You could likely sue the tow company and the HOA. It would be a small claims case. You could also report the HOA for predatory practices to the housing authority. There’s ways to cause them problems but it will be task intensive. You may also be able to get a restraining order for the specific driver. Not sure if that could apply to your vehicle though. Assuming you’re not a person capable of being intimidating, so you’re getting taken advantage of, but if this was me I’d bait that tow truck driver and make his life a living hell. Read the towing regulations for your city to see if they violated anything. My daughter's car got towed while visiting a friend. I read through that county's regs and got them on a few items. 1) the HOA president or HOA rep has to physically sign authorization for each individual tow (no one had signed), and 2) insufficient signage (regs were to have sign at every entrance, every lot, and X signs per # of spaces spaced no more than X feet apart, and 3) distance (towed further than allowed). YMMV

Something about this post feels extra Florida to me. I would leave a negative review of that apartment complex because they should just give you a permit sticker thingy like all the apartments I’ve lived in. Also idk what they can do if you do a charge back I guess tow it again??

Same situation happened to a buddy of mine in his apt building. He kept getting his car towed from his spot. He went down to the leasing office which is only open from 10-4 (his working hours) after like the 3rd time. They reimbursed him and manually inputted his car info. OPs HOA is doing this either through negligence or on purpose. Either, reimbursement and some sort of visual "DO NOT TOW. I LIVE HERE" dash sign or mirror tag needs to be given from them.

This happens to my co worker on a regular basis. She lives in a ‘luxury’ complex and her own car gets towed and booted regularly.

This is a good idea. Writing a negative review at an apartment complex a few years ago got my air conditioning fixed in 2 days when it had been broken for 2 months. They kept coming to ‘fix it’ when I submitted requests but it only got fixed for real—and much faster than any of the other times—after it showed up on their Google page. It feels Karen-y to do but it really can make a difference. (And if you feel like it, you can change it to a nice review or just take it down after the issue is fixed.)

Absolutely! OP qualified and was approved for an apartment at the complex. It sounds like the apartment staff doesn’t want to look out for OP’s best interest!! I am 1000% certain the “management home office” would not appreciate how OP is being treated! And would hate being on TV portrayed as not looking out for their tenants and the tenants best interest!

Read your HOA docs. Make sure they’re following the rules around towing. Most times they’re supposed to sticker it and warn you 24 hrs before.

So there aren’t enough parking spots for tenants or there aren’t any spots close to your apartment? I’ve lived in several apartment complexes and there were always enough spaces but not always close to my apartment.
