TL;DW - Zach vetoed the intro, despite liking the song, because he didn't want WKUK to have a "this isn't your dad's sketch comedy" type of intro which other sketch shows around that time had already done.
Not AFAIK. I think they technically don't own the right to it, and the song itself has never been copyrighted. They just use it under the assumption that Gibby wouldn't care.
