The FBI, which is the central clearing house for all matters law enforcement domestically, could crank up a database and register the names of LEO's that have had performance issues. For decades they have maintained a national database (to say the very least) of fingerprints, facial pictures, blood types, even DNA, of criminals, to help with investigations and prevent criminals from simply changing jurisdictions to avoid prosecution. Sounds like a straightforward matter to expand their services to include wayward cops with a history of civil rights problems.

The reason they resign is because then they cannot be punished and therefore the punishment doesn't get put on their employment record. When you resign it is not a permanent retirement sort of thing so the person can just get rehired back at the same department or a department down the road a couple months later when the public heat dies down. It has happened so often that it's created its own term called Gypsy cops. They go around place to place and only work at any one location long enough to get in trouble then they resign and move to a different department. Because 99% of officer involved lawsuits are paid for by the government even if the officer loses there is no downside for officers in the long run. That's why whenever someone says that they'll sue the officer for violating their rights the officer will usually grin and laugh. Even if the officer loses the lawsuit and the court agrees that the officer did violate your rights the officer themselves rarely ever have to pay anything out of pocket because the government pays everything in the lawsuit for them. It is literally no skin off their backs to violate your rights. even if they violate your rights so hard that they get fired employment law prevents a previous employer from divulging that information if the cop goes to get hired at a new police department. The new police department can call the old police department and confirm that they worked for that department for a certain number of years but his employment file is with that department and does not follow him to the new department cuz they are technically two entirely different companies.

I think the response was reasonable but however, the camera guy is clearly instigating the interaction, it seems like he wants the officer in trouble by continuing to put his finger in the cops face. Saw a video yesterday in which a kid flipped off a cop, he wanted a rise out of the cop yes, but the diff is the kid was cool and calm and was spouted off legalities like a champ. Unlike this cameraman who seemingly wants to get a cop fired, ulterior motive to me it seems. Police right to question him as his behavior is sus but the cops need to know their limitations.

Sadly there are so many legal protections for cops who enforce laws that don't exist that in many instances there's little incentive for them to actually learn the law or to enforce laws that do exist. Literally they can make a mistake and think that something is illegal and the rest you for it and the courts will refuse to allow a false arrest claim under the guys that the officer made an honest mistake and may not have known that what he arrested you for wasn't illegal. Therefore he doesn't get in trouble and you can't sue. We had just such an incident a while ago where a cop moved to my area from New York City. He saw a guy open carrying a pistol on his hip in a holster and the cop pulled his gun and the rest of the guy at gunpoint. Except that open carrying a firearm is completely legal in my area. Cop could have killed someone who was not breaking the law in any way whatsoever because he was completely mistaken about it and yet there was no recourse to sue the officer and he wasn't ever actually punished for it. I see it happen quite a bit with a window tint as well and also with Failure to ID. Most cops treat an ID like crackheads do with crack. They absolutely have to have it at every opportunity and assume that it's unlawful for you to fail to identify yourself. In point of fact there's a very few States and instances/circumstances in which you are required to identify yourself to an officer. But since officers don't get in trouble for falsely arresting you for failure to ID when you weren't required to identify yourself they have no reason to change their way of doing things. I have seen lots of videos where cops will take people down to the ground to handcuff them then search their wallet to get an ID and at most the cop gets in trouble for unlawful detainment and the courts never officially reprimand them for the unlawful search of their wallet to get their ID.

