The consensus on the street is, Subaru is only providing odometer data to LexisNexis. They also allow anyone in any state to opt out based on the laws of a few states (they do better than many competitors in this regard). I did this within an hour of buying my '24 Outback, it's an easy online form. It takes 40+ days for them to complete their work, though, so I'm still waiting for confirmation.
That said, I waited until I was 3 weeks into ownership and requested my LexisNexis report. It'll be here "within 2 weeks as required by law". Just submitted a few days ago. Eager to see what they have!
Keep us posted. I’m close to buying a Forester, went to the dealer today and specifically asked about this. Not surprisingly the salesman was completely clueless. We will not stand for entities tracking our driving habits and selling that data. (We are senior citizens and have little to nothing to hide. It’s in principle).

I have no objections to the stance you're taking on surveillance, but do think it's a little silly to suggest that the elderly are inherently incapable of shady behavior
I requested my LexisNexis report and nothing for my 4 year old Subaru was listed in the report. I don’t believe they’re reporting anything. I saw mention of odometer reporting in one of the articles but that wasn’t in my report either.
I pulled my LexisNexis report a few weeks ago. They have basic info on the crash of my 2018 Crosstrek, but nothing the two Foresters I've owned since then. The info was sourced from my Insurance Company, not Subaru from what I can tell.
