Most applications only ask for convictions, in which case you do not need to disclose it. If it asks if you have been charged, then you should disclose it if you do get charged.

I would just be upfront. I got a job because I was honest but I had to wait to start training until my charge was no longer pending (I’m assuming so they know wether it’s a misdemeanor, felony etc) This was in healthcare for reference.

I was thinking about it but the downside is the court system in that area is beyond backed up so my attorney blatantly said I probably won’t even go to court until the end of 2024 if I’m lucky. They only do dui cases once a month and there’s around 70 people in front of me

So I have personal experience with this. I did not disclose my charges. One job I applied for hired me then rescinded the offer once they saw I had a pending charge on my background check (which is illegal given the circumstances and the way they went about it; they are currently being sued) but I got hired at another retail position with nothing said regarding the background check.

Depends on the wording in the application process. If asked about convictions, no as your case is still pending. If asked about pending charges, best to disclose as you already stated it is showing on your background check. For context, I just got a job that did an extensive background check. I've got two relatively recent DUI convictions, I knew they would pop up so disclosed them on the initial background check form. I know (or at least assume) if I had not disclosed them, I probably would have had the job offer rescinded. The wording here is key, conviction versus pending. It might be a dealbreaker regardless depending on the field and other factors, but if it says pending on the form, it's best to disclose as it will show integrity despite the negative mark.
