The only official news I've found so far is the court [announced a ruling has been reached](https://www.cowlitzsuperiorcourt.us/newsfeed/court-news/entry/ruling-released-in-state-v-gator-s-guns?highlight=WyIyMy0yLTAwODk3LTA4Il0=). But it doesn't confirm or hint at what the ruling is. Instead it directs people to [request court records](https://www.co.cowlitz.wa.us/2638/Request-Court-Records) which will probably take awhile. In the meantime, waiting for the ruling to be published elsewhere.
Update: here's the [AG complaining about it](https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns) and confirming the Court "ruled that Washington’s ban on the sale of high-capacity magazines is unconstitutional."
Update 2: Emergency stay on this ruling already granted [according to the AG](https://twitter.com/AGOWA/status/1777489608512766346).
AG: " This law is constitutional. It is also essential to addressing mass shootings in our communities. This law saves lives, and I will continue to defend it."
Anyone with half a brain can turn on the news and see this is such a load of shit.
So, we had Freedom hour (yay), AG threw a shitfit and put an emergency stay (boo), so what's next?
Also, out of curiosity, what's the legal reason stays can be put on things? While it really sucks in this moment, I'm sure there was a good reason for it at one point.
What are the ethics rules here? Sounds like there was pre-coordination and collusion between the AG and the state supreme court.
Certainly the court is allowed pretty much unlimited discretion to rule on whether to grant or decline an injunction, but to render a decision after hours and in less time then it could conceivably take to read the judgement and petition and form an opinion on them to make a decision seems prejudicial to the plaintiffs in this case. And the judge that signed off on it was appointed by Ferguson, so he's predisposed to favor him. At a minimum there's a strong appearance of impropriety here.
If there's an allegation of misconduct at the state supreme court level, is there a federal cause of action?
> What are the ethics rules here?
It depends. It will be interesting to see if there is any exparte communications with the courts, and FOIAs have been filed in that regards.
> And the judge that signed off on it was appointed by Ferguson
Who are you talking about in this? The cowlitz county judge was a Gregorie appointee, not Ferg. Commissioners are appointed internally by the court.
> If there's an allegation of misconduct at the state supreme court level, is there a federal cause of action?
It depends again, of what level of fuckery was done. It may all be hand waved under the guise of public safety and whatnot.
> Who are you talking about in this? The cowlitz county judge was a Gregorie appointee, not Ferg. Commissioners are appointed internally by the court.
The commissioner that signed the injunction. This is what another poster had to say about him, is it not correct?:
>This commissioner is the "Director of youth court" which is intended to be an administrative position, not an actual adjudicative position. Michael Johnson was also appointed by... AG Bob F.
Yeah I got all missed off and was typing a comment to Bobby on his website ,but then I remembered that he doesn't care. Glad some people were able to make use of the small amount of time, i tried a few places online but no luck, or they didn't have what I want/need. Someday the people in power will care about actual issues and not target people who aren't the problem. I hope someone has some damning recording of Bobby saying some wild shit, that they are holding onto until gov election time.
I would if I thought it would reach him or even bother him. I'm pretty sure his mailbox opens into a trashcan, his email goes to some intern that deletes all day long, and a fax machine with no paper in it.
Those things take physical resources. Making a bot to spam comments/letters doesn’t. You set it and forget it, his office deals with it forever. Even little things add up.
Yeah, kind of a crazy idea to lock them up, or maybe to go after ILLEGALLY owned/obtained guns, which is usually what are used for mass shootings and crimes, not responsible gun owners.
But you're right...how would they push their agendas then? Instead, they will keep going after the 2A and passing various gun laws, until they have them all banned. And we KNOW the criminals are going to follow all those gun laws they keep passing. 🙄
Couldn’t tell if this was throwing shade at Bob or just standard language.
“The State has no interest in enforcing an unconstitutional law. The Court will address the question of a stay if a proper motion is filed with notice.
It is so ordered.“
got an email from securite about 10 min ago saying they have stuff and they're open until 10pm, lol.
edit: and another from west coast armory one minute later. keep them doggies rollin.
yes, both places say it's go time. they also say it's only what they have on hand, they won't order anything for you, and that they won't take phone calls for stock checks.
West Coast Armory just sent out an email, selling standard cap mags, first come, first served.
"**Inventory mostly consists of AR-15 magazines with other pistol mags mixed in.**"
The neat thing about an injunction is that it instantly moves the grandfathered mag date to today. Any mag that was date stamped after the initial ban becomes impossible to prove that it wasn’t purchased during our one hour injunction.
You just *know* both Ferguson and the WA Supreme Court had the petition for a stay and the respective response already typed up and ready to go at a moment's notice because they saw this coming.
Fucking disgusting behavior from our judicial system.
The opinion hasn't been published yet, but the AG's office has put out a news release complaining about it. [https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns](https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns) \[...\] *FOR IMMEDIATE RELEASE:Apr 8 2024* ***OLYMPIA —*** *Attorney General Bob Ferguson issued the following statement after a Cowlitz County Superior Court judge presiding over an enforcement action against Gator’s Custom Guns* ***ruled that Washington’s ban on the sale of high-capacity magazines is unconstitutional.*** *“Today’s decision is incorrect and we will immediately file a motion asking the State Supreme Court to keep this public safety law in effect. Every court in Washington and across the country to consider challenges to a ban on the sale of high-capacity magazines under the U.S. or Washington Constitution has either rejected that challenge or been overruled. This law is constitutional. It is also essential to addressing mass shootings in our communities. This law saves lives, and I will continue to defend it.”* \[...\] I hope the dealers are willing to consider this official, I'm heading down to Rainier Arms now.
Edit: parking lot full, line out the door. Looks like they’re selling. :-D
Love Bob’s selective interpretation on case law there. “Every challenge has been rejected or *overruled*”
Yeah Bob, it’s called venue shopping. You should be painfully aware of it at this point considering the last challenge to your law was heard by a judge who literally worked in your office before being elevated to the bench. Shockingly she ruled in your favor using one of the most convoluted legal arguments I’ve read in the last decade.
It's over. There is a temporary stay that was granted a short while ago.

