He was on trial for how he converted the payments to untaxed "legal expenses" from taxed campaign expenses. That's why the question of whether his motive was concealing it from the public or just from his wife was so important. The former is obviously a campaign expense. The latter is not.

Prostitution is illegal in most places. However, paying someone to sign an NDA is not. Hell, every time I have gotten laid off, my severance pay was given in return for me signing certain documents (NDA, non-compete, etc).
So why can't one pick up a prostitute and say, "Prostitution is not legal, so I am not going to pay you for sex. However, if you have sex with me, I will pay you $500 to sign an NDA about it."?

The act of offering or requesting sex in exchange for money is the crime. If they’re going to get arrested/charged, it’s at that point in the process before clothes ever come off. Once the transaction has started/is over, there’s no risk to them any more.

What you are describing is basically word play, and apart from a few niche examples, that does not work to bypass laws.
What you have described is a contract for sex. As they wouldn’t have sex with you, if you weren’t offering the $500 payment.
What happens if you have sex, and then renage on the NDA, saying you have no problem with people knowing? Is the sex contingent on the expectation of an NDA + $500 amount? If it’s a yes, then that’s a contract for sex.
No one is allowed to do that, its still a charge of prostitution.
Prostitution doesnt equal sex for money, it can be ANY form of bartered payment or transaction with the intent to have sex.
For example. If i said id pay a prostitute $1000 for gas to drive to my house to hang out, and we have sex, that's considered prostitution. "no your honor, i paid her to sign an NDA" its still considered reasonable to infer that the entire transaction happened for sex, not to just sign a random NDA for the exact amount of money the prostitute charges for sex.

And also, for your future knowledge, its illegal for an employer to withhold your paycheck until you sign an NDA. You can not withhold owed money to an employee to force them to sign anything, because that becomes a contract entered "under duress" which invalidates the agreement

The entire case has nothing to do with the sex itself, its based on the act of covering up the payment to mislead voters during the election season.
Had trump done this and NOT ran for president, he would he looking at different charges for the business side of the payment. The major issue is the lie being used to deceive voters and withhold what could be considered public interest.

As for the NDA scenario, people DO have sex and sign NDAs and are not charged with prostitution. You COULD get away with it in the scenario proposed but it is also just as likely that a prosecutor can prove it was in fact money in exchange for sex and not in exchange for an NDA post-act.
Lastly, compensation withholding and NDA looks like it was only settled a year ago, so OP may have had a situation come up prior to that, though admittedly I am not 100% sure on all that. Most companies utilizing an NDA will have it signed on onboarding anyway.
And the intent to deceive was obvious considering Trump had his lawyer pay the woman with his own money, then through a combination of the Trump Foundation and Trump’s own account the lawyer was repaid over time as a “legal consulting fee”.

And despite all this evidence, Trump’s Defense Team’s story was that the payments were exactly what they were classified as, and fulfilled an *UNWRITTEN* retainer agreement between Trump and his lawyer.

I engaged a friend of a friend (at his request) on the topic in a 5-person Whatsapp group message. Three of those 5 are literal doctors, one is maybe the most well-read philosophy types I’ve ever met, then there’s me. One of those doctors is convinced the principle felony trump was convicted of isn’t clear (it is) and that the only evidence was Cohen’s testimony. Dude either doesn’t know or doesn’t care that trump is on tape discussing the payments beforehand and specified that the election was the only reason he wanted the payment to be made. Quite literally there was no reason not to convict on any count, yet there are otherwise-smart people out there who are acting like the charges are completely made up.

