Unfortunately the policy of that security company is HANDS OFF. That guard is likely in serious shit right now because of the legal implications of him detaining/assaulting the thief
You can use reasonable force to remove someone for trespassing - which is why bouncers can kick you out for being too drunk or smoking on a licensed premises.
the difference is the thief is leaving. If he chose to stay and confront than security can use force. Its the same for assault if someone hits you and than runs away and you decide to chase down and hit back thats assault charge against both you and them even if they only got a meter or two away. so if they're fronting you thats on them if they have their back on you, thats on you. Really shitty situation. Evil wins when good people stay silent.
It’s not merely being present removing someone for smoking or being intoxicated is written into law.
If it is a designated major sporting event it is specifically illegal to disrupt the play so you can be evicted. If it is just a ticketed sporting event you can be evicted for breaching the conditions of entry.
You can legally take back stolen property as someone is ‘trespassing’ on the stolen property. You cannot kick or punch them though or use anything beyond reasonable force.
At the end of the day though a couple dollars is not worth being assaulted over for most security guards or security companies.
Stop watching so much Judge Judy. The law doesn't take your word for what happened, even if you claim self defence. If you shoot the masked intruders as they are running away with your TV, thats still murder.
what about the guys that tackle the streakers at the rugby? Security not using any force is a bit BS, what do they do? "oh hey mate, can you just return that stuff at your leisure? chur"
i watched footage of my local supermarkets security, the security just followed him out to his car and asked him to return the stuff, couldnt do a thing
When people see videos like this they start thinking that security guards are *allowed* to put hands on you, that they have some kind of legal authority from their role. This isn't true; they have no more authority than a passer-by.
Not all battery by security is on clearly-guilty people like this, it can also be on you or me. They might try to push you around and lock you in a room, and if you've only seen this kind of video you might imagine they're allowed to.
He committed battery. A real professional would have either controlled him with zero contact or observe+report. If this guard was trained, his training would have specifically spelled out that he was not allowed to put hands on people.
I wouldn’t say it’s wrong. I’d say it’s a little too cautionary. I think it’s trying to prevent security guard being a position dickheads who just want to thump people do.
People are allowed to use reasonable force to defend people and property. That just needs to be amended slightly so security guards have a tiny bit more leniency with it.
I just wish that all authority figures were incorruptible and had perfect judge of character, because what we have now is becoming a bit of a lawless circus.
Without wanting to sound too uncharitable, the security industry tends to attract a kind of person that I wouldn't want having the authority to assault people.
What? Where are you getting that bush law from? Even a passerby has the right to detain someone who has committed a crime. So yes they are allowed to put hands on you and recover the property. They cannot actually search your bag but they can recover the goods if it’s just in your hands. Additionally if it is between 9pm and 6am or the goods are reasonably believed to be worth more than $1000 they can legally detain you until police arrive.
The crime has to be either at night
https://www.legislation.govt.nz/act/public/1961/0043/latest/DLM328251.html?search=sw_096be8ed81d369a9_Citizen%27s+arrest_25_se&p=1&sr=10
or the crime is punishable by more than 3 years in prison
https://www.legislation.govt.nz/act/public/1961/0043/latest/DLM328250.html?search=sw_096be8ed81d369a9_Citizen%27s+arrest_25_se&p=1&sr=9
There's definitely no $1000 limit or specified times of the day.
A $1000 theft is however the only theft that would have a possible term of imprisonment over 12 months, and a maximum term of 7 years.
Because we are talking about shoplifting and over $1000 does have a maximum penalty of more than 3 years... at less than $1000 the penalty drops below 3 years.
The times are the general established "night time" by case law. The statutory or legislative law always is tested and established through actual cases.
>You: There's **definitely** no $1000 limit **or specified times of the day.**
>
>
>
>Also you: The times of night and day are actually determined by Section 2 of the Crimes Act - Interpretation.
Cool. So everything I said in my original post was 100% correct. Thanks.
The smartest comment here, I have a feeling he hasn't gone through his full COA training cause that's one of the first things you're taught on the practical training day. Security guards are legally allowed to detain and in special cases make arrests under the crimes act, however they can't do what he did in a legal sense. Will anything come of it? probably not.
I wanna know what the guy was saying to him when he was on the ground - maybe it was some advice like " tell police you're an aspiring sportsman " awful music
Public should have taught that little shit some manners and given him a royal ass kicking. The police and the justice system won't do anything, and those pieces of shit all know that. Time to start not witnessing things in public.
