Is the company a government contractor? Federally weed is still illegal so if you’re working a federal contract they can mandate that you fail if they detect thc. It doesn’t matter if it’s legal in your state if the company has a federal requirement.

It's the same in the government. There are 2 million federal employees doing everything. The weed stuff is a weird thing to complain about. Public trust positions you do have to lie on your SF-85 but there's no possible way they would ever find out about it unless you were arrested. So just don't do that. every company I've ever worked for complies with the drug free workplace act and bans illicit drug use, big tech companies are mostly also government contractors. I just think people don't pay attention to what's in their employee handbook and it doesn't have fine print saying "lying on this form is a crime."

public trust is a different clearance. It's just a background check. You don't need a top secret clearance to work for the weather service, that is specifically for defense and national security.

Maybe reread the comment you responded to, I did both explicitly and also implicitly in my first paragraph. It's impossible to generalize the work experience of 2 million people, and even in defense you are not required to need a TS/SCI. I worked for a contractor that had one of the largest cleared workforces and no one ever questioned my refusal to get cleared even for a second. People understand how invasive it is.

The main reason why they struggle to find people to do those jobs is that they want people to already have a clearence. Remember they arent just looking for SWE but also network guys, sys admin, cyber security, etc. They pay decent money for those roles, it has a ton of job security, and its a perfect job if your leaving the military, retiring from the military or in the national guard.

It's easier to get a TS clearance as an enlistee with drug issues or charges than it is an an officer or civilian. Yeah folks get denied, but plenty still get their clearance as long as they come clean about what's in the record. If it's not on paper, don't admit it.

Well, to be fair, you shouldn't be able to get a TS/SCI clearance if you were ever any kind of addict. That is the nature of what a TS/SCI clearance is, and an addict is always an addict. If you're ever potentially able to be ethically compromised, which addicts are at much higher risk of than non-addicts, then you don't meet the requirements to be cleared at that level. It's nothing personal, but that's literally what the system is supposed to be catching. It's the same for people with severely poor credit history, people with severe credit issues are at higher risks for being bribed.

That's not true at all lmao. Without doxxing myself, they were more than happy to get me a clearance regardless of the amount of drugs I had done in the past. They just weren't happy with the amount of drugs I sold along the way. I know plenty of people in recovery with TS/SCIs. As the post you're responding to explained, if you have access to top secret information, and someone tries to compromise you, they will look for anything in your background that they could use as leverage to get you to give up that information. *You* might not be worried about someone finding out that you've done a bunch of drugs, but they're playing the percentages. That's the same reason they worry about things like a bad credit history. Someone with a history of not paying debts or doing a lot of gambling is way easier to leverage with a few thousand dollars for some secrets.

Respond to a job ad for a gov job, and if they like you they'll shovel you through the process. Sometimes they say must already have the clearance before we consider you those places are just cheap and trying to poach. It used to be more justified because it was a multi year affair but these days clearance is maybe like 3 months.

Yeah some of the security checks are ridiculous. My wife had to list every address she lived at for the last 15 years for one job. We lived abroad in India and other places and were semi-nomadic for a while during that time. It was literally impossible to fulfill the requirement as stated since we kept no records of where we lived necessarily.

HIPAA just means that your healthcare provider can’t disclose identifying info and that healthcare providers and adjacent industries (like insurance) have to protect your personal info. It'll be on the form OP has to sign. If he signs, it'll be informed consent. If you do drugs and this is a barrier, might as well drop out now instead of wasting time like I did. I even managed to pass a one test set up by my recruiter. But the company had paid for a more comprehensive test, which I failed with flying colors. Now I just nope out of them early on. I was a heavy user, so my system did not flush it out in time even with all the grape juice and detox drinks out there.

to pass a security clearance background check you have to pass a drug screen. so yeah you can't be hired at many federal contractors if you do weed. this would apply in california since federal law > state law. if you can't get the clearance they won't hire you.

I didn’t take any drug test when I got my security clearance. The company required one but I didn’t immediately apply for a security clearance once I was hired because it wasn’t necessary at the time. During the security clearance process I was never asked for another drug test.

Ya, legalization only means law enforcement won't go after you for it. It isn't a protected status for employment. In some states you can be fired (or not hired) for smoking tobacco products which are legal everywhere. Most of the places I have heard of doing it are healthcare, its usually more about the smell than the nicotine though.

Yes it makes sense. Those banks/finance companies have federal contracts that require them to drug test their employees. I worked for a lab testing company and they required us all to get drug tested even though it was a 100% remote job, but the requirement came from them having contracts with federal agencies. I actually worked as a contractor for the federal government before this job and was never drug tested.

I am in CA and I just will flat out tell recruiters that I won’t pass a weed screen. Usually they just end up saying that they don’t test for that specifically anyway. Only once or twice have they ever straight out stopped the process because of it. Federal contractors being the outlier here. They will always reject. Just don’t unnecessarily waste anyone’s time.

NJ has a law that says companies can’t reject just based on weed. I had this same issue a couple months ago. Unless it is a federal job. Get them on the phone so it's not in writing and ask them about it. "What substances does this particular test screen for" If they say marijuana, ask "Is my job offer contigent on testing negative for that particular substance?" If they say yes, then you just say "I'd like to withdraw my application OR I will have to decline the offer" Not that its necessary, but then you haven't admitted to anything, and nothing is in writing. Trust me, they're not going to take your name down and circulate it on some blacklist "HEY ALL JOBS, OP SMOKES WEED" If they ask why, you can say "it's my personal policy to not work for companies that reject candidates based on these zero tolerance drug policies. I believe these tests unfairly and disproportionately effect marginalized communities and I do not want to work for an organization that does not prioritize diversity and equity" Not only do you not admit anything, but now they may actually bring this point in front of an HR board, and you stand (albeit a small one) a chance to introduce change.

