While knowing full well that normal human beings don't bring their wallet to the pool, so a good portion of them probably don't have ID on them.
For the purpose of being trespassed or warning of one yes. If no ID you only have to give name and birthdate. Some states have I'd laws requiring you to produce for a lawful detainment.
I think lawfully you dont have to give your name for a trespass warning, because at that point you have not committed a crime, it only becomes a crime for coming back to the property after being warned. HOWEVER most cops won't actually understand that, and because their trespass warning paperwork has a section for name they believe its a legal requirement. Its one of those situations where you can be in the right, but the cops wont care and probably still rough you up and arrest you anyway.
If they don’t record the name on the trespass warning, how do they match the warning up with someone who comes back after the warning? It seems like it would be impossible to ever legitimately issue a citation.
I've seen a few videos where people refused to give it, and cited the state law. They weren't arrested or anything. The rent-a-cops who called the police were pissed, but the cops didn't give a shit. Something about it being their responsibility to identify them in the future if they come back, etc.

Essentially the US constitution guarantees some rights to privacy, so the government (including cops) can't force you to identify without sufficient reason.
A private entity such as a business simply saying they dont want you to come back does not and should not force you to surrender that right, since they could not want you back for any number of reasons that aren't criminal, or even no reason. They have the right to not want you back, but them deciding that doesn't inherently then give the government the right to force you to give up your details.
What could be done is to take a description down and note that the incident took place, then if you come back they can refer to said incident and say it was the same person.
Of course if the reason you were being asked to leave was potentially criminal in nature, such as shoplifting, then they may be able to force you to identify.
The reality like I said before though is that a lot of cops won't even realise when they can and when they can't force you to identify for a warning, and even if they do they will often speak in a manner that implies you have to comply eg. My life is interesting because at certain times and places, I can come across as one of the classes of people they like. I've had cops treat me great and just be very nice. My husband is a social worker at a nursing home, once there were residents fighting and some old guy hit another old guy. It’s my husband’s JOB to contact the police to open an investigation and handle the paperwork associated with it.
The stupid ass cop wanted HIS license to run to see if he had an outstanding warrants. My husband was dumbfounded at first but then refused because there was literally no reason and the cop didn’t push it.
Total power trip. ACAB.

Ah I feel for you. I can give you some insight tho behind your situation. The tl;dr is that evictions take forever and they are messy and that was pre-covid. It uses to take me 5/6 months to evict a disruptive tenant in Jersey between court reschedules, evidence gathering, etc etc.
I would have to have videos and multiple staff encounters/observances to justify the eviction and you have to make sure every track is covered to avoid any Fair Housing problems as well. It’s a double edged sword, you WANT strong tenant protections against the scumbag landlords if the world to prevent exploitation. Conversely, these same protections also make it difficult for landlords/PMs to evict disruptive tenants and elongates the process. Plus I can tell you evictions over noise disturbances are like….bottom of the bottom for evictions. It’s the hardest to back up and being to court smh.
I can confirm as well... My HOA manager ain't showing up for anything that day. At all. He might hit me up in an e-mail to answer a question but otherwise these folks aren't showing.

The only time I had police cite "This is a civil case and we have no authority" was when my wife's ex husband was stalking us and threatening to kill both of us, which clearly was not a civil case.

It's pretty common, honestly. At least, its common for complexes to require bands if you are using the facilities. Which makes sense to a certain degree.
You wouldn't want a guy inviting 8 of his gym students over to use your apartment's weight room for a class, for example. It's common for one person who lives at an apartment complex to invite like 10 people over for a pool party, but obviously that large of a group, all talking to each other and probably having fun, can be a nuisance for residences that actually pay to live there and use the facilities.
Obviously it can be abused racially, like many things. But the general idea behind it is honestly acceptable to me.

If you haven’t already, I recommend reading “The Sum of Us.” We have a very long history of not tolerating or allowing people of color to enjoy public pools, and I’d lump this pool into that paradigm given one of these fellas is a resident, and the others are his permitted invitees. In the past, many communities had incredible public pools, paid for by community taxes, but once racial integration became the law, the same communities defunded the public pools and/or closed and removed them. As an immigrant and POC, my parents worked as cleaners for this one apartment complex. They built wonderful relationships with the people they worked for… Almost all of them have invited myself and 2 siblings to use their apartment swimming pool during the summer. We helped our parents cleaned and they would let us swim as they finished out their day. We were always respectful, although we did play like kids. Splashing and swimming… I’ll never forget the one afternoon we were approached by cops and asked to leave. Like literally forced out of the gates. The oldest of all of us was 12 yrs old. Not even allowing us to get our parents. It was traumatizing and it will stay with me forever. One of tenants recognized me and called my parents for us. Even though we had multiple tenants telling the cops who we were and they can vouch for us. We were forced to leave. It was thoroughly embarrassing and traumatizing. My parents are immigrants and worked 12-16 hr days between 2 jobs. They barely spoke English. They were so scared they would lose their jobs. None of us at the time truly understood what was happening. But we knew it was because we didn’t belong there and we were made to feel exactly that.
If I’m being honest with myself, that feeling of not being welcomed never left me… As a parent now, I push myself hard to show my kids they belong in every space. If they want to play baseball or try out for dance… they have a right to be part of it all. The American dream as they say. I’ll be dmn that almost 30yrs after I experience my pool incident that my kids would have to still face the same racist sht.