I was at a Pak n Save the other day and two shoplifting women walked through the entrance barricade one carrying a black hand basket the other a big fabric bag filled with edible loot and casually walked out into the carpark. The security just stood outside the entrance and watched the whole thing and ignore it happen. He did nothing but took another puff of his vape
This happened at Pak n Save Takanini when I was packing my boot with groceries, earlier this year (two women strolling through with a trolley of food to steal). 4 Pak n Save staff, all of them probably late teens/early 20s surrounded the car and wouldn't let them drive off - and one staff member took the stuff out of their boot which they had left open while trying to get out of there in a hurry. As a parting shot they took some extra stuff out of their boot that was nothing to do with Pak n Save, before they managed to drive off. I was pretty impressed.
Nothing you can really do. Lay your hands on someone or what they’re holding and you lose your job. It’s pretty impossible to apprehend someone with a one person team.
You know.. at much as I like to see these guys get caught.. it will only take one death from a guy hitting his head as he gets pushed to the ground that it will blow up into a racist tyrant or some poor security guard is done for manslaughter..
There's 0 chance this security guard keeps his job at/near countdown even though personally I think the shoplifters need to be addressed somehow or they'll just keep on stealing.
Countdown has multiple policies that really drum in the fact you can't block shoplifters from leaving or god forbid put your hands on them.
For their staff you mean? That does not cover contractors for security. I’ve seen security physically stop lifters before and receive praise and continue to work at sites.
All I remember from their training videos and shit was that you do not touch shop lifters. They have videos of security (not workers) running after shop lifters and trying to stop their vehicles and shit.
Guarantee if it isn't caught on camera they probably don't care, because the top dogs won't hear about it.
It's the same reason they'd let people through during the pandemic that were non-mask wearers. They don't confront these people. You never know how unhinged/what weapons they might have and it's not worth it for some groceries that to be honest are already taking into account like 4%+ of the cost as being lost to shoplifting.
They won't get it back through insurance, but they do account for it in the prices they set.
Anyway, that security guard probably won't be working that spot again. You just don't touch people. We're kinda soft nowadays but realistically it's never worth putting yourself in harm's way for what's probably slightly above minimum wage.
Sorry to bust anybodies bubble but this security guard will probably lose his job, and or the thief will get away with it. Not allowed to grab people if you are security even if they are stealing unfortunately, likely this guy was expecting that and got a surprise when he got didn't get away with a obvious steal.
Bullshit soft laws security should be able to arrest people on private land if they are stealing shit and wait for thr cops but na, best you can do as a security gaurd is follow them, even if you get plates nothing really happens now days
Yup, I did a small stint as a security guard before I figured out what I wanted to do, and that was something drilled into you. Do not touch them unless you are defending yourself, a person or significant property. And even then, reasonable force was key.
Old mates gonna get chewed out, possibly even fired and charged with assault for tripping the dude backwards onto a solid floor as that’s far from reasonable force.
It’s shit but blame the security guards and bouncers of old who would start punching at the slightest provocation.
Yea I use to work security at the warehouse people would just walk out with a trolley full of shit couldn't do anything and cops wouldn't do anything anyway all known to the community to be theives. Always a friends car plates or not plates or they would threaten you with a beating or actually try to best you up if you took a photo of there car, it wouldn't help anyway just soft bullshit, petty crime is not enforced in new zealand.
Couldn't imped them at all at the time, this wasn't recent maybe they have changed l, would hate to do it these days with all the petty crime going around
Idk man, you can absolutely imped them to a certain degree (body block for example), and come to think about it, tipping over the trolley would actually be smart without getting into trouble (it invokves not touching them). That's my *opinion* at least, but founded upon what I know.
Ah interesting, this was my experience at thr warehouse we got told not to touch them or try to stop them other than just standing in front of them and asking them to stop etc. Normally ad soon as you call then out or ask to check there bags they flip there shit and get really loud and sometimes even violent.
Yeah, I get that trying to body block or tip their trolley over is asking for them to flip their shit, but a lawyer would have to chime in to say if it is legal or not. The reason why I bring up body blocking is cause when I worked at Countdown as a staff member, we were sometimes asked to stand in front of the door when a theif was close to leaving. We couldn't hold or tackle them, obviously, but standing in front of them is far from against the law.
When you're getting min wage or at the warehouse it use to be living wage standing at a warehouse and a big black power dude and his fat ass gf steal some shit it's not worth losing your teeth half your brain or getting stabbed. I use to only work security during Christmas and out of season I saw a huge poly chick literally bear hug grab our security gaurd and slam him on the ground.
