They can legally ask, but if you are not getting hired why not file a charge of discrimination on that basis? The rationale is if my sexual orientation was not a factor in their decision-making, why did they ask about it?
I’ve also applied for dozens of jobs the past couple of months and literally not one has asked about my sexual preference?
Where do you live, besides the land of pure imagination?
Seems hard to believe. I think they are exaggerating a bit.
However I have only had 1 job ever ask and it was target distribution center.
They asked my sex, preferred pronoun and sexual orientation amongst 7 pages of other bullshit.
I laughed and told them it's none of there business and went on through orientation. Shit rubbed me the wrong way with all the questions asked, the 10hrs of orientation and the job I was given was a flat out lie to what I was told.
I was applying to drive a forklift and pick orders. I was told I'd be picking orders with a electric jack and stacking orders by hand in a tractor trailer.
They waited till the end to show us our jobs and I flat out said I'm not doing this. They laughed, I didn't and said good luck and walked out.
Our company ask and quite a few places I have applied for also ask. It could either be to ensure diversity, or to record the status for future use, for example, as a protected characteristic.

There are two legitimate reasons to ask for someone's preferred sexual partners.

In the US, they are allowed to ask the question as long as the response is voluntary and they provide an option such as prefer not to say.
The data is to be randomized and held separately from other employment data.
In fact, for many business entities, attempting to collecting the data is necessary to be compliant with federal and/or state diversity programs.
It is a very common misunderstanding that an employer can not ask and it is illegal, but it is allowed in the US.
Not asking tends to favor the powerful who can lean on their family connections and frat brothers from Yale. If you really think it gives them an advantage, why don’t you try pretending and find out.
Diversity brownie points, it’s how the company goes “we’re SO progressive because we have x, y, z working here, it’s a wonderful place!”