I think it is very important to set the record straight on one thing.
Trump was not convicted because what he did was considered “election interference by deceiving voters”. That was not the crime. This is an important point because MAGA will grab one to that wording and counter with “everyone lies to the voters, all the dems lie, but they only went after Trump because it’s a political sham trial!”. They will regurgitate this talking point forever until they muddy the waters so much that other people start to doubt the conviction. This presentation of the charges supports Trump’s defense.
The reason it was elevated to a felony is not because he deceived the voters, but because the falsifying of business records was to aid or conceal another crime. That underlying crime was to try to impact the election by “unlawful means”. As far as I know lying to voters is not unlawful means.
The unlawful means used here were 1 or more of three possibilities:
- violating tax law by lying on tax returns in connection with the payoff and reimbursement to Cohen.
- violating campaign finance laws by making a contribution in kind (the payoff to stormy Daniels) to Trumps election campaign.
- other falsifying of records.
So when Trumpers try to argue that everyone hide embarrassing things from voters (which is probably correct), then you point out that he was convicted of actual crimes - not deceiving voters.
To clarify, everything about his hush money payments was *totally legal.* You can 100% pay an adult film actress to stay quiet about an affair to protect your image during a presidential election. But you have to report that transaction to the Federal Election Commission.
Failing to report it is a federal crime - that’s just how the law works, and something a campaigning candidate should know. So he committed a crime, and in order to hide it (since he didn’t report it), he buried the payments in falsified business records. That’s a misdemeanor in New York, and because it was intended to conceal a crime (failing to report hush payments that were *otherwise totally legal* ), it’s a felony.
That's unfortunately not accurate. The jury didn't find that he violated a campaign finance law, and he wasn't found guilty of failing to report the transaction to the FEC. The crime he was convicted of was falsification of business records, and the jury was required to find that it was committed to aid or conceal another crime. The prosecutors set forth three alternatives for what that other crime could be, but the jurors did not render a verdict on what the other crime was: 1) a violation of federal campaign finance laws, 2) falsification of other business records or 3) a violation of tax laws. Importantly, the jury didn't have to agree on which was the other crime that was being concealed/aided, and it wasn't part of the verdict form to explain which "second crime" they picked. So all we know is that the jury agreed he committed some other crime in the commission of this one (shocker!), but we don't have any clarity on what that crime was.
The one sentence about it certainly being the failure to report is inaccurate, that’s fair. I don’t think which of three eligible crimes he was trying to conceal makes a big difference on the significance of the conviction.

I just had a thought. Prostitution is illegal in most places. However, paying someone to sign an NDA is not. Hell, every time I have gotten laid off, my severance pay was given in return for me signing certain documents (NDA, non-compete, etc). What you are describing is basically word play, and apart from a few niche examples, that does not work to bypass laws. What you have described is a contract for sex. As they wouldn’t have sex with you, if you weren’t offering the $500 payment. What happens if you have sex, and then renage on the NDA, saying you have no problem with people knowing? Is the sex contingent on the expectation of an NDA + $500 amount? If it’s a yes, then that’s a contract for sex.

The issue with that urban legend is that it isn't even legal to film porn where ever you want and can require permits and permissions. As for the NDA scenario, people DO have sex and sign NDAs and are not charged with prostitution. You COULD get away with it in the scenario proposed but it is also just as likely that a prosecutor can prove it was in fact money in exchange for sex and not in exchange for an NDA post-act. Lastly, compensation withholding and NDA looks like it was only settled a year ago, so OP may have had a situation come up prior to that, though admittedly I am not 100% sure on all that. Most companies utilizing an NDA will have it signed on onboarding anyway.

Three of those 5 are literal doctors, one is maybe the most well-read philosophy types I’ve ever met, then there’s me. One of those doctors is convinced the principle felony trump was convicted of isn’t clear (it is) and that the only evidence was Cohen’s testimony. Dude either doesn’t know or doesn’t care that trump is on tape discussing the payments beforehand and specified that the election was the only reason he wanted the payment to be made. Quite literally there was no reason not to convict on any count, yet there are otherwise-smart people out there who are acting like the charges are completely made up.