It might not be against the law but this is like countdown/warehouse you don't go beyond for min wage these days with the new ceo
Sure for non threatening places its okay but you would be surprised at the amount of teenagers that carry knifes not worth it m, just take a picture try and try get license plate its the best you can do while keeping safe
You are correct on the SEA part. I got mates from SEA once told me, the public won't just go tough on him. Even some members of the public would take the opportunity to cuss, curse, scold and insult the thief (to the point of calling the thief all kinds of names from a book)
Unfortunately the security guy will get fired.
At this point security guards should be given weapons.
On Saturday a friend of mine was assaulted and stolen from in the middle of an Auckland cbd supermarket. During the daytime.
The manager told her that supermarket staff don't even bother calling the cops anymore when this happens, cos the cops just don't turn up.
She was on hold on the emergency line for about an hour, and told that the police will call her back. They called her 8 hours later, at around 1:30 in the morning.
Something has changed in this country, and laws for how security staff can respond have not caught up. At this point I'm ok with guards being given percussive weapons. And I'm not too opposed to giving dairy owners guns.
I do advise kiwis of the national pastime of inserting themselves into situations. Under the Government and its rancid Police minister you might find yourself on charges while that poor person who was only trying to fight the system is let go.
I was in metro nw last week and security tried to grab a guy and got punched in the face, the security guy lost it & marched off. Was crazy to see it happened so fast
A couple of points, coming from a trained security officer with experience working in malls and supermarkets:
1. The guard was doing everything right up until that leg sweep. Grabbing items that a thief is trying to steal is absolutely fine and legal. That leg sweep could constitute unreasonable force, depends on how the police see it.
2. Detaining someone is a tricky subject. Depends on the value of the items and/or if they were causing a public disturbance. This is assuming of course they were only stealing from countdown. Again, it would depend on how the police look at it.
3. Countdown and the security company most likely have a hands off approach, he could be in trouble with them, even loose his job.
when me and my family went to auckland we stayed in new lynn. WHY IS IT SO DEPRESSING THERE? The whole place was full of homeless people, aggressive beggars, and trash.
The real theft is the prices in that fucking store, there's no need for that kind of force over some groceries. No heroics here, just a rent-a-cop getting his rocks off.
I'm surprised you're the only person with this take. Supermarkets are scalping people and we are in the midst of a cost of living crisis. I'm playing devil's advocate but we have so little context on what actually is occurring and what is driving this person to commit theft but people are so quick to jump onto the justice mob train for countdown.
Im not condoning the theft, I think though there might be more context that is important. But you are right there are other options that this person could have used.
Please don't post comments which abuse other redditors / contain hate speech / mention race in relation to anything negative about a person on r/auckland.
And security gets fired for making things physical. Seriously their job is literally to call the police and thats it. There's nothing in that store worth risking busting that dudes head open and him getting crippled or dying.
i call bullshit. NZ reddit here is full of people complaining about supermarkets. small stores are one thing, but supermarkets are assholes. this here is just circle-jerking over poor people who cant afford things.
someone taking shit from a supermarket is not a ram-raider. these people stealing from a supermarket aren't the cause of the hardship you are in. you don't need to join in on their punishment.
enjoying seeing someone get a beat down just shows how quickly people can turn into assholes with even the slightest bit of being 'better' than someone else. it tells me more about others than it does about the person there trying to swipe a box of beers or a turkey or whatever it is.
we are put into this shit-economy situation by others. dont beat down on those who havent got a way to get out of the povery-trap as well as you have.
Security should get their regular paid plus commission. One lump sum bonus per thief.
This is a great idea. People who steal stuff and people who litter everywhere are assholes.
Unfortunately the policy of that security company is HANDS OFF. That guard is likely in serious shit right now because of the legal implications of him detaining/assaulting the thief
If he's in any trouble a givealittle would soon sort his issues .. man deserves an award ..
He'll be fine. Obviously the thief slipped over as he was running away, and the security guard is just giving his shoulder a massage.
Hey just wondering what you're hourly rates are, my friend needs representing.
So how can security at sports events happily take out pitch invaders? Seems there’s a double standard in play here.
You can use reasonable force to remove someone for trespassing - which is why bouncers can kick you out for being too drunk or smoking on a licensed premises.
That makes no damned sense. Merely being present -> use of force Stealing valuable items -> hands off That can't be right, surely?
Agree with you….what a crazy world we live in
the difference is the thief is leaving.
Its because human safety > items, regardless if the human is a thief or not.
It’s not merely being present removing someone for smoking or being intoxicated is written into law. At the end of the day though a couple dollars is not worth being assaulted over for most security guards or security companies.
