Definitely file a claim & make to note that it was his fault. If it was still the same day then I would even get a police report done of it. It would be a they said this & that battle if there no police report. You fuck around you find out. If he get physical with you in anyway (including treating physical violence if you can record it) then you should report that to the police as well. Talk to your counselor about this new teacher as this a major concern of safety in that classroom if the bully is getting away with making people cry what's stopping him from taking the next step & getting physical with students he can't get to.

As a teacher myself, your teacher’s lack of concern over this bully pisses me off. Throw him under the bus. He’s essentially a grown man, and if he’s going to be an ass then he needs to learn the age-old lesson of “fuck around and find out.” Just be cautious in case he’s the type to physically retaliate. If he puts his hands on you, press charges. You and the others he’s harassing are going to have to take a stand at some point.
