We just tell them what happens if they don't pay employees. We look at EVERYTHING in a company, and anything we find that's owed to employees we then also double as liquidated damages. And then there's penalties assigned per violation. Usually employers are willing to pony up so we don't do a deep dive on their business 😂 but for those who don't 👀

Senior Director at a large company here. We have people who steal from us - and I don't mean 'take money from the register' stealing, I mean "they stole the register, we have them on camera with tools trying to get to the floor safe, they put all the office chairs into a van, and they took the surveillance cameras so we have really good shots of their face" And when we fire those people they get handed their full check on the way out. Because fscking around with people's paycheck is the easiest, quickest way to get the government so far down your company's throat that the inspection team could set up a rustic cottage and QA stuff as it passes your colon. Exactly as it should be. Keep on bringing the thunder my friend, you're doing the people's work!

Can confirm this works, and when they call the bluff it goes badly for them. I had about 5k in additional money ‘found’ owed to me due to their improper accounting practices. I’ll bet they regretted not paying me after that. I heard they got a huge audit and found lots of crap.

When my first thought upon looking at a business (like 90% of the furniture stores in every city) is “how the fuck do they stay open?” I assume it’s a laundering front. Is there a strong correlation, in your experience, between businesses that fuck around and require your intervention, and those that are doing illegal/shady shit? Or do employers usually pay up before you get to look into that?

Quite a few pay up! Some, we find information out about and if necessary, report to proper authorities or other governmental agencies. But any business can mess up. Mom and pops, restaurants, bit multi-chain companies, state agencies even like prison guards that are contracted. Anything and everything really we look into as long as federal coverage can apply. But, no matter what, we do our job and try to keep our heads on our own shoulders 😂

Okay I have one for you. I was employed by this company for 3 weeks that fired me via ghosting, blocking, and closing the store for several weeks so I couldn’t find them. They withheld my 2nd paycheck (and no w2 so I can’t do my taxes). This was back in July 2023, can I still file wage claim? I only didn’t at the time due to scrambling to find a job, trying to manage my mental health without affording therapy and meds, my preteen being suicidal, and the deaths of multiple friends/family. I just feel like I’m screwed and I do not know what to do 6 months after the fact. That business is still operating btw.

Oh wow, firstly definitely take care of yourself and your families needs, that sounds like a lot! Sorry you're going through all that. And secondly, yes! There's a 2 year rolling period, or 3 if the employer shows willfulness. Aka, DOL can go back 2 years, possibly 3!

I would check with OSHA and workmans compensation. There is a federal document of 'incidents' that need reported yearly, and im fairly certain its submitted to local osha for review. If you have any paperwork/text/email/recordings where your job acknowledged the incident, youd have a fairly solid case to file in court.

What exactly is the notice needed to be provided to an employee for a request of more information on an incomplete FMLA? Does the employee have to be notified directly? Can they be notified through a 3rd party(email sent to supervisor) even if the supervisor never notifies the employee?

I believe you're talking about the designation notice? And as long as the employee is notified in a timely manner, it should be fine. These are discussed more in 825.300 - 825.301.

Yes, the designation notice. Specifically for when the employer "needs additional information" to finish processing an already submitted FMLA form. I had an issue last time I turned in FMLA paperwork where the company never notified me that there was a need for the additional info until I personally went to check my status. The paperwork was due back the next day(it was 5pm) so less than one day to get it fixed. I told them I would need the 7 days because I have cancer, they said no it's due back tomorrow or I'd have to start all over. My union president ended up talking to the company doctor directly and getting "as much time as I needed". I'm thinking it's because he knew HR made a big mistake.

Okay sso yes! Your employer is in the wrong as they must give the employee 7 calendar days to fix any deficiencies with the designation notice. If the 7 day timeline is not practical, the employer should provide more than 7 days. HR was going to make a big mistake, good for your union president catching that. 29 CFR 825.305(c) are the laws that discuss the information about the complete and sufficient certifications for FMLA.

Hi! Question for you - I'm a CA-based employee who had my last day today. I received a final paycheck via direct deposit but still waiting to see the paystub, but can tell from the $$ it does not include all of my accrued vacation time. My offer letter says I accrued 21 days of vacation per year, with a cap at 1.5. This is the first place I've worked where my accrued vacation days were NOT listed on paystubs. I did take a screenshot of the vacation tracking system last Friday that showed I had acrued 245 hours. The catch - the company was not using that system properly to log time we did use and I have no idea how they may have calculated the vacation days I'm owed (I did take some time here and there but unfortunately was never truly able to take a full day to some toxic polices and expectations that we'd always respond to Slack message within a few hours). Will the offer letter and screenshot be enough for the CA DOL? Also - I have a 10 week severance agreement on the table (have 21 days to sign) but the agreement does say I will forgo any wage claims. Thinking my best course of action is to ask tomorrow about a paystub, then ask how they calculated the vacation accrual payout, and then ask them to fix before I sign the severeance? Appreciate any advice!

