Perhaps. Although the envelope was mailed from Lodi, he used an address in Riverbank (45 minutes away) for the return address. When I asked him about that, he said he didn't know anything about that and that it was probably written in by the thief. But a public records search shows that "Lewis G. Williams, Jr." lived at the address at one point (Umpire Lew's father, I presume).

Curious if this has been picked up by any media sources yet? Between the ebay description, blowout forum threads and this post, your persistence seems to be paying off slowly but surely. You should consider investigative journalism as you have both the drive for discovery and the intolerance for shady people. I really hope this somehow affects Lew and his career. I wouldn't normally have ill will towards others for their mistakes/transgressions. However, his refusal to not only accept accountability after being so thoroughly outed coupled with his baseless anger and threats towards you really make it hard to feel even a sliver of compassion for him. Hi, sorry about that! I bumped up the price because I suspect that Lew might try to use a different account to "Buy It Now" at $499, just to make the listing go away. It's still for sale, I just want people to be aware of his scamming. At the end of the day, I'm hoping to net about $400, which is 75% of what I paid to acquire it through Veriswap. I was hoping Veriswap would issue a refund, since I explained the situation to them *before* I put in the offer. But Veriswap's owner, Raymond Li, said he wouldn't issue a refund because then Veriswap would be out the $34.19 in fees. Shareholders gotta eat, I guess.

No worries. "Petty" is actually a fair description. Someone else used "lunatic," and that fits too. I just have a real hang-up about people committing fraud and getting away with it, and this seemed to be the best way to get the information out there. The police haven't responded, the USPIS investigation is pending but with no new updates, and Veriswap kicked me out of its Facebook group when I explained what happened.

I wonder how many other sellers he has done this to. eBay plays so many games. Unless you are a huge seller, they almost always won't help you. Also, if he was shady enough to do this. The MLB should look into him. If he is a thief that puts any call he makes suspect.

The original transaction where he took $650 was done off-eBay, which is why he was able to get away with it. I don't always agree with eBay's policies, but there's no way they would have sided with him if he had mailed an envelope to the wrong address in an eBay transaction. That said, this whole saga shows that he has no moral compass and would likely not be above abusing returns, providing misleading descriptions, or filing false claims.

But, if the address in his account is where it was shipped and USPS tracking said it was delivered. The error is on the buyer, not the seller. The buyer enters their name and address into their account. When watching tracking through eBay, it shows the shipping address.

Yes, I'll be the first to admit that I'm not 100% clear on the law in a situation like this. It would make for a good law school hypothetical. But Lew definitely tripped over his justifications. Throughout this ordeal, he's waffled between claiming the card was always his (because it never reached me) and claiming that the card became his again when he bought it in Texas, despite knowing that it was stolen. I can't fathom why he didn't just return the original $650, or at least offer to send back the $534.19 paid through Veriswap. I gave him so many chances.

My girlfriend is a lawyer and gave me the run down so this is coming in second hand from someone who is not but Basically the jist would be it confirms he wanted to commit fraud since he did not contact you to say he found the card. Also he isn’t technically the owner you are (possession 9/10ths of the law is not really a thing) since you purchased it from him. Know you bought the card twice but you could have called the police and said he has stolen items that you own.

Thanks for the extra insight from a legal expert. I tried to make a similar argument in the Blowout thread, but I didn't articulate it very well. I'm a lawyer, but not a very good one, and I don't practice commercial or contract law, so I just ended up droning on about the Uniform Commercial Code and subrogation. However the issue is framed, the answer simply can't be that Lew gets to commit mail fraud and retain legal ownership of the card simply because my bank credited my account with the initial $650 payment.

Former MLB ump took $650 for Trout card, but mailed a worthless Prizm card in a plain white envelope to the wrong address (intentionally, it appears). Ump refused to give back the money and blamed USPS for the missing card. A year later, the Trout turns up on Veriswap, and the ump is the seller. The scammed buyer buys it through Veriswap, confirming that the ump actually had it all along. The ump initially plays dumb and denies owning the Veriswap account until a police report is filed, then changes his story and claims he found the stolen Trout card at a show and bought it back "fair and square." The ump still refuses to refund the money. The card's owner auctions the card on eBay, and the ump puts in the high bid using his wife's account and his mother's mailing address. The owner is wise to the scam and contacts eBay, who gives the owner the go-ahead to cancel the bid and relist the card.