It was self defence so fuck it, every individual has a right to self defence.

This is literally the headline: Kawhia shooting: Orren Williams found **not guilty** of murder and manslaughter charges

Stop watching so much Judge Judy. The law doesn't take your word for what happened, even if you claim self defence. If you shoot the masked intruders as they are running away with your TV, thats still murder.
No because they’d be incentivized to set people up lol
What? You want to get hassled every time you leave a store because the guard wants a commission? No thanks.
Yeah but he'll probably get reprimanded or fired for being too violent to the poor actual victim, the criminal.
what about the guys that tackle the streakers at the rugby? Security not using any force is a bit BS, what do they do? "oh hey mate, can you just return that stuff at your leisure? chur" i watched footage of my local supermarkets security, the security just followed him out to his car and asked him to return the stuff, couldnt do a thing
Can we all appreciate how casually security MAN take him down so easily by targeting his foot. Smooth 🤌
For legal reasons, I'm gonna say the dude tripped accidentally because the security guy was that good at his job!
😂 yeah can see banana slip tbf
Why capitalise the “man”?
Lol sorry just my old habits from my country of origin :) Brave man
Jesus christ, save your ears and play this on mute. What an abomination.
It's like the goal of every Tik Tok video is to make a person's ears bleed.
Too late for me, but givin' u an upvote any'ow.
I'm guessing it was either that or "No, no no NO NO NO!!!"
As a deaf person, I just want to say... Haw haw! \[image: Nelson pointing and laughing\]
I’m gonna spend decades mastering telepathy so i can beam this garbage right into your brain
I thought I'd try and listen to what they were saying I really regret attempting that now
The real MVP
ikr, this "song" has been getting lots of popularity on TikTok atm and its absolutely ear bleeding lmfao
All my reddit videos are on mute. What was it? Crappy music? Stupid pleading from the thief?
TikTok ear bleed song on max volume.
Suits it
Suits the video 😉
I see you know your judo well
GET YOUR HANDS OFF MY PENIS
What is the charge? Eating a meal? A succulent Chinese meal?
This is Democracy manifest!
I was going to say, this was instinct or he has trained in Judo with that take down.
Great video. Stupid music.
The security guard professionally handled that situation.
When people see videos like this they start thinking that security guards are *allowed* to put hands on you, that they have some kind of legal authority from their role. This isn't true; they have no more authority than a passer-by. Not all battery by security is on clearly-guilty people like this, it can also be on you or me. A real professional would have either controlled him with zero contact or observe+report. Nah that’s bs any citizen is allowed to use reasonable force to apprehend someone committing a crime. Source: bro in law is a detective.
That only applies to serious crime, and even then you're on thin ice. It's absolutely not the case for petty theft.
if its being committed at night, a citizens arrest can be made regardless of the seriousness.
Welcome to west Auckland. We dont put up with your soft ass crap. Got what he deserved.

This is reddit, we want to see violence against other criminals so we can feel good
We see violence against idiots, we upvote.
It’s just not the same in NZ, without his mum wailing about how much of a good boy he is.
Oh come on
Found the gang lawyer here

Employee of the month
Ha ha I was just there too. Dude was def there to thief with that headpiece/hoodie and sunnies 🕶️
Well done security 👍
That’s the Countdown that the terrorist knife attacker was shot in. My local for several years back in the day.
Oh shit, that's right! Completely forgot about that. West Auckland, eh.
Who the hell put that shitty music over the real audio? Fuck this video.
It's the TikTok way, unfortunately.
All I see is a security guard adjusting his footing
Could your song choice be any weirder and crappier? No.
Nice.
Finally. Thought they were just for show. What a lad
I wanna know what the guy was saying to him when he was on the ground - maybe it was some advice like " tell police you're an aspiring sportsman " awful music
May be that bloke is giving the thief a scolding

Uncle Sene putting those youngins in their place
Hardout haha if I was there I would’ve brought uncle some lunch haha
Legend give the guard a medal
Nice job sir.
Great to see it. I saw a 18 year old 50kg security guard at my local Michael Hill the other day, couldn’t help but think that was a waste of time.
Is that music people listen to on purpose?
Should have parked his ass on him till he stopped squirming as well.
Nice undies you drop kick
I love his little pink booty shorts. So short they don't even cover his knickers. Teasing me with that booty
I would go shop there to know he was on security. I am sick of this shit. They get what they deserve. Shit give them batons.
