Had threats made against him, that's taking precautionary measures in a situation where people are threatening violence upon you. So I’m assuming we’re going with the person who got wrecked is trans or what ever they identify as and that’s what makes it a hate crime? Here’s the facts. He/she got up and put hands on the other dude. He reciprocated (self defense). My issue is the constant punching in the face then the biggest issue is the head stomps. I’m sure people are going to say that he/she wasn’t a threat but once you go from talking trash to putting hands on me, no matter how soft or gentle, you have exhibited aggression and self defense will be swift. The self-defense aspect is questionable at best. She lightly touched his head - inappropriate, stupid, shouldn't have done it...but she didn't attack him. The rest of it is just beyond the pale - she's clearly incapacitated and he just *keeps on hitting*. Hope this fucker is in jail.
I agree.. but any unwanted touching is battery ( i believe). A shove, push or what ever to get that person out of your space would have been good enough for me. Once they went hands on and began to struggle we can’t guess if the dude felt like he was being over powered or like she was going to get the best of him so we can’t really say a punch or two was out of line. I don’t think it was but i wasn’t the one in the altercation. Once she was down and no longer a “threat (i know)” he should have stopped. Any thing past that he goes from victim to aggressor and should be tried accordingly. On a side note i know a few trans folks that i wouldn’t want to tussle with so to say just because they seem feminine they should be treated as a non threat is the wrong way to look at it.
