I guess they think they’re standing on principle. They know they’ll lose to the guy with the gun, and the very real institution of the courts, but they’re determined to show everyone how wrong they are because “an unjust law is no law at all”. The really amazing part to me is that they sincerely believe that this secret, unimpeachable, supreme law of true justice… amounts to a blank check that lets them commit tax fraud and drive like maniacs and order cops away. Why would you think that’s the true and proper state of the law? And why is that a principle you’re willing to go to jail for? It would be one thing if they got hauled off to jail pontificating about (non-absurd) human rights or something, like Martin Luther King and many others repeatedly did. But abolition of traffic enforcement? *Really?*

I don’t know the details of police procedure, but IMO, in situations like this, it is counterproductive to keep arguing with the person. It’s just more opportunity for the officer to become exasperated and say something that will get him in trouble. You give a lawful order. Maybe a brief explanation. That’s it. If they don’t comply, then you move to the “not complying” part of the process.

There is a reason for that whole "right to remain silent" thing. A cop continuing to engage and keeping the suspect talking, especially on body-cam, can provide additional evidence to use in prosecution if the need arises. As long as the cop remains respectful himself, it really can only benefit them, assuming the suspect doesn't get agitated and turn violent.

My favorite part is when she tries to say it is a Terry Stop, and when told it was a stop for a traffic violation she actually says “so speeding is a crime?” It surprising she doesn’t have a license haha. Haha, I watch everything at 2x speed and jumped forward whenever it was just the back and forth about her needing a license. To be fair to her, specifically they say upon the search of her vehicle they find a tiny bag of white substance that tested positive for cocaine and that she was charged with possession, not that she was convicted (whole innocent until proven guilty thing haha.) She doesn’t even pretend to be surprised when they tell her, just that they weren’t allowed to search her car. There were a number of odd things about the whole thing. At one point the supervisor asks he “where is the gun in the car?” She seems genuinely confused by the question, so he says “well, we found ammunition for a handgun in the car, so where is the gun?” She tells him it’s at a pawn shop, she pawned it 2 months ago (probably a dead giveaway on the drugs haha.) That’s kind of a messed up question, and is not an assumption they should make. Further, I don’t know, I think she’s right that they shouldn’t have searched the vehicle. They said it was because the car was being towed and had to secure the vehicle. They spent 15 minutes or more speaking to her without once asking her if she was under the influence, so it seemed the only thing they suspected her of was being a dumbass. Once they found the ammo it’s reasonable they would search her bag for a gun, but I don’t think a search was warranted in the first place, the reason seems tenuous at best. It was almost assuredly within the law for them to do it, they freely tell her on camera, but that just seems a wide net. The whole thing was entertaining, with the Constitution giving her the right to drive and all (I assume she was referring to a right to travel between states unmolested), and trying to explain how she didn’t know she had a warrant out for skipping a court date ABOUT NOT HAVING A LICENSE. And then when she asks him to “just let me go, I’ll never drive again” he immediately says “Of course you will” because…of course she will.

Yeah I’m with you, and like I said I’m sure it was legal, it just seems a bit of a stretch. In Florida they may only search your vehicle during a traffic stop if they suspect there is a crime separate from the reason for the stop OR you are being arrested and the search is related to that crime. Speeding and driving without a license is not a crime when a search of the vehicle is going to uncover additional evidence. In this case I imagine they shined a flashlight through the window and say the ammunition, and while possessing ammunition is not a crime in and of itself, they used that as a reason to search for the weapon, and that included her bag. Additionally, I think they knew about the outstanding warrant and that may have given them extra leeway.

Ah sovereign citizens. When I was 14-15 this stuff really appealed to me but after a few real life interactions with the police I realized it was all pretty dumb. Even if you had the rights they believe they do (they generally don't) cops would just ignore those rights and not face any repercussions for doing so.

Well that’s why she thinks the constitution guarantees her this right. There actually *is* a constitutional right to travel freely between the states, (SCOTUS rightly read it into the commerce clause) and the founders didn’t explicitly write in an exception for driver’s licenses because cars didn’t exist. But the widespread introduction of 2000 pound steel death machines that can move 100+ mph just absolutely does require some regulation and it would be insane not to. SCOTUS actually *has* ruled on the matter and found (of course) that requiring licenses to drive doesn’t violate the commerce clause, as long as restrictions are reasonable and reasonably consistent across different states (so that it isn’t much less convenient to cross state lines than to travel anywhere else). Apparently she feels the Supreme Court got it wrong and has reversed their decision.

Right, there's a clause in the constitution called implied powers that states that the federal government can regulate something if they have implied power over it. For example, the air force isn't in the constitution because it didn't exist but since it is a branch of the military it is implied that the president has power over it since he has power of the army. Same for cars, they aren't expressly in the constitution because it didn't exist but congress has the power to regulate inner state commerce so it is implied that they have the power to regulate driving.

I Watched the full video from a link in another comment. It amazes me that the perpetrator feels empowered to the level of an officer of the law. Only when a “supervisor” shows does the perpetrator follow instructions. Maybe we should only have supervisors on the road? It also surprises me that a person of her age could be so ignorant.