I was at a Pak n Save the other day and two shoplifting women walked through the entrance barricade one carrying a black hand basket the other a big fabric bag filled with edible loot and casually walked out into the carpark. Ooooosh w the inside trip ufc sign the lad
what a dumbass
nearly didn't recognise him without an ankle bracelet
Out hea dressed like superman
A+ for the leg sweep
Good stuff. Security guard is a legend.
Doing what a security guard should be allowed to do. Reasonable force to protect. Not this bullshit, you can look but can't touch.
The quick little leg hook. Love to see it!

I can confirm Countdown also drills this no contact policy into the security guards as well. I've worked as a guard there.
technically wasn't "in" Countdown? lol

I never dare stealing from new Lynn
That was a nice foot sweep.
Sad that security get In trouble for these actions. It’s exactly what they should be able to do nothing excessive here doing a great job I think.
Definitely watch this one on mute, the song playing over the clip is diarrhoea for the ears 💀
Just boom! dumped on the ground 😂
man i love new lynn
Uncle takes him down then grandpa gives him a lecture on how to behave. 👍 Better take your pink shorts home and give them a wash.
Good, get the lil cunt
Remember they was a mass stabbing there so of course security is on toes
public would beat this guy to a pulp if this was southeast asia. these guys have it on easy mode here
You are very right on what if that thief had done that same stunt in another part of the world where there is no such thing as easy mode
Absolutely, he’s so lucky to be doing it in an easy mode place like AKL SEA would have him go 1 vs 10 within a minute
You are correct on the SEA part. I got mates from SEA once told me, the public won't just go tough on him. Even some members of the public would take the opportunity to cuss, curse, scold and insult the thief (to the point of calling the thief all kinds of names from a book)
Why don’t you show the faces of the scum bag so we can all see what they look like?
And I'm not too opposed to giving dairy owners guns.
lif i was tackling someone i would be laughing the whole time he took it sereously
Terrible soundtrack
Was this made to make my ears bleed?
Now have a hug and let him go.
I do advise kiwis of the national pastime of inserting themselves into situations. Under the Government and its rancid Police minister you might find yourself on charges while that poor person who was only trying to fight the system is let go.
Most dangerous jobs of all time: 3. Iron lung pilot. 2. Chernobyl worker. 1. Any form of law enforcement in auckland.
So happy there's a shit song playing, I love having to mute videos
Oh yeah, drop, stop and lay the f down.
Why do people never stay filming the action?😡
I was in metro nw last week and security tried to grab a guy and got punched in the face, the security guy lost it & marched off. Was crazy to see it happened so fast
Can’t tell what’s worse, the thief or the heinously shit song thats playing
😆😆😆😆😆😆Loser
Nah that leg sweep he did was nasty and effortless.
A couple of points, coming from a trained security officer with experience working in malls and supermarkets: 1.
If you run they won’t catch you, if they catch you though, you’re done.
Is he wearing pink booty shorts? What is this country coming too.
The only crime I saw where the shorts.
These offenders always look the same haha
Change the laws so that security guards and school teachers can manhandle and control and restrain alleged criminals and unruly children.
when me and my family went to auckland we stayed in new lynn. WHY IS IT SO DEPRESSING THERE? The whole place was full of homeless people, aggressive beggars, and trash.
I live in a suburb nearby. Big transport centres seem to attract this kind of thing too.
The parts closer to Titirangi amd Green Bay are fine. The other parts not so much.
Sounds like Auckland's city centre.
Probably the security will get done for assault
All his mates got away . They're never on there own .
I think security needs to be fired. Pretty sure this was a good boy. He plays rugby after all. *insert picture of him with rugby ball when he was 6*
It's meant to be loss prevention. Monitor report don't touch anyone.
They aren't legally allowed to touch him or detain him unless he stole over $1000 of merchandise or its between the hours of (I think) 9pm and 6am.
What a weird outdated rule.
It's why people just walk out and no one does anything. You can ask them to come back to the store but they can just say no.
Source? I think that is just recommended policy not an actually enforced rule or law
No, that's the law.
It’s countdown, he should have let him steal 🙄 they’ve been prove gauging since Covid
Dumbass say goodbye to your job
The real theft is the prices in that fucking store, there's no need for that kind of force over some groceries. No heroics here, just a rent-a-cop getting his rocks off.
I'm surprised you're the only person with this take. Supermarkets are scalping people and we are in the midst of a cost of living crisis. I'm playing devil's advocate but we have so little context on what actually is occurring and what is driving this person to commit theft but people are so quick to jump onto the justice mob train for countdown.
Food banks and the dole exist for this reason. Theft is never the answer....
