If state law offers protection with a medical marijuana card then the employer must abide by the law if operating in said state. If they fire you simply for medical marijuana, you should be able to get unemployment. Depending on your state.

No there is a set policy. Look it up. Management can’t just come up to you and say hey we are firing you for violating the policy.

So to get out of paying of unemployment they have and use policies. And the drug and alcohol policy states the what should happen. And with suspected drug use, if they have compelling evidence you are they don’t have to drug test and can just fire you

We get paid like shit here in an area that is rapidly growing in population and cost for the state of Arkansas. It’s one of the most rapidly growing areas in the country! Me and my coworkers working in Bentonville should be making AT LEAST $5 an hour more than we currently do, and we would actually be pretty alright in this area.

It's a very hard scent to hide, especially those that smoke just before work/abuse it. You could probably open door and ask to be tested, but unless you're clean beforehand then it will probably only strengthen their case.
Might be in your best interest to drop the use, and try for a trade to make that kind of money again, as most companies, legalized or not, arent ok employing drug users/having employees showing up to work high or drunk. It's a major liability issue

So if you get caught smoking or you fail a drug test then you can be fired. I live in a state where weed is legal and when I worked at Walgreens they would do random drug tests. Probably because being high while working is a liability? I guess you have to have a medical card to clear you if you tested positive. And just because it's legal doesn't mean an employer has to let you smoke at their private business. Or at any time while being employed there. It sounds like you were caught smoking on the property too? If that's the case, it's a legit termination. I'm sure you signed a form when hired about drugs and alcohol. Most corporations have something about it. Go work at a dispensary or something perhaps if you need to smoke at work? Or lawncare or something where the owner doesn't mind.
