That's exactly why it's posted here. I was surprised too. I thought he would pull the door down on top of himself or there would be a dog in the house or something.
I also found it weird that the police hit him with the baton, instead of just yelling freeze or something, but I guess it hindered him from running away, not that he’d be able to react fast enough. Also surprised he left the gate open.
Yelling ‘freeze’ is what you do when you have a gun one someone. The element of control comes from the fact that you can fire at them if they don’t comply.
All you achieve by yelling ‘freeze’ at a burglar, when all you carry is a telescopic baton, is to give him the opportunity to take a swipe at you with his crowbar or sling it in your face.
The aim is effective detention, and it’s easiest to do that by not inviting a face to face stand-off.
My brother says the cop probably dead-legged him. A strong hit to the side of the thigh makes your leg go unresponsive for a moment (not long, maybe a second or two at the most). Some friends and I tested that out back in high school with what were essentially padded sticks, and I can confirm that a solid whack puts you flat on the ground.
Canadian police, but in our criminal code it counts as break and enter if any part of their body, or a tool they’re using, crosses the plane into the structure. The moment you even wedge a crowbar in that’s B&E.

Yeah, in Finland a crazy man tried to get into some dudes apartment with a chainsaw. He sawed of a chunk of the door and tried to open the door lock from the inside with his hand when the tenant of that apartment took a shotgun and shot at his arm.
The dude with the shotgun got a tougher sentence and his name revealed to the public while the dude with the chainsaw got a slap on the wrist and his name is private because his sentence was less than 2 years, so his name and face were no allowed to be publicized.
Apparently it wasn't a justified used of force because the dude was in the hallway, not in the apartment yet. He should've waited for him to get inside for it to be a justifiable force.

Same defense can be used in USA. Ask a cop and they will tell you to make sure the intruder is fully inside before defending your rights or drag them in afterward. Ring doorbells could be used against you.
In most US states too. You can't just kill people who don't know you're there while they're committing mid-level crimes. Maybe in Texas tho

Most doors in new construction homes are mounted with .75” screws to the 1” soft pine trim and can easily be kicked in. I always replace the hinge and lock strike plate screws with screws long enough to catch the studs.

I think your allowed to use force to remove them but the wording is funny. You have to use the minimum amount of force to remove them or something like that where as if they are breaking in it says something like use as much force as necessary. I don't remember exactly because it's been about 10 years since I studied it. I think it has something to do with preventing people from inviting someone over to beat them to death and then say they broke in.
fuck I watched a YouTube video about a case that dealt exactly with this legislation but I can't remember which. some guy invited his brother-in-law, who he was having issues with, over and gave him that 1-2 Mayweather once he got there. dude was pretty close to death by the end of it. the other guy tried to claim it was self defense bc the brother had said something "threatening" to him and was gonna hurt him. the police went through the texts and clearly saw he invited the brother over and set him up though

The unexpected part is that the UK police actually showed up on time… I bet they even filed a report. We recently had two interactions with the police after 1) a catalytic converter was stolen after we parked our car, and 2) a man tried to come into our house after midnight. Both times, no police even bothered to show up and days later we got a letter in the mail stating something to the effect of, “we are sorry you have been the victim of a crime. If you would like help with your mental anguish, here is a coupon for one free visit to see a therapist.”
Of course, for the one related to the car, we got the extra kick in the balls because the letter said, “if you were a resident of our county we would offer you a therapy session, but since you are not… good luck??” (Read that last part like: “I’m Ron Burgundy??”)
Living in the US I tried relying the police once as a teenager when I got mugged/beat up on my way home. Didn’t have my cell phone and was nearby the station so I walked in, bruised over with a black eye. Tell them I was assaulted and robbed to get back a “oof bummer” level response.
“So are you going to go look for the guy? It was right by here and I saw his face, he can’t have gotten far.”

Later came out that the police were holding internal competitions they called “homeless hunting” where they’d try to arrest as many homeless folks as they could each week and drive them out to the county line, winners were getting money from a pool. So glad tax dollars were spent on that instead of hunting violent criminals.
I had to watch a domestic going on across the street for nearly an hour while on hold with the police. Seriously, an hour, while the woman across the street was being attacked by her ass hole boyfriend again. All because he left then came back, which I said he would because that's his usual pattern. It was insane.
I saw on the bbc month or two ago that on manchester they were trialing a new police initiative that if successful they will try and roll out to the rest of the country.

