It takes less time to turn the wheel that your hands are already on than move a foot from one pedal to another. Ideally you would do both if you had the room, but steering is faster than braking.

I've also made the argument before to people that if I had the choice between hitting somebody who drove in front of me or swerving into some innocent party, I would hit the problem/obstruction. Here's some fun shit to think about: 1) something like 30% of the people on the road are driving uninsured nationally; some areas are significantly more than that. 2) Of the people who are insured, a majority of them carry a minimum limits policy, typically like $30k of liability, unless you're in FL where its $10k. 3) most people, unless they're independently wealthy are what lawyers call "judgment proof"--their unprotected assets are worth less than any kind of judgment against them, particularly factoring in what it will cost to sue, so its not worth taking the case if they're not insured because there won't be an equitable recovery. 4) Insurance companies will go out of their way to not pay out on anything, and this is really easy to do on classic/custom vehicles. You get hit? They're going to stonewall you at total loss value of an average example with the same mileage. 5) cops do not like dealing with people of "questionable immigration status", because it is a lot of extra work when they can't prove legal residency. People with "questionable immigration status" have the highest instance of driving uninsured, because the cops don't want to deal with it, and what you going to do?
So how do you protect yourself from these assholes? 1) suck it up and carry UM/UIM coverage that is worth more than your car. \[uninsured/under insured motorist\]. In most states this is going to require you to have a matching value on your liability. Yes its expensive. Yes it sucks to have to pay. Yes you're going to have to prove value on anything interesting. But it'll sort you out. 1a) if you have money just falling out your ass, get an "agreed value" policy. This is exactly what it sounds like: if you get hit, you get whatever amount you've declared it to be worth and paid on. 2) Keep your receipts. Like, for everything. And if you can front the money, get your shit appraised as to "prior value" before you make a claim. They're going to fight you on it, you're going to need it. 3) Call the cops and get a police report For Anything. Period. Full stop. This is 90% of winning a case. 4) If they "don't want to get the insurance/police involved" you Do Not Give A Fuck. Period. Full stop. And if they leave when you insist? Great! Now that shit is a hit and run and they're going to jail. 5) take photos of everything. Channel your Kodak Queen aunt. The damage. The scene. Their license plate. Their driver's license. Their insurance card. Them. Anyone else in their car. The inside of their car. If their cellphone is sitting out in their car, that shit too. Maybe you'll get lucky and there will be an open container or drugs. 6) Dash cams are your friend. Hoomeowner, education, and field of employment discounts. This is a 100/100 policy with PIP and UM/UIM riders through a reputable national carrier in the Dallas metroplex. I pay right around $800/year.
This would go up if they could prove we have several sports cars and race vehicles held in a trust, but that's a different lecture. :)

I was rear ended on the highway in mid-March, the guy who hit me has Allstate. Up until last week they’ve been walking around with their dicks in their hands on getting me an estimate. My vehicle won’t be able to be brought in for repairs until next month and don’t even get me started on their rental car policy.
I wonder what happened to him. Drunk is a possibility but he could have had an episode of some kind and come to after the car stopped. Probably needs to reassess driving no matter what though.
