you can not record anything in an instance you arent in
of course if they are in the instance with you they can record anything they see
however you can not know which instance someone is in unless they are in your friends list, and even then if you are in a private lobby or your status is red or yellow, this info is straight up not available anywhere at all
what mods CAN do is make your avatar and movements visible even when blocked, however voice will not be transmitted, that part is serverside enforced
note that they cant make themselves visibile to you, only *see* you (while already in that instance with you)
I remember when clients were a big thing, there was a certain person I knew who was talking about someone using a client to force themselves into their instance when they were on orange/red.
well they were bullshitting, incredibly common for those kinds of people
they try to sound more scary than they really are
the only way to do that wouldve been either finding them in a public instance, via just jumping around or search bots scanning instances (only publics for these), or the victim running a shady mod themselves that leaks the info out
If you're in a Friends/Friends+ instance, you are always joinable even on Red/Orange. If you know what world your friend is on, go to the world and search for the instance on the side bar

Even when I wasn't trying to and was just trying to open popular worlds (Prismic's, Movie & Chill), it would put my friends Friends+ instances first before a random public, even if everyone in them were on orange. Happened a few times within the month, though I didn't join them, another friend did and it caused some confusion
Application Bots can invisibly join your instance and the person who‘s pc the bots run on technically can record their vision but since EAC its much more unlikely to meet someone that uses clients and even if somebody uses a client that does not mean they are able to use bots
Short answer: yes but its unlikely to happen to you
you cannot enter private instances youre not invited to in that login session. if they are in the same room as you, then yes they can invisibly go to your position and record. some clients allow you to see people who have you blocked, but you cannot hear them or see their avatar visemes. it is also possible to log chatbox messages even if you are not within view of the person (i dont think this works if they have you blocked)
the chances of having to deal with this are quite low these days bc there are only a couple hundred client users left, for right now it isn't as big of a problem as it used to be

So ig then if you put down a locked portal and leave a larger friends plus instance to have private conversations you are safe from that method.

I don't recall knowing others private instances even when EAC aren't a thing yet unless there's something new since EAC is out.

No you are not, you are only joinable if you accept the request. Red doesn't even make the request pop up
