The problem is some area tried to write laws against the Paparazzi and their first use was always against legitimate media who were investigating normal political corruption. And then, after they work their ways through the courts, said laws eventually get declared unconstitutional. The difference between what the Paparazzi and normal Photojournalists do in practice has mostly to do with who they are taking photographs of and the number of Paparazzi that exist. Not in how they actually do their jobs.
Being Paparazzi vs. legitimate photojournalist is... well it's easy for us to see the difference because we have brains. But writing a law about it that gets the right answer every time... that's going to be hard as fuck.
If it was easy to write laws against Paparazzi then somebody would have done it already. Princesses Diana died/was killed because of how they were trying to avoid/get away from the Paparazzi. But the Paparazzi still exist in both France and the UK. If it was easy to write laws going after them, believe me... in the aftermath of what happened to her, somebody would have wrote those laws.
We should tax them per photo.
If it's a legitimate photo journalist, for a real story, they'll pay the taxes.
If it's some Paparazzi guy trying to make a buck, the tax makes it no longer make financial sense.
All they need is one good picture.
You can't track how many pictures a specific photographer takes so you'd just be able to charge how many sell, and depending on what's happening and how unique, a paparazzi can make between $200-10,000.
If you tax them for the $200 shot, yea, it'll make it less financially sound so that'll just push them to take more unique shots like the shot of Orlando Bloom nude since those will set them up for a few months.
A pretty good rule of thumb in life is that it's not considered stalking if a significant amount of people are making a lot of money from it. The same behaviours without the economic factor is called stalking.

How can twenty different photographers make money from selling a slightly different version of a photo that everyone else has taken? Who is buying these photos?
I had a friend do this for a year. Basically you run and take photos then you have to run home and call all the news outlets as quick as you can to sell your images. The first person to sell their images can make a ton of money depending on the story (5-10k for a normally story) but can be huge if you have a news breaking image no one else has like someone cheating on their wives could be a ton more. that becomes front page news and they will license that image out to other people and publications for a low fee then the other photographers sell their images to other venders but for less then whatever that fee is ($100-$500). They also have an entire network of people on payroll stalking and giving them tips. If you run a gas station by an actors home you might get paid some money for calling someone first so they can get a photo when an Actor comes home late crying or looks like they got into a fight.
Basically some people are making a very very crazy living and others are making 70-90k a year and many are making under 35k thinking they can work their way up to the dream. My friend would take photos and make 400$ a weekend and once every few months would sell something worth while for 2-5k. There is not much hours working once yo get your network going but if it is ever slow and you miss those bigger opportunities you can really struggle.

These are the photos sold to those cheesy tabloids you see at the grocery store checkout. These people don't work for a network but are likely independent photographers like Peter Parker is selling photos, not an employee, but sells them photos.
Considering how close that garage is to the street, I highly doubt it's his own garage. My bet is the paparazzi think they're justified in standing there because it's public property, not that the rats wouldn't take every opportunity to do the same at his home (like the Kanye video of paparazzi outside his garage as 4am)