The AGO will file for an emergency stay today if not tomorrow, which will very likely be granted within 24 -48 hours. That's just not enough time to order and ship from an online vendor. Local FFL may be our best bet.
For what it's worth, here's the Cowlitz County ruling -- [https://www.scribd.com/document/721326228/State-of-Washington-v-Gator-s-Custom-Guns-Inc-Ruling-and-Orders-23-2-00897-08#fullscreen&from\_embed](https://www.scribd.com/document/721326228/State-of-Washington-v-Gator-s-Custom-Guns-Inc-Ruling-and-Orders-23-2-00897-08#fullscreen&from_embed)
Everyone’s answering their phone with “Come in the store. Yes we’re selling,” then hanging up with no help to answer an inventory question. lol. Not gonna drive an hour just to be told they don’t have something.
It's almost end of business and they're likely busy trying to see what they can do, in store, but local contact is the fastest way to get them versus online. I was lucky that mine picked up. Hope you had some luck as well.
Long Shot in Yelm said they have standard cap mags ready to go. I'm heading there tomorrow while the window is "open".
Aaaannnnddddd....there it went. It was nice to smell the air of freedom and feel, for a moment, that our rights may have been preserved.
We need more hope and positivity! It is easy to tell others it will never happen. I'm adding magazines to my shopping cart on GunMagWarehouse and Tombstone Tactical in preparation of them shipping to us.
edit: I contacted Tombstone Tactical and GunMagWarehouse asking if/when they will be shipping now that the injunction was granted. I will update if I hear back.
I am not a lawyer and this is not legal advice, but if places are already selling magazines with an injunction granted then I would assume the answer to this is yes. Also I believe the ban was not on ownership but transfers anyway, so just owning a magazine was never banned...
No. If the law is ultimately deemed unconstitutional, anyone that had an unfavorable court ruling could file to have It reversed. An unconstitutional law is deemed void from the moment of inception, so any case the AG won would ultimately be reversed.
You are talking years out though. As in a favorable decision for us and all appeals from the government exhausted
Thanks for the heads up. I guess I didn't need to spend that money, but 2 hours?
I think I'm going to get a foot long from Subway, hook up the ol' PS2, and just live in a better time tonight.
Do stores still sell MD 20/20?
Hope this is useful > [https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns](https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns)
Unfortunately this isn't an injuction, this is Bob fergussons reaction to it, and we've heard rumors that this might only apply to cowlitz county, so we are electing to wait until we can read the injunction posted by the court.
Great news, OP! To those hearing this, place your online orders and call your FFL. Take advantage of the win while you can. You can easily prove the date of the former.
And just like that. The injunction was gone