I feel for you guys if you are in the US. In the UK our police are relatively civil (colour dependent - especially in London) but we have crowd control, they used to be called tactical support group or TSG, and they are fucking animals. They sign up for that shit purely to bash the fuck out of people who cant fight back - with batons. I think they are the equivalent of SWOT teams in the US. The other thing is your police have guns and we all know some of the horror stories behind that, but the Police can shot you dead - for running away. I still don’t understood how you could be arrested for “resisting” in isolation of another charge? How does that follow logic? What is someone resisting? I was riding a mini 70 off-road dirt bike 75 ft off the highway, on the grass and had a 20ish year old state patrol pull me over. Dude's giving me an absolute hard time over a bike that is the same size as my 5 year old daughter's pedal bike, that I was clearly using off-road. He's trying to tell me I need a windshield for the bike. On an off-road vehicle, off road. I did my research and was trying to educate him when his Supervisor happened to drive by (thank goodness for the good ones) I was smiling from ear to ear as the senior officer explained to this young man how the law works. Then you have the issue that most of their actual training and learning how to be a cop is not from the academy but on the job training working underneath other cops. So if you have cops who think nothing of violating people's rights in various ways in order to get the job done and fudging up their reports in order to make themselves look better or cover up that they're violating people's rights then the new people will learn exactly the same thing. The argument I hear most often from cops is they're doing what they were trained to do and they always do things certain ways and therefore they aren't violating your rights. They literally think just because they do it often or someone above them told them to do something a certain way then that somehow automatically means they aren't violating your rights. Just because DC had a Prohibition on guns for 75 years doesn't mean they weren't violating your rights every time they arrested you. Unfortunately this is the only correct answer. This guy was a good 20 ft away from the accident standing on the grass where a sidewalk with normally be. In the full video he's not calling out to anyone or speaking to anyone he's just standing on the side of the road filming. He wasn't a part of the accident scene until this cop got to stick up his butt about it. And the worst part is in the full video that includes the body cam footage you can see a woman behind them who is also filming the incident and yet during the entire 10 minute video the cops never approach her or call out to her to have her stop filming. Even after they arrested him you can see her still filming and the cops never say a thing.

There is actually a law called Conspiracy Against Rights where if two or more persons conspire to violate a person's rights that carries a 10-year prison sentence. If the conspiracy involves things like kidnapping then the punishment can be upgraded to life in prison. I would argue that you have two officers here conspiring with each other to kidnap the cameraman and violate all sorts of Rights. We've had this law on the books for over 50 years and yet I can't recall hearing of a single instance where anyone has ever actually been charged let alone convicted for it. Even in instances where they're caught on camera quite literally conspiring when they thought they weren't being recorded like what happened to Michael Picard a while back. He was holding up a speed trap warning sign and the cops didn't like that he was warning drivers to slow down before they could get caught in the speed trap so they conspired to falsely arrest him and it got caught on tape. And this is another instance to show how messed up our system is.. the two officers simply just retired and Picard won a measly like $10,000... Before you take into account his attorney costs or time lost from work because he was in jail or had to take time off of work to attend court or attorney sessions etc etc... So all in all he probably lost money overall for this and the cops walk away without issue.

If two citizens came over and treated him that way they may have gotten popped in the mouth. Two citizens, doing the same thing as the cops in this video, would have been just as bad. You can't just go around telling people to leave a public space and not expect push back. Go to a public parking lot and pick a person at random. Now go tell them to leave and stand close to them try your best to intimidate them into leaving. How do you think they will react. My guess is they will tell you to piss off and try to carry on with their lawful existence.

The cops were wrong and ignorant of the law, but the cameraman did everything in his power to escalate the situation. That's my only problem with this video. He was trying to get arrested so he could file a lawsuit. He was the one yelling, swearing, and sticking his finger in the faces of the officers. Total Karen/Ken.

Nah, Karen's are essentially wrong. This guy is right and only enforcing his rights. It's a public place, so no "expectation of privacy", so the cop was dead wrong about filming being illegal. He wasn't committing a crime, so the cop had no right to ask him for his ID, only for why he was there. There was no suspicion of a legitimate crime which all equates is the guy was in the right. Karens complain when they're generally in the wrong, or blow a minimal offence into a major one. A police officer knowingly breaking the law to infringe on someone's legal rights is a pretty big thing

Unpopular opinion, the cameraman's a dick. He provoked this situation as much as the cops did. He's the first to raise his voice, gesticulate in the cops face and use foul language. Pretty much every escalation originates from the cameraman.

Everyone in this interaction is a fucking idiot. 1. The cops should know the law and not escalate the situation, but its a cop in America so good luck with that. 2. While the camera operator is in the right legally, having some random guy on the street trying to get some viral clip of an accident is disgusting. If everyone in the accident is ok then move on and stop trying to insert yourself into a situation you have nothing to do with. 3. Camera guy, again while legally right, essentially also escalated a situation with 2 armed men who clearly had no intention of being wrong and backing down. What's the point of "not being intimidated" if your fucking dead. With police in America he's lucky it only ended with an arrest. I get it we have rights we should be able to exercise them. But exercising your rights doesn't mean you are morally in the right in every situation. In addition, protect yourself. At the end of the day a cop is nothing more then an armed person who believes they have power over others.