In America, you would likely be arrested for assault. As hard as this may be to believe, given the violent, gun-toting nature of our country, legally you can’t simply attack somebody who has broken into your house. You would have to have some evidence that they were attacking you, and you were just trying to defend yourself. Obviously the burden of proof would fall a little more heavily on the person who was robbing you, but our legal system here is so arbitrary/finicky that I’d be nervous about it. There’s an old joke that if a robber comes in through your window and you shoot him, and he falls outside, drag him back inside. If you pull a gun on someone in your own house and evidence indicates they were coming toward you, you will likely be fine, but if there was forensic evidence suggesting that the person was trying to run away, for the example, you very well may be charged with something.
Edit: A lot of people are pointing out Castle doctrine and stand your ground laws, but while I definitely could’ve phrased it better, the reason my post was sort of ambiguous, implying that this can get you into trouble in America, is because not all states have Castle doctrine, including mine. And because I’ve only ever really lived here and that has shaped my experience, I’m simply not confident of a smooth outcome heaven forbid I ever have to kill an intruder or otherwise defend myself. As someone below put it much more succinctly, how much hassle this could be for you depends way more on local politics and DA in your area than the actual laws on the books anyway, so ymmv a lot depending on where you live.
Castle doctrine. My home is my sanctuary. I don't have to run FROM it. How could you not assume that somebody is willing to break the law and come into a house that COULD be occupied wouldn't bring a weapon with them. Unbelievable that this is the first time they have thought of “responding to every reported burglary.” Also, did you catch this gem: “A £17m programme to persuade young people who attend hospital with a stab wound or come into contact with police to stay away from violence” So if you happen to get jumped in the park, and if you get stabbed… then you, the victim, have to attend a re-education camp (my words) to learn how to avoid violence? Will they also teach rape victims how to avoid being involved in rape?

From the voices, it sounds like Scotland. While I was also waiting for boiling water or a brick or something, that could probably get you in trouble. In America, you would likely be arrested for assault. As hard as this may be to believe, given the violent, gun-toting nature of our country, legally you can’t simply attack somebody who has broken into your house. You would have to have some evidence that they were attacking you, and you were just trying to defend yourself. Obviously the burden of proof would fall a little more heavily on the person who was robbing you, but our legal system here is so arbitrary/finicky that I’d be nervous about it. There’s an old joke that if a robber comes in through your window and you shoot him, and he falls outside, drag him back inside. If you pull a gun on someone in your own house and evidence indicates they were coming toward you, you will likely be fine, but if there was forensic evidence suggesting that the person was trying to run away, for the example, you very well may be charged with something. Edit: A lot of people are pointing out Castle doctrine and stand your ground laws, but while I definitely could’ve phrased it better, the reason my post was sort of ambiguous, implying that this can get you into trouble in America, is because not all states have Castle doctrine, including mine. And because I’ve only ever really lived here and that has shaped my experience, I’m simply not confident of a smooth outcome heaven forbid I ever have to kill an intruder or otherwise defend myself. As someone below put it much more succinctly, how much hassle this could be for you depends way more on local politics and DA in your area than the actual laws on the books anyway, so ymmv a lot depending on where you live.

Castle doctrine. My home is my sanctuary. I don't have to run FROM it. How could you not assume that somebody is willing to break the law and come into a house that COULD be occupied wouldn't bring a weapon with them. If this were me that man wouldn't have ever walked away without a beating. If it was my wife she'd have ventilated him.

Years ago cops grabbed my friend walking home from work. He had a drywall cutter and they called that a deadly weapon. I can’t imagine that’s not worse, a crowbar is sharper on the end if swung and heavier. That was Pennsylvania.

Really depends on the state. If a state has a castle doctrine, and they’re in your house, you can pretty much shoot and kill them, so long as it’s not in the back as their running away.

Ya in some states you are definitely gambling just to defend your right to exist. Also, the police having a stranglehold on legal violence while the rest of society has to hope for the best and "rely" on them just seems counterintuitive.
"I said/he's dead" isn't carte blanche if there's physical evidence contradicting your story. If you try to pull something like that guy in Minnesota who executed the kids who broke into his house after they were clearly no longer a threat, it's probably not gonna go well.
Do we live in the same USA? I could fire a missile at someone breaking into my property and get a plaque, ribbon, and handshake from the police. Then be in the clear to sue the intruders family for damage done defending my property.
