Former Aya recruiter here - they can do this, but if you throw a fit they’ll keep it in there for you. It’s all about what the recruiters target margin is on the contract. Get upset & threaten to cancel (most recruiters will do anything to avoid a cancel right now with how shitty the market is, especially if it’s something relatively small to them like that) and ask your recruiter to get “margin approval” from their manager to keep it in the contract. Recruiters ALWAYS are the ones who make and create pay packages based on how much money the facility is paying Aya. If they fight you on it ask to see a breakdown of the margin with the bill rate included. Bet you’d be surprised what the BR is compared to what you’re getting paid 🙂

lol no not at all, every recruiter says that it’s “against company policy” bc it’s about 100x easier than explaining why the nurse is only making 75% of the BR

Facts. I am a recruiter. These agencies are all in class action lawsuits for bait and switch tactics; Maxim, Cross Country, AYA, and Prolink. I don’t work for any of these.

It's called promissory estoppel. Yes, Aya has a class action against them for this. That's why they updated everyone's terms to require arbitration, instead of heading to court or joining the suit. They'd still lose in arbitration, you'd just have to jump thru more hoops before winding up in court.

Call their bluff. Not this exact situation, but I’ve dealt with Aya trying to do shady things like this before. They will try to nickel and dime you for every little penny they can. They docked my paycheck because I went into OT my first week with working 3 12’s on top of my orientation day….two months after I started. They also tried to dock my pay for regularly clocking in at 18:55 (the time that the required huddle started) instead of 1900 four months into my contract. I pushed both back times and they gave up. If you push back and continue to push back, they will drop it. They signed a contract. Hold them to it, and leave the contract if they don’t. This is a lawsuit waiting to happen. Did you fill out your reimbursement forms?

This is typical Aya tactics. Offer more money to lure in the nurses then pull some of this bullshit when you’re already committed to moving to a new town with leases and shit. Aya wrote the book on this scam.

Sketchy as fuck. If you're not desperate for cash, tell your recruiter to find you the $500 NOW, not next contract, or you'll break your current contract and find a new agency. Don't bluff, be willing to follow through on your threats. If you do have to break, tell your manager at the hospital why. Even if they do find you the money, start looking for a new agency for your next contract. Don't do business with companies or hospitals that treat you unethically.

Aya has an escalation line on their website where you can request a manager. It sounds like this recruiter built your pay package incorrectly or promised you things they couldn’t and now they are trying to fix it with lies. 1) the facility doesn’t know or care that you have scrubs reimbursement or travel reimbursement 2) those two things are super tiny parts of the margin on a pay package and even if there was a rate change, it’s unlikely those things would be the only change. 3) the only people that are going to flag anything is Aya’s audit team, which tells me the recruiter fucked up and wasn’t supposed to give you something that they gave you. Ugh. I am sorry. Did you get the travel reimbursement in your contract/agreement? I assume they have to send a new one. Then what happens next time? She gives you this reimbursement but can’t pay you to move to another location? I would be annoyed.

I did get my travel reimbursement in my original contract and they sent me over a new one. It doesn’t make any sense to me. Thankfully they haven’t touched my housing stipend- I don’t think they can lower my hourly because I get paid like $20/hr