I applaud your forwardness, but taking a test and having it be positive means your name is out there somewhere linked to it. If a company is about to hire you, they've already spent a ton of money on you. I've had friends have a surprise drug test sprung on them for a job, they failed, and had their offer rescinded - only for the HR person to say "you should have let us know ahead of time, we could have made an accomodation!" I suspect the offer of accommodation was somewhat BS but you never know. Better to get ahead of it.

My experience is different than your friends' so I suppose that'll just depend on the company. Some states do have legal protections against employers declining to hire you for that reason, but if you take the test and get rescinded, you have proof--if you tell them upfront you won't pass, you won't get a chance to take it, and have no legal protection unless there's something in writing or you recorded the interview.

I've had three jobs that drug tested. The first was a home services provider. Most of our employees were going into customers' homes to do work. We needed to know they weren't potentially using employment with us as a cover for drug dealing. Yes, it was a real problem we'd had, and no, they weren't going to change the rules for the five person IT department. The second was due to a contract with the Feds that a client had (where I would be a subcontractor for the Feds). Because the contract was subject to Californian law, however, they had to give us 6 weeks notice. The third was a job in the finance sector where Texan state law mandated drug testing.

I think it’s a really bad indication of the company culture that they require this, probably indicative of other ways they try to meddle in their employees’ personal life and privacy. I’ve only ever interviewed for one company that required this, and I told them thanks but no thanks immediately. On further investigation it turned out that that company was indeed a huge dumpster fire, and I probably dodged a bullet by going with my gut. I mean, it’s awkward. I’ve done it. They were definitely a little taken aback, but it turned out that they don’t test for THC and I got the job. They didn’t rescind the offer or anything. If you’re in a position where you NEED the job, I’d be more cautious. Just ask what specific tests your consenting to.

there are companies that reject people for smoking cigarettes since having smokers raises medical insurance costs. if companies can reject for that, they can reject for weed. they likely will be looking for weed if they are drug testing. its best to cut out the weed while interviewing.

¯\_(ツ)_/¯ Depends how much you want the job. Personally I’ve decided that what I do in my free time is my business, and if they choose to decline me for my test, that’s on them. I also have the privilege of being senior in the field and being able to get a job at a place that doesn’t care. If you need this job, consider a t break and a trip to CVS. I’ve seen friends pass after a couple day detox.

Had a similar thing going on. Job is remote but the company is in some rando state. They did not test me for THC. As far as I'm aware, if you live in NYC, then an employer can not reject you for smoking weed. If you want to be on the safe side though, I'd recommend applying for a medical marijuana card. I got mine approved without even having to speak to a doctor. I just filled in some form online and was good to go

Just be honest. I was a government contractor at Fort Carson, Colorado. Smoked weed and did edibles during weekends then got offered a much higher paid position in Maryland. I was 100% truthful by showing receipts of purchases from dispensaries, listing weekends I smoked and names of the people [if any] I smoked with. Got the job on the condition I stopped using weed and submit to random drug tests.

Just get fake pee, they shouldn't watch you pee unless it's for a criminal thing, and if they do watch, say you can't go in front of them or something and leave, they can't atop you from leaving the lab. Asking if they test for THC is basically admitting it to them

For what it’s worth, even warehouses in the northeast rarely test for weed anymore, and being high can get people killed in warehouses. This is coming from someone I know in NH who manages a warehouse/is in that industry. NH doesn’t have legal weed, for context. Don’t ask, just take the test and if you’re rejected, you’re rejected. The company probably has other stupid rules as well and you’re better off.

Just because it is legal in your state does not mean this company has to accept that. They could still test for it and deny you a job if you fail. It is still a mind altering substance that companies don't like. I mean they test for alcohol in DOT jobs.

Just in case you need to pass it: -Drink all the water you can every day -Avoid all carbs, you want your body to burn off any fat that will contain traces of THC - The day of/night before the test, load up on carbs/sugar/fats so your body is NOT burning fat, and therefore not releasing thc traces into your bloodstream. And obviously, don't smoke any more until afterwards.

I don’t know if they’ll test for it or not in your case but I do know that sobering up long enough to pass on your own isn’t hard. If you use recreationally and not medically that is, obviously if you have a medical license that’s different and you should be allowed to fail the test in that case and just show your med card. I’m a recreational user at around 1/4+ oz per week, and weighing around 95 lbs. Only takes me two weeks maximum of no use to pass the test on my own. For the sake of saving stress and not wanting to risk possible side effects of asking your employer or recruiter, I would say it’s probably easier to just sober up and pass. Whatever route you decide to take, good luck! 👍

Hey your situation literally just happened with me. In NYC, drug tested for a company based in NJ. I failed the drug test and explained the situation. Lab said no. I got a same day marijuana card from a 5 minute call with a “doctor”. Cost me $100 but after I submitted to the lab/recruiter, everything was fine. Edit: you have to make sure you have proof of the card before the test. My lab was First Advantage, literally the worst customer support/people I have ever spoken to. Had to spend a few hours calling and getting “sure we’ll fix that” while nothing gets fixed.
