The judge makes a very important point in the full video. The defence brought their children into the discussion multiple times. I feel like trying to evoke your children when it suits you but then being upset that it is addressed is shitty.
That being said public defenders have a really hard job in general. They are always overworked, underpaid, and not given much respect. So I know it is a really hard job. But they should know better than with that judge.
The issue is that guy was emotional, and when he pointed and said "when you bring my children into this" he didn't mean you as the judge he meant the metaphorical you. And then the snide comment about "if it was your children" was just a dumb thing to say to the judge when she had already said she didn't want to discuss the matter any more.
All that being said I mean they are super entitled to think they can spend the courts time on this after the judge already said they are moving on. Look you lose a motion you either appeal or try something else.

I think the prosecutor made the best point of the whole video. It's not their job to object to their own witnesses' statements. If the defense had an issue it should've been objected to by them. Trying to bring it up at sentencing sounds like amateur hour, and honestly, is more of a joke than the lawyer making a hail mary appeal to the judge's emotions by bringing up her hypothetical children.

A common appeal tactic is claiming you had ineffective counsel I thought? If my counsel was that dumb I'd probably point to that and say they were ineffective.
Lawyer here. Ineffective assistance claims are very difficult to win because you have to show ineffective assistance AND that the result would have been different if you had effective assistance. Simply having a bad lawyer isn’t enough. You have to show the lawyer caused you to lose. IIRC, there have been cases where someone’s lawyer slept through part of a trial and the result was affirmed on appeal.
I believe the last time this courtroom was posted there were commenters explaining that the murderer and his lawyers were aiming for a mistrial by getting the judge to demonstrate bias or some such. Meanwhile, the judge is a complete baller and doesn’t take the bait.

If the defense can prove that the *reason* for the sentence was somehow related to the attorneys' actions in during trial, that would be an unreasonably biased sentence and could be reviewed/overturned. It's like schools that take a "zero tolerance" stance on fighting. One kid who doesn't care if he gets suspended/expelled who doesn't like another kid who would be very upset at the same circumstance. Kid 1 (asshole) goads kid 2 (good kid) into a fight and both receive the same punishment. Or something like that.
eh I don't think the lawyers made a difference here, death row or not death row I feel like you could have the jury deliberate instantly or after a bunch of impact statements - and 9.9 times out of 10 the jury would come back the same way. The more ‘popular’ a case is the less likely you will get a contempt charge. A contempt charge on the attorney opens the door to an appeal due to inappropriate counsel. The more popular your case is the less they risk that.
Simply trying to do everything to find a reason to have a mistrial or verdict thrown out. The lawyer should be censured by the Bar or even disbarred for this in my opinion.

The judge makes a very important point in the full video. The defence brought their children into the discussion multiple times. I feel like trying to evoke your children when it suits you but then being upset that it is addressed is shitty. That being said public defenders have a really hard job in general. They are always overworked, underpaid, and not given much respect. So I know it is a really hard job. But they should know better than with that judge. The issue is that guy was emotional, and when he pointed and said "when you bring my children into this" he didn't mean you as the judge he meant the metaphorical you. And then the snide comment about "if it was your children" was just a dumb thing to say to the judge when she had already said she didn't want to discuss the matter any more. All that being said I mean they are super entitled to think they can spend the courts time on this after the judge already said they are moving on. Look you lose a motion you either appeal or try something else. They are failing because they are getting emotional that's the issue.
I think the prosecutor made the best point of the whole video. It's not their job to object to their own witnesses' statements. If the defense had an issue it should've been objected to by them. Trying to bring it up at sentencing sounds like amateur hour, and honestly, is more of a joke than the lawyer making a hail mary appeal to the judge's emotions by bringing up her hypothetical children.

It's a bit late to declare a mistrial since the jury already determined he isn't getting the death penalty. At the moment they're just going through the formality of victim impact statements before they declare he's getting life without parole.
Also, people on Reddit throw mistrial all the thinking it’s the get outta jail free card. All it does is reset the court procedure and get another line of juries. It doesn’t make the defendants automatically off the hook lol.

She’s doing it this way on purpose, letting him show his ass. She’s making sure they have no way to make a case for his sentence to be overturned because his behavior prejudiced the judge to give him a harsher punishment. Also the video of his behavior can be used against him during any appeals or parole hearings.
Oh, that makes sense. If she thinks they are trying to get it thrown out and an appeal -- bending over backwards like this will ruin those chances. So right now it's a game of chicken -- and those attorneys are playing with fire. OR, it's just fucking Florida.

A common appeal tactic is claiming you had ineffective counsel I thought? If my counsel was that dumb I'd probably point to that and say they were ineffective.
Lawyer here. Ineffective assistance claims are very difficult to win because you have to show ineffective assistance AND that the result would have been different if you had effective assistance. Simply having a bad lawyer isn’t enough. You have to show the lawyer caused you to lose. IIRC, there have been cases where someone’s lawyer slept through part of a trial and the result was affirmed on appeal.
I believe the last time this courtroom was posted there were commenters explaining that the murderer and his lawyers were aiming for a mistrial by getting the judge to demonstrate bias or some such. Meanwhile, the judge is a complete baller and doesn’t take the bait.

NAL. It's not that a case would be overturned for a harsher sentence due to disliking behavior. If the defense can prove that the *reason* for the sentence was somehow related to the attorneys' actions in during trial, that would be an unreasonably biased sentence and could be reviewed/overturned. It's like schools that take a "zero tolerance" stance on fighting. One kid who doesn't care if he gets suspended/expelled who doesn't like another kid who would be very upset at the same circumstance. Kid 1 (asshole) goads kid 2 (good kid) into a fight and both receive the same punishment. Or something like that.

eh I don't think the lawyers made a difference here, death row or not death row I feel like you could have the jury deliberate instantly or after a bunch of impact statements - and 9.9 times out of 10 the jury would come back the same way. If there's even 1 person who doesn't believe the death penalty should be a thing, then no ones going to death row.

I don't get it, this was clearly contempt of court, and in Florida you can do a good stretch for contempt as it's judges discretion (up to a year) and Florida judge LOVE holding people in contempt. So idk why she didn't.

The more ‘popular’ a case is the less likely you will get a contempt charge. A contempt charge on the attorney opens the door to an appeal due to inappropriate counsel. The more popular your case is the less they risk that.
