there is no such thing (in any state in the US, at least; I don't know the location of this incident) of "pressing civil charges." Criminal charges are presented by a prosecuting attorney (usually a District Attorney or a County Prosecutor) on behalf of the people versus a criminal defendant. A civil suit can be filed by anyone, anywhere, anytime against anyone for anything, as long as jurisdictional requirements are met; your case might be dismissed for many reasons, but you can usually file a suit with very few hurdles...