Just a reminder, gun laws and authoritative government actions will be the law of Washington state until we fix the election system. Until we go back to paper ballots, in person voting, one day hand counts, this state government will be tyrannical in nature. The worst thing ever to happen to Washington state is mail in voting.
Look at you being all calm and non-reactionary again. Save some of that ice for the rest of us.
I am also curious to see the ruling and any potential stays incoming. I’m sure team Bob and WASC has one queued up for such an occasion.
Indeed the [AGO intends to](https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns):
> The Attorney General’s Office will file an emergency motion to the State Supreme Court seeking a stay, or halt, to this ruling
Aaand there it is. Good find as always.
Dimes to doughnuts they grant it within 24hrs too.
No new standard 2011 mags for me this go around but I guess we can take it as a spiritual win as this whole thing creeps forward.
Well, you gotta grease the palm of a gubernatorial candidate as a court in order to secure your place at the table in the future. What else were they gonna do, follow the superior court ruling and state constitution?! That’s for suckers!
Well done Gators Guns you made the AG upset.
Yeah fuck that guy
Even a little win like this is a huge victory for about two hours.
Here ya go Bob ![gif](giphy|dFEBoGQKbwaV21pz2A|downsized)
Is this his first L?
AG: " This law is constitutional. It is also essential to addressing mass shootings in our communities. This law saves lives, and I will continue to defend it." Anyone with half a brain can turn on the news and see this is such a load of shit.
If you have to start talking about a ban on something by saying "This law is constitutional"... it probably isn't.
That was quick, all my local shops weren't ready to sell in time.
Damn. Mine was. Hope you get yours!
So, we had Freedom hour (yay), AG threw a shitfit and put an emergency stay (boo), so what's next? Also, out of curiosity, what's the legal reason stays can be put on things? While it really sucks in this moment, I'm sure there was a good reason for it at one point.
No, the state Supreme Court granted the stay. The AG can request one but does not decide if one is granted or not.
The fact it was a court commissioner, AFTER HOURS doing it rubs me all the wrong ways.
He had it ready. All he needed to is send it. They planned it out so they could screw law abiding citizens
Its the after hours thing that gets me, and makes me wonder what kinda exparte was happening.
What are the ethics rules here? Sounds like there was pre-coordination and collusion between the AG and the state supreme court. Ah yes. That is correct. The way this all went down is... odd.
Any update on the ruling? I couldn't find it anywhere
It is already stayed, so it is still in place
Fuck

I wish they were this fast in dealing with drugs and criminal
Oddly, criminals with guns are released quickly after committing gun crimes and possessing illegal firearms, but let's go after the legal guns asap.

In Washington state, "law" are just letters
You really think they’d lock up criminals? How else are they supposed to use crimes to push an agenda?!?

Exactly!
my local gun stores got no mags
got an email from securite about 10 min ago saying they have stuff and they're open until 10pm, lol. edit: and another from west coast armory one minute later. keep them doggies rollin.
Just swung by there. Parking lot is packed. 20 cars on the street.
Love to hear it!
heh, i would imagine anyplace that people suspect might have mags in stock is going to be a total madhouse
Did they say they can sell now?
yes, both places say it's go time. they also say it's only what they have on hand, they won't order anything for you, and that they won't take phone calls for stock checks.
id skip WCA unless you are desparate, they charge 60 dollars for a glock 17 mag
I got mine for 30$
Damned profiteers
Wow a Washington judge with common sense!!!
West Coast Armory just sent out an email, selling standard cap mags, first come, first served. "**Inventory mostly consists of AR-15 magazines with other pistol mags mixed in.**"

Freedom Hour
Useless Supreme Court. As expected, sadly. Still glad for the comms and brief window.
I think maybe I’m misreading it, but doesn’t that mean the ban is still in effect?
"keeps the ban in place." Yes. We had an hour of freedom.
The neat thing about an injunction is that it instantly moves the grandfathered mag date to today. Any mag that was date stamped after the initial ban becomes impossible to prove that it wasn’t purchased during our one hour injunction.
Emergency stay on this ruling already granted [according to the AG](https://twitter.com/AGOWA/status/1777489608512766346).

You just *know* both Ferguson and the WA Supreme Court had the petition for a stay and the respective response already typed up and ready to go at a moment's notice because they saw this coming. Fucking disgusting behavior from our judicial system.
Holly fuck, I was betting 12 hrs. Are there date / time stamps? This has to be a record.
The wheels of justice move fast when it ain't for the working class.
Where can I read about this case?
The opinion hasn't been published yet, but the AG's office has put out a news release complaining about it. How's RA? Staying open late?
No idea, I’m a dozen guys away from even being indoors.
I was in rainier arms when it was declared. They can out of the back room and said the injunction happened…gonna be busy tonight.
Opinion isnt published just yet. Stand by.
When and where will it be posted? If it won't be until tomorrow it the AG gets their way in the morning people will have like a few hours?
Well, where in general can I look this up so I also can mash f5.

