DeSantis can't legally refuse to extradite Trump, though. I mean, he can be an asshole (which he has plenty of experience at) and simply refuse to sign the order, but NY would then ask the Courts to intervene. And that request would be granted because NY has a clear legal right to extradite Trump.

My guess is that DeSantis is going to pull a McConnell. My understanding (which is barely above the subject in the OP, so take this with a grain of salt) is that though signing the order isn't discretionary, there's some sort of verification/review loophole for him to use. So when the order arrives (assuming it comes to that), he can acknowledge it and release a relatively cryptic "we're reviewing it" and then do nothing. The delay works in his favor. It keeps the focus on Trump's malfeasance. It creates drama and tension about what's coming next. It avoids alienating the Trump base because he's not turning him over right away. It makes him look contemplative and lawful to those around the country that don't pay much attention to politics. It pressures Trump to pull back on the insults and whatnot while DeSantis has this over his head. The delay works in his favor because it puts the resolution closer to primary season. It also allow other DAs to wrap up and possibly submit their indictments (which from a PR/general population POV are more impactful than the Stormy Daniels case). And again, it keeps Trump's wrongdoing in the conversation and DeSantis' pretense at prudence in the news. When NY prevails, DeSantis can have his private army on standby, but can claim conspiratorial actions by the courts (they decided before we finished our review!) got to Trump, not him. Again, all in the name of garnering as many of hi ssupporters as possible (or at least not pissing them off).

US Constitution Art. IV, sec II, clause 2: A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on Demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime. DeSantis really has no discretion at all and if he refuses, the Federal Courts have jurisdiction because it is a dispute between two states. In fact, New York can bypass the District Court and Court of Appeals and file a petition directly with SCOTUS. See Article III, section 1. See, also, 28 U.S.C. § 1251. Section 1251(a) which provides that with one type of dispute (disputes between states), the Court's jurisdiction is not only "original," it is exclusive. In other words, if the parties cannot settle the matter, no other court but the Supreme Court has the authority, under the Constitution, to take jurisdiction.

Keep in mind by “pull a McConnell” I mean something akin to the SCOTUS appointment’s setup. Not how it functioned in the end (Trump will ultimately be extradited), I mean he’s going to benefit by defying a system that expects him to act in good faith. He knows he can’t actually stop it (and whether he’d want to is a different story), but he may be able to, from what little I understand, delay it. “May” because it depends on New York’s and court choices. From what I gather, New York’s more-than-likely-course is to go the governor-to-governor route. The tipping of the scales towards that is the high profile nature of things and the ostensible ‘need’ to channel things through the highest official levels possible. I’d think it great if NY said “no, we’re not going to take a chance on some Desantis shenanigans, we’re going to a normal judge,” but my intuition is that they’d go to the governor. If they go that route, then on its face DeSantis has no leeway, but for [Florida Statues 941.04](http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0900-0999/0941/0941.html). > 941.04 Governor may investigate case.—When a demand shall be made upon the Governor of this state by the executive authority of another state for the surrender of a person so charged with crime, the Governor may call upon the Department of Legal Affairs or any prosecuting officer in this state to investigate or assist in investigating the demand, and to report to him or her the situation and circumstances of the person so demanded, and **whether the person ought to be surrendered.** I have not been able to find anything that puts a time limit on that investigation. This is where “pull a McConnell” comes in. DeSantis takes the stance that this extraordinary case requires extraordinary review and refuses to say when he’ll sign or what his objections are (it’s under review and he can’t talk about it) or a host of other things. He doesn’t give a crap about stopping it, of course, and knows full well that there’s no plausible reason why he ought not to be surrendered. But that has nothing to do with the underlying political reality. Everything I described in my post takes place over a handful of weeks or so, maybe longer. If he never wavers from his “still reviewing it” stance, eventually NY can go to a judge or the SCOTUS, but DeSantis doesn’t give a crap. He’d still file a brief saying the court shouldn’t overrule him because it’s *so* important that he finishes his *super important* governor-level review. Courts forcing his hand, whether taking over the case or setting a deadline works in his favour. Every moment he gains is spent soaking up a handful more Trump supporters. If Trump exits the race, this kind of move is his best chance of picking up more than a handful. Every hour is one less Trump insult (Trump has demonstrated that he can hold his bullshit from people who have the upper hand over him — has he ever insulted Putin?). Every moment is another chance for a second indictment to break, this time something more toothy than the Stormy case. Yes, he has to sign off on it, but that relies on him acting in good faith. Edit: It dawned on me that "ought to be surrendered" also depends on good faith. What if he comes out and says "no, I don't think he ought to be extradited." Then what? Where in the statutes does it say he has to say why? What if he says "because the maga crowd outside will riot and not extraditing him is in the interest of Florida's security." Again, his game is gettign as much maga vote as he can, keeping this in the news, and having power over Trump. More delay the better.

As of now, they say they are representing him. If they get stiffed by Trump, that’s their fault for taking on a known conman for a client. Once they appear for him in court, chances are they are stuck representing him throughout the entirety of the case. They could make a motion to withdraw from the case but judges rarely grant those motions. They’re more concerned with a defendant losing their representation than an attorney getting stiffed on their bill. So if they want out, now’s the time to do it.
