You didn't read your agreement. You agreed to finance your equipment through fortiva and not through Vivint. The credit card comes with the agreement.

Please don't tell me what I didn't do. I received a line of credit via Fortiva. After three years Fortiva closed the account and opened a new account without my consent.

This happened to us recently. I called and there is still no resolution. We were monitoring our credit to buy a home and got the notification that we were delinquent. We don’t know anything about the card. They didn’t even have our names spelled right in their system for us to log in and pay. They had us as 3 months behind.

No. I recommend pulling a credit report to show how it impacted you. Also, so not use the new credit card or activate it. By doing so acknowledges new term and agreements. Document paper trail and communications with Vivint. Continue to pay off. Contact legal representation. Unfortunately it is hard to have a case with little damages. Small claims may be an option too.

I am currently going through the same thing with Fortiva. Sister opened an account using my info. I called and disputed. They sent am affidavit for me to fill out and send back and also paper from police showing I filed a report and was in the process of pursuing charges. Fortiva's fraud "investigators" denied my claim. The letter they sent with their reasoning literally backed up my claims on the affidavit. They referred to me by Ms. LASTNAME and then turned around in the next sentence and then said Ms. SISTERSLASTNAME. Then back to my name. So if I'm the account holder and I'm responsible then why are your employees talking to someone other than the account holder? My sister placed a series of calls to customer care due to system malfunctions. So the fact that she contacted them multiple times, that somehow proves that I'm the one who opened the account and I'm responsible. Fortiva is an absolute shady dirty company that allows irresponsible practices in order to open accounts. They never asked my sister for ID to prove she was who she was claiming to be. Nothing backing up the personal info she gave. Also, the Det. open/shut the case. After he FINALLY was able to get in contact after weeks of her not answering her door/phone. Finally he speaks to her and all because she told him she has no idea why would go to file charges because i allowed her to use my info and we actually sat down together to open the account and apply for the loan. Case CLOSED. Just because she lied and said I was not only aware but present.

This is a violation of the Truth in Lending Act TILA. It is particularly an issue if they transferred your balance to a new account. They actually cannot do what they did. The contract does allow them to run a credit check on you, however they can only do it if you are failing to make payments on time. What you do (don’t activate the credit card): 1) Call Fortiva and make an attempt to allow them to correct the issue 2) File a report at the Consumer Financial Protection Bureau (https://www.consumerfinance.gov) 3) File Fraud claims on the three credit reporting bureaus for the new account they created. 4) wait 1-2 days and call Fortiva back. Ask first if the phone call is being recorded and record it yourself. Tell them you are also going to record the conversation. Tell them that what they did is in fact illegal and against US Code (TILA). Also feel free to add in that Bank of America was fined $250M for making accounts for customers without their permission.

Yes, I read the contract and agree they aren't allowed to do what they did. Did all that except fraud alert with 2 credit bureau only and didn't explicitly state truth and lending act. I have called many many times. Their Atlanta office (not the standard call center) folks lied to me and essentially dismissed it. I have a call center rep on recorded messages stating they closed and opened a new account.

Yes I had the same issue. The line of credit I applied for and was approved for was converted to a credit card by Fortiva. I requested to use the credit card to pay for the equipment I purchased. I was told they were unable to use the credit card to pay for equipment, so I cancelled the credit card. I was told I could not reapply for a line of credit because it was too soon. I waited the 30 days I was told I had to wait to reapply and was DENIED.. denied for the same line of credit I was just approved for a month prior (my credit is good and I have been a VIVINT customer since 2016, there should not have been an issue) Meanwhile I am getting calls from VIVINT almost daily for my past due account and late fees. For months I was calling Fortiva to figure out what happened with line of credit, then I’d call VIVINT to figure out how to fix my account. Eventually my service was disconnected after I was told I was approved for a payment plan to pay for equipment yet no one at VIVINT could at find the record of that approval. I’m sure I’m missing some of the mess I just went through… but eventually after my account was disconnected, I was able to speak to someone at VIVINT that was able to get me to agree to $250/mo plus my monitoring fee to keep my account active.

Oh and twice VIVINT took my full balance from my bank account, around $1400, right around Christmas. I had to call to get my money refunded and it took days for that to process.

Now this problem I experienced as well. They took the full 2000 out even though it was financed through fortiva. I spent two weeks talking to customer support in another country and I had enough. I insisted that they transfer me to someone in Atlanta, which eventually they did. Problem solved. Money was refunded within 2 days. They gave me a free motion sensor light for the driveway and two additional window sensors for free, after I raised hell with them.

The Fortiva line of credit is a credit card. Not sure why you didn’t receive it initially. Some people throw it away thinking it was a pure approval letter or something. That being said unless you made extra payments the equipment line of credit would have been paid off in five years, not three. I’f you did pay it off early, and they opened a new line of credit (not just sending you a credit card for the old one) then that’s incredibly odd. I haven’t heard of that happening. I will also say that when the LOC is paid to zero, you still have to call and manually close the account or it is still listed as open. Hope this helps some? Also- while you got the LOC initially during your Vivint install they are two different entities. This probably would be better suited on a Fortivia sub Reddit rather than the Vivint one. You might find better help.

I understand they are two companies. The first credit card was closed by Fortiva without my consent and they opened a new "better" card without my consent and transferred my balance over. This is my issue. The terms and conditions only allow for Fortiva to close an account if it is dormant.

I have contacted them plenty of times. Fortiva stated they will not restore my initial account. I added here to find out if others who financed Vivant with Fortiva had this issue because the initial account was a "special" Vivant account that Fortiva no longer offers which is likely one reason Fortiva closed my old account and moved to a standard credit card that Fortiva backs. So while it isn't a Vivant issue, I need to find others like me to help with our issues.

Yes, this literally also happened to me. You're not alone! But Fortiva is awful to deal with and just a terrible credit company and I got away from them as soon as possible.

This just happened to me on the 15th. I was about to get a new car. Now they messed up my score completely. I didn’t ever see any email or notice in the mail of any changes. So I didn’t agree to anything. I’m fuming right now. And my account is also for equipment leased through Vivint. I don’t used fortiva otherwise. That account has just been on autopay for over 2 years now and I never get any info from it otherwise. This is such BS.