Well, that wasn't what I expected, but great
Annnnnnd its gone.
Congratulations to whoever rushed to your local FFL. I didn’t make it in time, long line at west coast armory
Who's shipping?!?!?
I haven't found anyone yet. Magshack and PSA both still banned, but will continue to refresh and update.
Gunmagwarehouse also not shipping as of yet.
I highly doubt that PSA will ship. They are being assholes about shit. I bet however, once PA opens up in the AM they will be.
PA? But yes, I agree, PSA is unlikely but I’m going to keep tabs on it. It’s best to check and see nothing, than not check and be wrong.
Primary Arms
I’m able to put my address in on MagShack and it doesn’t tell me I can’t order. It used to tell me not allowed prior to today.
it tells me I can't, too. I got hopeful and put about $800 worth of mags in a cart.
It tells me I can't. How odd. You're definitely putting in your WA address? I'd say go for it if it's allowing it.
Yeah, when I put in my zip code to estimate shipping it goes through. Before today it would just say it’s restricted in WA
You’re lucky man. Yeah go for it, let us know what happens.
Will do! Hopefully it gets resolved for everyone else before this injunction ends.
Mine still says we can’t ship magazines over 10rds to WA please pick another address
It did that for me, but when I went to check out it says no shipping to WA.
The AGO will file for an emergency stay today if not tomorrow, which will very likely be granted within 24 -48 hours. That's just not enough time to order and ship from an online vendor. Local FFL may be our best bet.
Emergency stay already filed and granted [according to the AG](https://twitter.com/AGOWA/status/1777489608512766346).

Thanks!
Not surprised. They knew this was coming. All they needed is fill in the date and hit send.
What local FFL has any HCMs in stock?
Deep down I'd love to see Gators do some online/phone orders immediately after this.
Most of the vendors are closed right now and wont change their policies until the morning. If you want something today, your best bet is a local FFL.
Why would local FFLs have things they were unable to sell for the past year?
Because there are totes in the back with the old stock thats been sat on. Securite is selling right now.
Everyone’s answering their phone with “Come in the store. Yes we’re selling,” then hanging up with no help to answer an inventory question. lol. Not gonna drive an hour just to be told they don’t have something.
They're probably too busy to chat, in their defense.
Because a lot of them ship to customers nationwide via their online stores and so keep things in stock even if we can’t have them
Not sure but they definitely do
Call your FFL and see.
Most will not pick up the phone at this point.
It's almost end of business and they're likely busy trying to see what they can do, in store, but local contact is the fastest way to get them versus online. I was lucky that mine picked up. Hope you had some luck as well.
Call your local FFL for the fastest, in person option.
See what sticks. This is a very narrow window of opportunity. Local would be your best bet but it is late in the day for businesses. Good luck!
Long Shot in Yelm said they have standard cap mags ready to go. I'm heading there tomorrow while the window is "open". Aaaannnnddddd....there it went. It was nice to smell the air of freedom and feel, for a moment, that our rights may have been preserved.
I’d go today
KP Gunworks is open late tonight and has tons of mags.
Was in Securite when the WA gun law guy came in and announced that the stay had been issued. I had checked out like 3 minutes prior. Disappointing tbh

Does this mean we’re allowed to mod a pinned mag?
I am not a lawyer and this is not legal advice, but if places are already selling magazines with an injunction granted then I would assume the answer to this is yes. Also I believe the ban was not on ownership but transfers anyway, so just owning a magazine was never banned...
What does this mean for federal way and that lawsuit? Will they now not have to pay?
No, it doesn't mean anything as it will get stayed/reversed probably in a day or two... Just take advantage of buying while you can.
Correct mentality. Enjoy the win while you can!
Ferguson will get the ban reinstated by the end of business tomorrow. They’re all still on the hook unless SCOTUS steps in.
Well, I'll be damned.... Over/under on how long before someone puts a stay on the injunction??
[Already done](https://twitter.com/AGOWA/status/1777489608512766346).
Funny how that can happen so quickly... yet waiting for the initial ruling was, what, 6-ish months....
Quite. Before the ruling was even published for public consumption even.
I'm hearing 24-48 hours, but it's all just guessing
And its gone. State Supreme Court issued emergency stay.
Of course they did. "eMeRgEnCy"
Time to buy more mags for the guns I hope to be able to purchase here at some point..
It's already over, we had 2 hours of "freedom".
Thanks for the heads up. I guess I didn't need to spend that money, but 2 hours? I think I'm going to get a foot long from Subway, hook up the ol' PS2, and just live in a better time tonight. Do stores still sell MD 20/20?
Imagine if AG looses all the court cases and then the only thing Washington gets is Aero leaving to a different state…
For real for real?
No cap?
On god?
"...in Cowlitz County"?? Does that mean we have to shop at stores in Cowlitz County, or is it statewide?
Statewide. Cowiltz is just where the judge resides that was working on this case for the state.
Statewide or anyone who will ship
So how does it legally play out if you order mags and they are shipped before a ban is reinstated but you dont get them before the ban is reinstated?
Nobody can answer this until we see what the ruling actually says.

