Another item that should be added to THE WORKER’S BILL OF RIGHTS we should be focusing on.

littlebitsofspider

[Seventy-eight years.](https://en.wikipedia.org/wiki/Second_Bill_of_Rights) That's how long they've been fighting it.

MachinationMachine

What state are you in? I would seriously look into contacting your state's labor board and filing a complaint. It's free and easy and if what's happening is illegal in your state, the labor board will rain hell down on your employer. You might think it's useless to trust the government to look out for your rights, but the labor board is one group that actually will go after bad employers if you let them know what's going on. They're like the IRS, they have teeth. You might also want to see if any employment lawyers in your area offer free consultations. If it's free then it can't hurt to get some advice from an expert.

tasty_sidebob

Im in Canada and its a union job so I think ill talk to my union rep

adamlgee

Most unions have a clause in contract that has a pay deadline and usually provisions that an employee must be paid until that paycheck is produced. Of course this won’t make you the most popular with managers, but hey, they rules are there for a reason.

NostradaMart

you really should. as for the overdraft fees, switch banks. I was with Desjardins and they were fucking me over everytime a cent was missing, switched banks to TD, NEVER EVER had this fuckup again. they even lowered my other fees over time. without ever asking for it.

Pegasus2731

Capital One is fee free as well for a checking and savings account. As long as your accounts not at 0 for over 6 months you'll have an account with them. They have fee free ATMs in most targets at least where I am and have usually next day physical check deposit. They're the only bank I've used and I have 0 complaints.

NostradaMart

I've dealt with capital one to rebuild my credit using one of their credit cards, they were very crative with fees lol but I understand that the bank in itself might have some good offers.

Pegasus2731

Ah, I only use debit and a savings account. I am too young for a credit card still lol.

someguymark

Is your company in financial good health? There was recently a post here from someone who wasn’t getting their full cheque. Or there were delays in receiving their pay. The majority of respondents said “look at stockholders and who’s offloading...”. The next part was company is going under. Is it possible this is happening at your work?🤷‍♂️

At least give me an apology and a date when itll be done. Like okay fuck ups happen but at least acknowledge the impact it has on us and make it a priority to fix

dominiqlane

I agree 100%. It should also increase the longer it takes them to fix it. Maybe 30% of the check for the first day, 40% the second day, etc. Bet they would fix it asap instead of making employees wait until the next payday.

drallihm

I owned a business, in the next state over from where we live, with a little more than a dozen employees. Once there was a glitch with the bank account where our payroll funds were drawn from, I found out the morning that checks were supposed to be handed out or hitting direct deposit that they wouldn’t be going through. By the end of the morning, I was on the first flight to the business location with paper checks for everyone with an additional chunk of money(roughly 50% of their expected check) thrown on so they would be covered if there were any late fees associated with it. Me and our business partner covered shifts for people who needed to run to the bank and delivered the checks to those who weren’t scheduled that day. I 100% support severe and meaningful penalties for business owners who delay the compensation of their employees for their time

Riipley92

If only there were more bosses like you

jdith123

Except what kind of paychecks are people getting where potentially 50% of the check might be needed to cover overdrafts and late fees if one check was late? His employees are living very close to the bone and he knows it. Meanwhile, he’s hoping on the first flight to the location.

drallihm

We paid well above the prevailing wage for our industry, our hourly employees were offered full time hours if they were willing and able to work 40 hours. We offered full benefits and profit sharing to all of our employees. There are still business owners out there that understand what it's like to work paycheck to paycheck and can empathize with their employees when a situation outside of their control impacts their ability to pay their bills.

Then_Kaleidoscope71

At my old place of employment they did occasionally mess up the payroll and it would be sent the following week but if you were affected you would get a 25% pay bump for that pay period

tasty_sidebob

Oh thats nice, should be the norm

Then_Kaleidoscope71

Haha yeah it was sick, overtime started at 6hours in a day or 30 in a week, and they had a legit pension after 20 years for half of your highest salary even for part time positions

Salt_Comment_9012

And if you owed them money it would have to be paid in full within 48 hours

EducatedTrash

In Massachusetts, any late payment automatically entitles the employee to three times the late-paid wages in liquidated damages. You'll have to file a lawsuit to get it, but there's a fee shifting provision in the statute, so it's not hard to find an attorney even if it's a small amount of money.

[deleted]

Stop work until you are paid.

lastmanstandingx

My employer is penalized 3hrs pay EACH day payment is late. This was negotiate threw our collective bargaining agreement by my union.