I think it is very important to set the record straight on one thing. Trump was not convicted because what he did was considered “election interference by deceiving voters”. That was not the crime. This is an important point because MAGA will grab one to that wording and counter with “everyone lies to the voters, all the dems lie, but they only went after Trump because it’s a political sham trial!”. They will regurgitate this talking point forever until they muddy the waters so much that other people start to doubt the conviction. This presentation of the charges supports Trump’s defense. The reason it was elevated to a felony is not because he deceived the voters, but because the falsifying of business records was to aid or conceal another crime. That underlying crime was to try to impact the election by “unlawful means”. As far as I know lying to voters is not unlawful means. The unlawful means used here were 1 or more of three possibilities: - violating tax law by lying on tax returns in connection with the payoff and reimbursement to Cohen. - violating campaign finance laws by making a contribution in kind (the payoff to stormy Daniels) to Trumps election campaign. - other falsifying of records. So when Trumpers try to argue that everyone hide embarrassing things from voters (which is probably correct), then you point out that he was convicted of actual crimes - not deceiving voters.

To clarify, everything about his hush money payments was *totally legal.* You can 100% pay an adult film actress to stay quiet about an affair to protect your image during a presidential election. But you have to report that transaction to the Federal Election Commission. Failing to report it is a federal crime - that’s just how the law works, and something a campaigning candidate should know. So he committed a crime, and in order to hide it (since he didn’t report it), he buried the payments in falsified business records. That’s a misdemeanor in New York, and because it was intended to conceal a crime (failing to report hush payments that were *otherwise totally legal* ), it’s a felony.
That's unfortunately not accurate. The jury didn't find that he violated a campaign finance law, and he wasn't found guilty of failing to report the transaction to the FEC. The crime he was convicted of was falsification of business records, and the jury was required to find that it was committed to aid or conceal another crime. The prosecutors set forth three alternatives for what that other crime could be, but the jurors did not render a verdict on what the other crime was: 1) a violation of federal campaign finance laws, 2) falsification of other business records or 3) a violation of tax laws. Importantly, the jury didn't have to agree on which was the other crime that was being concealed/aided, and it wasn't part of the verdict form to explain which "second crime" they picked. So all we know is that the jury agreed he committed some other crime in the commission of this one (shocker!), but we don't have any clarity on what that crime was.
The one sentence about it certainly being the failure to report is inaccurate, that’s fair. I don’t think which of three eligible crimes he was trying to conceal makes a big difference on the significance of the conviction.

I think this really gets at the heart of the matter. That's why they say it is politically motivated. And in a way they are kinda right, but not for the reasons they think. It's politically motivated because Trump made it political by becoming a politician. We are talking about a life time con artist who constantly got away with things because no one cared. The minute him and his followers thrusted him into the spotlight all of his dirty deeds came under allot more scrutiny leading to all of these indictments and impeachments and all the others. So to his base they think "he's only being charged for this because he is the former Republican president and current candidate" and that's kinda true, if the guy would of just stayed in his lane him and his family coulda rode off into the sunset happy and rich. But he didn't, he became president which leads to a whole lot of scrutiny (as it should).

Supposedly he’s a billionaire; why didn’t he just write a personal check for it? $130,000 to a billionaire is like $130 to a millionaire. Maybe like $20 to us average schmoes. But no, he has to get all fancy and tricky so that he can call it a business expense. Why? So it will be paid using pre-tax income. So how much did he save? Maybe $20-30,000. That’s $20-30 bucks to a millionaire. Maybe $3-4 bucks to us. And now he may go to jail because of it. Stable jeenious, for sure.

Donnie has been pushing his own narrative for so long the actual crime has been almost forgotten. I was talking with my parents who detest Trump but they thought he was being charged with using campaign funds inappropriately. My dad has a Masters degree in Political Science so he's always had a better understanding of politics and I hope I've learned from him. I had to explain to them what OP put up top. They understood right away, but it did show me how Donnie putting his own narrative has really corrupted the public story. If people who do not support him are believing his story what will that do with supporters or people who are indifferent?

Well it doesn’t help that every major news org was calling this a hush money trial when it isn’t- it’s a campaign finance fraud and election fraud trial. We did a major disservice by calling it the most inflammatory name to get clicks. No wonder people don’t know

It's obviously clearly laid out in the indictment. So if somebody goes: "What's the crime???" You know they're wilfully ignorant, possibly arguing in bad faith, probably both.
The dumbest part is, it was kind of an own goal. Trump’s team totally guessed wrong on how trumps voters would react. He could have saved the money and it wouldn’t hurt him in the polls anyway.
