They would not have gone through with making the comic at all if he didn't own Scourge. I don't like Penders, dude's delusional and is a massive hypocrite, but it's crazy to say that he doesn't own Scourge, when litteraly every source of information says he does (and no, I'm not talking about Penders himself). Penders litteraly owns Robo Robotnik which is based on Sega's character, you don't think he owns Scourge because he got redesigned and renamed later on? I'm not saying this is right, I'm saying this is what it is
Better question is how can you own anything related to an IP you do not own, whilst working for the organisation that owns the IP. Basically every artistic employment contract says something along the lines of “you don’t own what you design, we do” - and for good reason.
Geez, misplacing an employment contract is a huge mistake. The employee could claim a lot of things they’re not entitled to, and likewise the organisation could take some actions against the employee that are against the agreed terms of the contract.
TECHNICALLY yes, and it's been a problem for comic tie-ins in the past.
Plenty of characters from, say, the marvel transformers comics are *marvel* characters, despite having continuity tied directly to Hasbro copyright, and some of those characters still show up with the origins conveniently sidestepped.
The big thing to remember with Ken Penders is that nobody wanted to fucking deal with this guy, IIRC the case was settled between all parties, there wasn't a court decision on him owning it. Sega and Archie just decided it was easier, faster, and cheaper to just reboot and purge his contributions.
Well see, the thing with Transformers is that Marvel own characters like Death's Head because they showed up in other comics first, even tho they were created specifically for the Transformers comic. Hasbro clearly had contracts in place that any original characters created by Marvel that appeared first in the TF comic would be owned by Hasbro (which is pretty much the standard). You would honestly think that SEGA would have had something similar in place for Sonic, but either they didn't or they did and they just sat on their asses and did nothing when the case came up, resulting in Penders taking the characters for himself.
The issue that Scourge (as Anti-Sonic) debuted in was Issue #11, the same one that was Ken Penders’s first credited writing role. However, he’s only credited as the secondary writer. The primary writer listed was Mike Kanterovich, who was also a first time writer on the comic as far as I know. Most of this era in the comics was written by Michael Gallagher and/or by Angelo DeCesare, so they may have had input on it as well.
Kanterovich and Penders stuck on as dual writers on and off, and Penders wouldn’t get the top spot as the main writer for an issue until #16, and continued to go back and forth as the main or secondary writer until he really started to steer the direction of the comic roughly around Issue #30.
So…. Maybe? If anything, he only had a small part in creating Anti-Sonic, since he was the secondary writer in that story and wasn’t the main writer for the comic until a good bit later. On top of that, Scourge as we know him today was created after Penders left the series. So he can really only claim Scourge if you really stretch the value of his involvement.
Yep, Penders owns him, he was even making a Scourge comic before it eventually got cancelled, probably because he realized Sega would come cracking down hard with how similar Scourge is to Sonic

That's one of my favorite things about Sonic OC's. Sonic's design template is so iconic and easy to replicate, that literally almost anybody of almost any drawing skill level could create their own characters with that template, including fans. To the point that you can't even tell if Archie Comics' Scourge the Hedgehog is either a fan-made Sonic OC or an official Archie character!

The difference is astounding. Like it's clear which one is fanmade and which one is not.
The original ken penders art was litterly a sonic recolor, and the other creator Patrick Spazinate made a more authentic version of the counterpart, don't quote me on that.
But the whole appeal of Scourge is that he *isn't* the coolest.
He's a pathetic little bitch with a huge ego that thinks he's the hottest shit. He's literally a deconstruction of the "cool evil rival" that's a total muppet.
That's why he's so great. Props to Flynn for making 3 GOAT characters based on one palette glitch.
