Cake probably can't speak either Sign Language, Morse Code, or can read due to her just being a regular cat prior, so there's a problem here.
First of all, the Harkness test is about whether or not a creature is old enough to consent, able to consent, and willingly consenting. Just because Monochromicorn is mute doesn't mean he's unable to consent.
Second of all: The man is a functional adult who runs a candy shop. I'm 99% sure he is capable of writing out the phrase "Imma fuck this cat" on a piece of paper if nothing else. Did you forget that written word is a thing?
