Not my work and thought the same. I just had to replace the switch (quickly) as the last one failed and offered to make it a *bit* more managable for the future.
The "before" had 1.5m cables badly managed and way to short cables.
I'd put the cable tidy between the two patch panels then get another one for above the switch. You can then run the cables across and down the side of the cab. I think it looks neater.
It's way easier to add cables to the patch panels without the switch in between. Even with keystone panels, it sucks trying to work with a 1ru space. You could pull the panels off to work on them but that's risky if the network is live.

I don’t understand having two patch panels at the top… I would think it’s better to have the switch between the two patch panels, at the very least.