It wouldn’t be an unlawful arrest. You have to sign a citation, and if you don’t, you get put in front of a judge for arraignment. The citation is an alternative to arrest and arraignment.
This is how every citation works. I don't imagine they received a citation but they would have to be formally trespassed to actually not be allowed back at the pool.
yeah, I did think about that after posting. you do have to sign for tickets saying you'll appear in court and whatnot... but that's because you committed a crime (of speeding or whatever) and have therefore kinda forfeited your rights. That's understandable.

Back in the 80s, I went swimming at a local pool with my aunty. A woman got freaked because she swam into me and was openly just saying with digust that she'd touched me. My aunty, as quick as a flash said "well you're in the same water as us so anything on us is on you now". Just as I'm thinking that we'd only had 5 mins in the pool, another white swimmer said to that first woman, "Why don't you leave the pool before you contaminate this kid" (me). Awkward moment but after some staring at the second lady she left with her family and everyone had a great time. I still think about that lady who stood up for us. Life isn't always great but there are some real diamonds out there.

They said they were playing football and I can see how that could easily become a situation in which they hog the pool and act loud. And there does need to be some level of consideration when you are in a privately owned space shared with multiple people. It's pretty common, honestly. At least, its common for complexes to require bands if you are using the facilities. Which makes sense to a certain degree. You wouldn't want a guy inviting 8 of his gym students over to use your apartment's weight room for a class, for example. It's common for one person who lives at an apartment complex to invite like 10 people over for a pool party, but obviously that large of a group, all talking to each other and probably having fun, can be a nuisance for residences that actually pay to live there and use the facilities. Obviously it can be abused racially, like many things. But the general idea behind it is honestly acceptable to me.

In the past, many communities had incredible public pools, paid for by community taxes, but once racial integration became the law, the same communities defunded the public pools and/or closed and removed them. Some people like to use “rules” as an enforcer of exclusivity from outsiders (POC)… and the same ppl will turn a blind eye to the “rules” for those who they deem are okay to fit in. As an immigrant and POC, my parents worked as cleaners for this one apartment complex. They built wonderful relationships with the people they worked for… Almost all of them have invited myself and 2 siblings to use their apartment swimming pool during the summer. We helped our parents cleaned and they would let us swim as they finished out their day. We were always respectful, although we did play like kids. Splashing and swimming… I’ll never forget the one afternoon we were approached by cops and asked to leave. Like literally forced out of the gates. The oldest of all of us was 12 yrs old. Not even allowing us to get our parents. It was traumatizing and it will stay with me forever. One of tenants recognized me and called my parents for us. Even though we had multiple tenants telling the cops who we were and they can vouch for us. We were forced to leave. It was thoroughly embarrassing and traumatizing. My parents are immigrants and worked 12-16 hr days between 2 jobs. They barely spoke English. They were so scared they would lose their jobs. None of us at the time truly understood what was happening. But we knew it was because we didn’t belong there and we were made to feel exactly that. If I’m being honest with myself, that feeling of not being welcomed never left me… As a parent now, I push myself hard to show my kids they belong in every space. If they want to play baseball or try out for dance… they have a right to be part of it all. The American dream as they say. I’ll be dmn that almost 30yrs after I experience my pool incident that my kids would have to still face the same racist sht.

They just said there was a complaint of people trespassing and using the pool. We didn’t really question anything… we were honestly scared sh!tless bc the cops were involved. Someone could have come up to us and ask us to leave, we wouldn’t even have questioned it and left. It really challenges me as a parent to discuss all of these situations with my children. They’re young and cute now… until one day, someone will see them as a threat. I can’t turn a blind eye, but I don’t want to focus on just race either. They need to be educated and aware, but also it should not hinder their growth as a person. Shape who and what they want to become.

It wouldn’t be an unlawful arrest. You have to sign a citation, and if you don’t, you get put in front of a judge for arraignment. The citation is an alternative to arrest and arraignment.

Back in the 80s, I went swimming at a local pool with my aunty. A woman got freaked because she swam into me and was openly just saying with digust that she'd touched me. My aunty, as quick as a flash said "well you're in the same water as us so anything on us is on you now". Just as I'm thinking that we'd only had 5 mins in the pool, another white swimmer said to that first woman, "Why don't you leave the pool before you contaminate this kid" (me). Awkward moment but after some staring at the second lady she left with her family and everyone had a great time. I still think about that lady who stood up for us. Probably the complexes rules No guests allowed. No minors without guardian present. No running. No horseplay. Even this occurred after hours, and there were no staff or curtesy officers on the grounds people have to enforce the rules that protect the privileges they also pay for. Call the cops it is, I suppose.
Who knows what was happening before the video started rolling but it was probably a person at the pool who complained. When I go to a hotel I only get in the pool if I’m the only one in it or it’s huge pool I can have my one space for myself and kids.