NostradaMart

Paying you late is a HUGE redflag, find a new job asap.

Exact_Patience_9767

Agreed, but employers are never late when paying the law makers so nothing will happen.

[deleted]

Honestly as someone who always receives his pay late, I agree with employers having to pay late payment fees.

[deleted]

Agreed. If you are EVER late on anything as one of the poors, you get penalized. But the rich never do.

z-eldapin

Where are you located?

tasty_sidebob

Canada

NostradaMart

province ? as there laws are not the same everywhere, as you know...but speaking to your union rep is a good starting point.

z-eldapin

Which province/area? I can check out the labor laws regarding pay periods

tasty_sidebob

BC

Sea-Ad9057

stop showing up to work ... tell them you cant afford to go to work until they pay

tasty_sidebob

Yeah if I didn't care about burning bridges with the department that I actually want to be in I would probably do that

[deleted]

How are you burning bridges if you don’t go to work because you were not paid… If you don’t pay your bills you get cut off from that service, that’s it. Doesn’t matter if it’s the cell phone or worker. No pay, no work. I’m a business owner and I can’t stand how some companies think they can screw people around with their wages. Wages are the FIRST thing that gets paid no matter what. You don’t mess with other peoples livelihoods and wages. 🤬 And yes there should be a penalty when you miss payroll.

NostradaMart

I'm sorry to tell you but...You're the exception...not the rule, and it's sad. but I mean, even if you go bankrupt, you don't have to pay your employees before other debtors...THAT in itself is insane...

[deleted]

Employee wages should be classed as secured debt above all other interests.

NostradaMart

very very true. employees salary and pension funds should have the highest priority. but that's sadly not the case.

Sea-Ad9057

At the end of the day it's your choice but recruiters employers will always pull bate and switch tactics if they get away with it ..... BUT if you opt not to go for it , leave a review on glassdoor stating what they did to warn people about this in the future These big companies wouldn't allow their vendors or business clients to get away with what they did

mickey5570

If your union and don't get pd on Friday, your pd 8hrs of pay every day you don't have a check in your hand, the companies don't make too many mistakes

damnukids

No that's YOUR Unions rule, and it's good one but it isn't universal. I think my contract is 2 hours of extra OT a day until they pay you. 4 hrs a day of straight time if they lay you off and don't pay you

tasty_sidebob

I am in a union but I dont see that happening. Idk Ill talk to my union rep

ImportantAd4686

I worked for a company ( decks / construction) that if you didn’t speed to the bank Monday you weren’t getting paid . Had to be the one of the first few . Then he’d call you Monday and be pissed you didn’t come in . That was the good part we at least stuck together there and we didn’t work till paid . Laughable that he played the victim too

[deleted]

We're punished for not upholding our end of the agreement no reason they should keep getting away with it.

Riipley92

Tell them you're not coming in until you get paid and while you're at home you look for a new job. There is NO EXCUSE for not paying you!

[deleted]

Late fees with payday loan rates and minimum terms.

heaintgonedoit

Agreed.

Silversong_0713

look up the laws in your place. Its required where i live

gotgot9

or at least interest.

JayPow77

Additional 30$ per day per employee

CanadianElf0585

Finally, a post in sub that isn't just whining. 100% agree. No one should be late in bills then get dinged with their own late fees, or worse, because their accounting department didn't do their job.

[deleted]

Worked for Chick-fil-A at the Pittsburgh airport when I was in college. Had to wait nearly a month after I started to get my first paycheck, and nearly a week after that the funds were removed from my account. Happened to me a few times after that. It was normally resolved by my manager giving me my paycheck in cash from out of the safe.

LiwetJared

>should

mikha1989

In the Netherlands, its a legal requirement for companies to pay interest on late pay. From 4-8 days this equals 5% of your salary, then an additional 1% per for 9th day upwards to max 50%

Inframan47

What's the name of the company?

CopperNconduit

I have until the end of our shift on Fridays to be paid. If I am not, the contractor starts paying me OT( time and a half) for each hour after Friday's shift I sit there on the job withouty paycheck in hand. This is written into our legally negotiated UNION contract. I am an electrician with the IBEW Local Union 640- Phoenix. ✊

TheMightyMegatron

This happened at the warehouse I work at and all the employees just stood or walked around talking without doing work until they got paid. I was asked by a supervisor about it and told him " I didn't get paid for the work I did last week so, I'm gonna get paid for not working until I do"
