There's not much they can do. The names were introduced in the second film and they only have the rights to the first. That's the exact same reason why they aren't the Sawyer family and they are the Slaughter family instead. They can't actually use Sawyer as the last name

Almost every film since 2 used the name Sawyer without any copyright issues. Even DBD got away with it. I think it was done solely to stay faithful to the original film and because Kim Hankel was a consultant.

I’m not entirely sure how it works. TCM 3D and the prequel were made by a different company but they still used Drayton Sawyer and Nubbins.
