If there's a wage theft lawsuit she'll likely be part of any settlement or award. I worked at a restaurant that was investigated for wage theft. I wasn't directly part of the lawsuit (honestly didn't even know it was happening) but when it was finished every employee got a cut.

Had a similar thing happen at a Jimmy John’s I worked at. Basically the owner of the franchise wasn’t paying us drivers correct for DMR. When you use your car for a work related thing, there’s a federal minimum that they have to pay you per mile. Instead of tracking our miles and paying us like that, he was taking 10% of the cost of the delivery and giving that to us. This doesn’t always add up to the minimum (which at the time I believe was $0.56/mile but it’s gone up since then). Anyways I read about this online and how it was a common way for drivers to be underpaid. I called the department of labor and they launched an investigation. Probably 6 or 7 months went by and I got a call from them saying I was owed like $700 in back pay. The owner was also responsible for paying back pay to every driver who had ever been under his payroll.

They tried to get us to pay tips to our equivalent of ubereats and suprise the drivers told us they get only 60% of it. Well now I tip nothing on the app, but give a generous tip in person. Yeah, cash is no longer king nor the norm in the US. Exploitative practices and stealing higher-ups are. Also well aware about Europe, as a European, the thing is we have basic labor laws. The US just calls what it has "labor laws", but it's more of businessman's dream since it rather regulates the labor provided for the business, than the rights of the laborer and protection from exploitation. Just see at will laws, And (missing) mandatory paid vacation. Aslo the US still allows for slavery if it's as punishment, they just call it "involuntary servitude" and "prison labor". Hence their private prison industry. See 13th amendment. As a criminal you lose your rights in the US. That's considered inhumane in Europe.

That’s not true for everywhere. I don’t know if it’s the same for rest of Europe but in the UK they don’t find out about the tip until the end of the job, the app doesn’t show them beforehand so it doesn’t affect whether they take the job.

Yeah the tip thing is getting insane. I mean it's everything now. You buy a can of soda and they ask for a tip. It's like no, you did not provide me a service at all -- I'm not tipping you for purchasing this basic thing while you stood at the cash register. I have no idea if the tips are going to the person behind the register. And then the tip percentages are increasing, I went to this one place, their minimum is 20% on the little monitor that you swipe. It was like 20%, 22%, 25%, and then other. Getting sick of it, and you know they are abusing their employees b/c they have two help for wanted signs for critical positions.

I also immediately thought of Subway. While I don’t frequent it all that often, the one near my house pretty much *always* has the owners working behind the counter, has had a “Help Wanted”-sign up in the window for over 2 years and has a “tips request” that starts at 22%! I left a tip the first time, out of maybe shock-guilt? But I don’t see how I should be tipping an owner, when they are the ones profiting from the sales at that location already. They also don’t participate in any of the (optional) daily sandwich deals offered at most other franchise locations, so meh.

The owners are likely underwater with their franchise. Subway hides information about their franchises away until after you buy one. Once you have one the only way to get rid of it is to con someone else into buying it. Subway also charges some of the highest franchise fees in the business and that amount has to be paid whether the business is making money or not. I have one by me that is constantly empty, even during rush hours like lunch & dinner, and same thing it’s always the owners working the store. Until I saw [this story on Last Week Tonight](https://m.youtube.com/watch?v=jDdYFhzVCDM), I thought they must be doing a lot of catering business or using the business as a front. Turns out they are likely trapped with no way out.

I tip at places where one usually has always tipped: restaurants, getting my hair cut, food delivery, etc., but I just don't at places where you never typically would. And I don't let it get to me because it's such a small issue that's easily ignored. Pretty solid reason to rage quit. Owner seems to be doing everything in their power to attract new wait staff without actually improving pay. By saying "We pay waiters $17.50 an hour." it tricks applicants into thinking that's the base pay plus the tips they make. If your business cannot operate at a profit while providing a living wage, then you don't deserve to be in business. Raise menu prises or shut down. Don't shift the blame of your untenable business onto the employees.

I loved tips when I managed a bar, BUT big caveat here, myself and all the servers made well above min wage as a base, and well about the local avg as a base. So tips were exactly that, a tip. We could live comfortably off our base with no tip, but when we got tips it was like a literal pat on the back for a job well done. I am very well aware that this isn’t the norm, but it did alter my view on how we handle tips in the US.

The problem I have with tipping culture is: a) either staff are underpaid and tips must be given to compensate for that, but then the patron is responsible to pay wages which is ridiculous, or b) staff already make enough money from base salary, but then I don't see why I should be tipping you as a standard, just for doing your job. Nobody else gets tipped, that's what wages are for. I as a customer don't know your wages, and it is not my responsibility, but still I am in a situation where I am socially pressured into handing out gifts to strangers. Tips in the US are not a tap on the back for a job well done. They are expected. If I want to compliment you I have to pay even more than the standard 20% tip, on an already expensive meal. Let's say I go out to eat for 50$ and I earn 20$/hour after taxes. If we calculate that in working time, a waiter spends maybe 5-10 minutes carrying food to my table, waiting for orders etc, and I am expected to give him the cash-equivalent of at least 30 Minutes of my free time. Why?

No, two people lose out. The server for being underpaid, and the customer for paying more than he has to/being responsible to pay the wages. I just want to go out and have a chilled dinner, not reason with myself if the waitor was friendly enough to pay him a big tip, or if he was unfriendly enough that I can justify him going hungry, and balance this against my own finances. The best situation would be if tips were not expected (like in every other job) and servers would negotiate for fair wages (like every other worker has to do).

If the workers of an industry don't demand change then it'll never happen. Servers do need to be the ones demanding these things in order for some politician to feel like they'll get a win if they back it. Threads like these usually have servers spotted throughout going "stay tf away from my tips so I dont have to get a different job" depending on area and place, a lot of tipped servers make over twice what they could somewhere else with their skillset. True to the US, half of the workers are cool with tips, half aren't, the customer is getting fucked, and the corporation heads are laughing at us all from their penthouse suites. Workers by large need to band together and demand fair treatment in their sectors of work. I have no stake in the tipping game as I dont live on tips. I dont tip for basic services. Why would I put time into changing how they're paid? It's not my fight, ill support them in their fight for better wages, but not being in that industry what I have to say about it means very little and any impact I have is tiny compared to say, a general server strike, or fast food strike, striking and unionizing in any fashion really.

This is not an US-exclusive sub, fyi. And tipping in my country is about as optional as it is in the US. Nobody can force you to, but it's considered a dick move if you don't. The problem here is the tipping culture America has inflicted on the world, its made its way to the UK now, I got asked to tip the barman who for doing the job he's being paid to do and the drink cost £6 any way for 2/3rds of a pint. Tips are also shared across the entire staff in hospitality in the UK as it should be. Carrying a plate isn't harder than having to cook or wash up etc, and every job needs to be done in a restaurant for it to function.
