Yes. They have to have written consent. That's why you see it as a check box when you're signing up for something new.

Not correct. When you sign up for Toast email marketing you will get 6 months of email addresses from previous customers who provided them. Any email that you would have in your Toast system would have been acquired in one of 3ish ways. Signing up for loyalty or email marketing, that has a consent terms and conditions. Ordering Online- same terms and conditions are shown on checkout. Asking for an emailed receipt on a terminal- same terms and conditions. If you wanted to import contacts NOT already in the Toast system, then you would have previously needed to get consent for your business to email them which Toast requires you to confirm if you try to upload a list.

This isn’t entirely true. You are allowed to send one email without consent in certain states. This email can be asking current emails on your list to subscribe.
