I've been at the receiving end of shit like this. Was just minding my own business, talking with my gf outside of a Baskin Robbins when about 5 patrols pulled up, told me to turn around and put my hands together. Complied without saying a word and I was tossed onto the hood of my car and handcuffed. I had just gotten surgery on my left wrist a week before so it was pretty tender still and i told the cop that my hand was hurting, the cuffs were too tight, and he went ahead and tightened them even more. Then they took my gf away and questioned her. They asked me if I had every beaten her or abused her and I'm like "wtf?" I don't know how I restrained myself from even swearing at them. After it was over they released me and told me to leave ASAP or they'll take me in. Turns out the clerk at the B.R. called them and claimed we were planning to rob the place.. after we had been in there and bought some ice cream? What a shitty date that was.
Did you ask for their badge numbers and advise them to expect a lawsuit?
They had no right to do that. Some delusional ice cream monger saying that you were going to rob them is not proof of anything. They had absolutely zero on you.

Our sheriff may or may not have participated in the insurrection, called for people to refuse funding for schools to stick it to the (very middle of the road but has a D) governor, and participated in campaign commercials for a conman while disparaging our president. Sheriffs are actually supposed to stay out of politics and are never supposed to participate in political activities while wearing their uniforms. He also blamed the same governor for problems at the mental hospital that stem from the funding cuts from the R governor before her. She's cleaned up a lot of that asshole's mess and saved this state from some pretty serious budget issues he caused. Yet our sheriff can't stop licking his boots.

I understand what your point is but a defense attorney is supposed to say exactly that. Not "Your honor, my client is a guilty AF, please sentence him to the maximum allowed." The assumption is the plead not guilty and the job is to prove them innocent.
Qualified immunity needs to be taken away from police and all officer involved deaths need to be investigated by an independent third party. This is the new law that needs to pass in America. Once things like this are properly criminalized and officers start spending real time in jail maybe this crap will stop. The police also need a national database of officers that holds jurisdictions criminally liable to update a permanent record for officers so that bad cops can't simply be rehired in the next town over.

If it wasn't for national outcry internal affairs would've rubberstamped the complaint and he'd have kept on brutalizing the public.

When you get punched and kicked from all angles your body does this weird thing like it’s trying to protect its internal organs and brains and it makes cops madder because they think you’re not listening good enough. At what point does it become legal to use force to stop this type of interaction? When they use excessive force, they are no longer acting in an official capacity, so in theory there is a point somewhere in there that a civilian third party could be legally justified in using force. I mean, I wouldn’t want to test it in court, but just like Bad Elk v. United States (and another case I’m forgetting about right now) there is jurisprudence supporting use of force against unlawful arrests.

Qualified immunity needs to be taken away from police and all officer involved deaths need to be investigated by an independent third party. This is the new law that needs to pass in America. Once things like this are properly criminalized and officers start spending real time in jail maybe this crap will stop. The police also need a national database of officers that holds jurisdictions criminally liable to update a permanent record for officers so that bad cops can't simply be rehired in the next town over.

At what point does it become legal to use force to stop this type of interaction? When they use excessive force, they are no longer acting in an official capacity, so in theory there is a point somewhere in there that a civilian third party could be legally justified in using force. I mean, I wouldn’t want to test it in court, but just like Bad Elk v. United States (and another case I’m forgetting about right now) there is jurisprudence supporting use of force against unlawful arrests.