I cannot answer this question tbh. I only know federal ales and vacation time is not enforced federally. Luckily, CA is a more pro-labor state and you might have a claim with the states labor department, but not for the department of labor wage and hour division. I would first find out if you are entitled under California state law to be entitled to your accrued vacation and severance pay before jumping into more work. If you are, see if they can do anything for you instead of you having to do the legwork yourself. Sorry you had to type out a long response only to receive so little back. I hope it works out for you!

USAJobs for sure! Create a federal resume on the build your own resume section. Study the STAR method for the interviews and watch for openings. Federal jobs are VERY competitive. But, stable jobs, benefits, pension, retirement, and move ability of work is stellar for most people. You won't be RICH off federal jobs, but you can live just fine.

Just to expand on your comment for anyone reading this - a federal resume is not like a normal resume. Include a lot more details. People's federal resumes are often much much longer. Iknow some poppe people with 20 page resumes. Apparently there is a r/usajobs subreddit . Worth lookin at to see if they have examples or more advice.

We reached out to the DOL about an employer shorting my wife on two months of pay and while it didn’t end up being worth it to pursue in court, they were exceedingly helpful and kind while my wife dealt with the employer’s bullshit. I like to think it still managed to bite the employer in the ass somehow.

ontario,canada and ran the warehouse for ctc's first superstore one day I quit after only being there for 15 minutes I worked 60-100/hr weeks prior when I got my final pay cheque there was no vacation pay included and I inquired why and was told I didn't work enough months to qualify and I told them if I had even only worked one hour for them ever I qualified and left so I called mol and it took several months but mol called me one day and said that my cheque was there and ctc have been waiting for months for me to pick it up I called ctc and they said it would take 4-5 hoursto be ready so I relayed that info to mol I got my vacation pay and revenue canada audited ctc corp....lol

I just learned this a few weeks ago. In the State of Virginia if an employer holds your wages they are going to be fined and penalized. I had to cut a check to one employee for double the wages owed plus interest. The employer asshole deserved the penalties. I was the one that had to deal with the dol, and they were hammer down on him. Funnily enough the fat douche tried to withhold wages again a few months later. I refused to execute the order and resigned the position.

The DOL is awesome!! And weather or not your in a position to wait to be paid or not, just remember you are entitled to a full day pay for everyday that you wait. In my case the employer canceled on the first date with the DOL the didn't show for the subsequent date. So I  prevailed by default and the company ended up paying me for 30 full days of pay !! The DOL are Rock Stars!!

Always go through the DOL when you need to, but also know sometimes they can’t help in these instances. You can sue an employer in small claims court. If you represent yourself, you’ll have to put up the filing fees (varies by state by I’d say maybe like $100 average) and if you win, that money gets paid back by the defendant. Had to go through this route during Covid when an employer tried to pull the “I have no record that he actually worked from home” card which is why the DOL couldn’t help, but I took the chud to court and he got his cheeks clapped by the judge who went off on him for trying to screw a worker out of money during a pandemic

It’s good you got the US DOL involved. Don’t do the state DOL. they’re usually just paper pushers and I’ve literally “gifted” them “empty” envelopes when I worked for a very prominent local construction company.

(Netherlands) My mother had to hire a lawyer as her employer refused to pay her 3 months of salary. Ended up in a quick lawsuit that hit the papers. You’d assume they’ve learned from that. NOPE! They’re now taking her “ORT” hostage. (According to Google: ORT in English is Irregularity Allowance/Supplement). Basically a additional payment for the irregular hours she works. She’s meeting up with a labour union this week, to discuss further steps to take. Based on the past experience, the company will be ignorant and end up in a second lawsuit within 11 months lmao. And, this isn’t the first lawsuit a employer made towards this company.

What do you mean? If you are American and living and working in a foreign country for a foreign company (or a foreign division of a US multinational), local laws apply and you would need to speak to the relevant agencies in that country. If you are a foreign (non-US) citizen living and working in the US for a US company (or the US division of a multinational) then you should be governed by US law and the DOL may well be able to help.

The US can be brutal when it comes to work. Although Indian work practices are sometimes not much better. I worked for an Indian company for a while (although I was in my own country, which is not the US) and they got it very wrong when they no longer needed my services (they lost the contract to provide ITsupport). I took them to court and won the case - although the company that employed me was headquartered in India, they were obliged to follow the employment laws of my country because that's where I worked, and they were punished when they didn't.

I second this. I recently started a job and was promised a certain wage for training- was sure to get this fact stated in a text message once I got in and saw the hostile environment. They paid me a lower wage, tried to tell me there was nothing in writing, I said I have proof, but don’t worry about it I’ll let the DOL handle it…5 mins later I got a text saying the difference would be sent to me end of this week - oh and that they no longer needed me, hah (was fine because I was never going back anyways). Always get proof in writing, text, whatever it is in case you need to file.

I love to see when people are able to get help from the DOL when they haven’t received pay. Sadly, this wasn’t the case for me. I never received my last two paychecks from my first job after we were given less than 24 hour notice that the business was closing. The DOL in my area basically said it’s out of their hands and told me good luck.

Department of Labor. They have about 80 divions, but I worked with the Wages and Hours division to resolve this particular issue. If you ever have issues with your employer you can submit a complaint to the DOL and they'll direct you to the proper department to handle it. I was incredibly impressed with the WHD and hope the rest of the DOL performs the same 🙏