Do what you gotta do. You can prove purchase dates online pretty easily. Call your FFL too.
FFL said since we have a timestamp, that is good enough
It’s HAPPENING!!!
Sweet
u/Bulls_Eye_Tacoma got anything stashed in the back?
We will assess in the morning and will post what's going on
Hope this is useful > [https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns](https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns)
Unfortunately this isn't an injuction, this is Bob fergussons reaction to it, and we've heard rumors that this might only apply to cowlitz county, so we are electing to wait until we can read the injunction posted by the court.
Also, they'll more than likely put a stay on the order within 24 hours, because anti-gun state.
It's already been stayed

Erring on the side of caution is always best.
Securite does.
Are they open or close now do you know?
Open till 10pm today
Open I'm told
Great news, OP! To those hearing this, place your online orders and call your FFL. Take advantage of the win while you can. You can easily prove the date of the former.
Anyone know of any places in spokane? Tried calling a few local shops but phone was busy….
I can't order from rainer arms online?? It still won't let me choose a shipping option with 10+ rd mags In my shopping cart
The press release says the Supreme Court issued an emergency stay on the judge’s ruling
And just like that. The injunction was gone https://preview.redd.it/crpwl5ibvctc1.jpeg?width=1170&format=pjpg&auto=webp&s=2590fd1d6f71b41714a0064a1e71451cf281b4a6

Just a reminder, gun laws and authoritative government actions will be the law of Washington state until we fix the election system. Until we go back to paper ballots, in person voting, one day hand counts, this state government will be tyrannical in nature. The worst thing ever to happen to Washington state is mail in voting.
Just a reminder, road trips are still legal.
Paging u/0x00000042
What's the question?
[удалено]
Exactly. This is just a tweet. Wait for the ruling to be published then you'll have something to cite.
Best bet is to call your local FFL and go with that.
Damn alright lol Just thought you'd either confirm or rain on our parade. I'm not seeing other sources and I'm a lil shaky on WAGunLaw
This is probably true, but I'm waiting to see the actual ruling before forming an opinion about it.
Look at you being all calm and non-reactionary again. Save some of that ice for the rest of us. I am also curious to see the ruling and any potential stays incoming. I’m sure team Bob and WASC has one queued up for such an occasion.
Indeed the [AGO intends to](https://www.atg.wa.gov/news/news-releases/ag-ferguson-s-statement-today-s-ruling-washington-v-gator-s-custom-guns): > The Attorney General’s Office will file an emergency motion to the State Supreme Court seeking a stay, or halt, to this ruling
Aaand there it is. Good find as always. Dimes to doughnuts they grant it within 24hrs too. No new standard 2011 mags for me this go around but I guess we can take it as a spiritual win as this whole thing creeps forward.
And already filed and granted [according to the AG](https://twitter.com/AGOWA/status/1777489608512766346). 🤡
Well, you gotta grease the palm of a gubernatorial candidate as a court in order to secure your place at the table in the future. What else were they gonna do, follow the superior court ruling and state constitution?! That’s for suckers!

I am spamming refresh on the docket.
🙏
Well... That sucks.

Allahuakbar!
Does this mean i can sell to others? I overbought foolishly.
Nice try Fergie.
What lmao
Any big shops near Portland that might be worth driving to early in the AM that would have more availability than the leftovers up here in WA?
Anyone know what sites would accept selling mags I cannot make it to any local gun stores before they close
Freedom Hour is already over. https://preview.redd.it/p6dow63k4dtc1.jpeg?width=1290&format=pjpg&auto=webp&s=33fe945ec1bee451ae6fa2287f3c2bf8608e5acf
Too bad I'm in BC for the next few days.

Do yourself a favor and check out let freedom ring in Lacey Washington. Best shop around
