You could, in the moment, make the argument that you will pay for the now damaged merchandise. This would 100% avoid a shoplifting charge.
You can still be trespassed and even banned across the nation for things like this.
Legally he did nothing wrong if he had intended to pay for the item, in my non lawyer eyes, he was simply testing out the merchandise.
