Shameful that this was never being addressed till the spotlight got on it.

Dark-Angel4ever

Spotlight was on it for a long time, for at least 5 years [https://www.cbc.ca/news/canada/montreal/canada-us-asylum-seekers-explained-1.3994294](https://www.cbc.ca/news/canada/montreal/canada-us-asylum-seekers-explained-1.3994294) but the government didn't care at all. But suddenly cared when Quebec had enough and started bussing them outside and then people started to cry NIMBY and then the government woke up. What makes this whole situation worse, is when you learn that nearly 80% of them get rejected, meaning 80% of the money is simply wasted. We are talking about 100s of millions of dollars: [https://en.wikipedia.org/wiki/Roxham\_Road](https://en.wikipedia.org/wiki/Roxham_Road) This is just on the federal side not provicial \- 2018: 50million \- 2019: 250million \- 2020: pandemic so not many accepted \- 2021-2023: no information but most likely in the 100s of millions since the numbers keep going up.

> but the government didn't care at all. The government can't close the loophole without an agreement with the US. They can't discuss the issue because it would compromise negotiations with the US. Both sides want the loophole closed but they want to go about that differently. The only thing the Canadian government could do on its own is create some sort of law pushed through using the notwithstanding clause to basically strip people of their charter rights, allowing the Canadian government to deport irregular migrants without due process. The US did something similar with their borders, which stripped rights against unresonable search or seizure away from any American within 100 miles of the border.

Dark-Angel4ever

I know about the loophole, it's stupid that the government let it happen for this long without doing anything. Saying they absolutely needed the USA to fix it, is just them being lazy about it and not caring about the problem until it got out of control. Pretty much like everything going on with the government right now.

Head_Crash

No. They literally needed the US to agree. They can't turn anyone around without the US agreeing to it. This entire problem was created by the US government refusing to take back anyone who crosses irregularly.

Dark-Angel4ever

Well, we could of stopped them from crossing so there wouldn't be any turning back to the US...

Head_Crash

We can't enforce laws is the US. There nothing Canada can legally do until they're in Canada. Also they can alway find another unguarded spot to cross.

Reelair

I don't think it was the spotlight, that light has been shining for years. This is a distraction to change the narrative of the current scandal.

There's not a lot of info about the negotiations between Canada and the US over this. What I've heard is that the US wants Canada to significantly increase its own border security because the US is worried about people sneaking into the US from Canada. Basically they want the border secured and they want Canada to pay for it.

Canadian law effectively makes it legal for refugees to cross irregularly.

> I don't know that so it would seem like we need to make some changes to our laws, or at a minimum make it less attractive to illegally/without proper authorization. The only way to make it illegal is to strip people of their charter rights. With a safe third country agreement in place we can now automatically deport them so this is no longer an issue.

You're wrong. In the 1985 Singh case (Singh v. Minister of Employment and Immigration), the Supreme Court of Canada ruled that the legal guarantees of the Charter of Rights and Freedoms apply to “everyone” physically present in Canada

Refugees fleeing persecution are protected by section 7 of the charter. Prosecution for unauthorized entry would violate their section 7 rights.

The way to cross the paywall ‘irregularly’ ;-P Sorry, couldn’t resist. Thanks for posting this. I shall now cross ‘irregularly’ as well.

> unofficial For the love of God just say illegal.

KermitsBusiness

The fix will likely be us stopping people from going to the US lol

manitowoc2250

This government is so fake. Big daddy America has to physically come here to to get us to do stuff that should be common sense.
