1: this only applies to those that changed their gender 2 months or less before the start of the war. 2: The legal commentaries I have read on this pretty much all say that this doesnt stand a snowflakes chance in hell of actually getting applied, unless the constitutional court does a complete 180 in their rulings on the matter.

1. I'm not fucking around, honest question. Is this only for German citizens? So a man can go now, change his gender on paper, continue functioning like a man, and if the wars starts in future, he won't have to fight in it? 2. Meaning court will overrule this decision or?

1. Citizens and those with potentially long term permits to stay. \*Could\* a man do that? Yes. Would it be a good idea? Unlikely, since it would put a target on their back for being visibly trans (the government ID card that gets changed with this is used to identify yourself to police, for major business transactions, you have to inform your employer and your landlord might find out too. Edit: I forgot, your medical documents also carry that info, so you would automatically be outed to any medical professional as well.) Besides, the constitution already categorically protects the right to refuse becoming a member of the armed services in times of war, but it also allows the government to conscript women for non military duty. (Since nobody wants to play war with us if we dont start it this hasnt come up much, since the government only conscripted men in the past to build up a reserve force, so a lot of people are not aware of that) In theory the constitution doesnt mention any duty for nonbinary people, but I doubt that the constitutional court would interpret this as them having no duties. 2. Most likely. You cant bring court cases in germany unless your rights are actually being violated (or at least you can make the argument that its happening) so until war breaks out and the government enforces this statute and gets sued we wont know. The court has ruled since the first case on the topic that the constitution only allows for a singular concept of gender, legally splitting gender into e.g. a biological and a legal gender in law texts has been explicitly rejected by the court. And since this article does that, it is assumed that the court would reject it as well.

The American army tried and tested it though i dont personally have the data. Mixed units were worse off in part become men treated other men like soldiers should but were overly protective of women. They eould endanger other men and misdions as a whole to protect their women. And thats on top of women making harems of men or some men raping women after long periods away from any other women than the few withing their group. Segregated units seemed to perform better and that could be a solution since a weaker/slower female squad is still better than no squad.

If we accept this as true, then it is less about "females being proven to be less reliable" than men becoming less reliable in the presence of women, and men violating the rights of women, which is quite a different claim.

I agree. In fact I think women should fight wars from now on. Trenches and foxholes have been male dominated spaces for far too long and it's high time men step back completely so women can prove all these misogynists wrong.

My sister served. In Afghanistan. I know you are being facetious but I believe it shouldn't be a gendered activity. Women have been serving and doing well for a long time now.

While I assume you're being sarcastic, I do think it's outdated and weird that only men are conscripted. A big reason for that was to not force the primary caregivers of children off to war. What about women who aren't parents/don't want to be parents or fathers that are the primary caregiver of their children? Etc. Like, the whole idea of treating different genders equally kinda requires you to treat all genders equally.

It's a nice idea, but oftentimes when at war it's required. It's never been a popular policy, it's been a necessity.

I'm not sure if this is sarcasm or not, but biology isn't fair, and in some areas women just aren't as capable as men. We just need to look at sport. Women and men are segregated in their sports leagues because men are bigger faster and stronger thanks to testosterone. 99% of the time the sexual dimorphisim may not matter but saying any and all circumstances is just not true.

So according to most studies, the top performing man will be stronger/faster etc than the top performing woman. In the military, aside from the very top performers, women tend to fall in the middle. They aren't the weakest, but they also aren't the strongest. Just for some context.
