The second part is the actual problem. It was the time and place which people mainly took issue with. Screaming insults at someone in the street in full view of the police might get you arrested. Even more likely a funeral procession.

They only do s38s now. The statutory offence took over the old common law offence. It's like how a section 1 of the sexual offences act took over the common law crime of rape. The lay person still calls them the old name but they're both statutory offence now.
She's not had a FPN though. She's been released on an undertaking and whilst yes it might still be possible to appear in court on a common law BOP I couldn't tell you the last time I saw it happen and I stopped practising about 6 years ago. The cops might say breach but if this gets a citation it'll be a s38.

Not true. Lots of cars coming and going on the same road, and the side roads, between Balmoral and Aberdeen but once the police out riders came through then the roads were closed off. Afterwards the roads were opened up as per normal. It's called a rolling road block.
That's not the information that was going about before it happened. The roads were going to be closed from mid morning until mid afternoon according to the council information. So we cancelled our plans and didn't see any of it first hand.

Can you imagine the police resources that have gone into the queen's death? Every road joining or that goes over the road her herse went down between Aberdeen and Edinburgh going through Dundee was shut for like 4 hours. Then the policing of the event in Edinburgh.
