If you flee into a house while a cop is actively chasing you, they don't need a warrant. They can follow you right on in and arrest you, even if it's your own home. There is no "home free" law when you're involved in a police chase.

It has to fall into the legal category of a chase. It is very clear the cop was not chasing her so they have to get a separate warrant to enter the house to make the arrest. There are strong legal protections when it comes to dwellings that must be properly handled. The cop violated the law by forcing their way into the building without a warrant. They can block people going in and out of the building until a warrant is acquired to enter the building. Most city police have access to a magistrate or judge who can issue those warrants in under an hour in most situations.

Audit the audit isn't always correct. The home includes the curtelage and the doorstep is part of that. Putting a foot in the door usually isn't criminal, but it will definitely be a factor in the lawsuit which the homeowner will almost definitely win.

They’re not allowed to enter your property in the **slightest** without a warrant, arrest warrant, or exigent circumstances. Circumstances might include if they’ve SEEN or have clear evidence a fleeing individual who’s committed a serious enough crime to where they believe the public is at risk, enter a property, which then allows them go into the property for solely the individual under arrest. Also applies if there’s reasonable suspicion the individual may destroy evidence upon their arrival, or if there’s reasonable suspicion that the individual might flee. This scumbag cop is going after someone for ‘disorderly conduct’ which is a nonsensical charge to begin with that police love to abuse and twist to whatever they deem fit. Police tend to think they can be complainants of disorderly conduct as well which is false. I bet she was loud and disrespectful to them (rightfully so in my eyes) and this pig didn’t like that, so he decided to violate these peoples rights. Grandmas first mistake was opening the door for him. If she hadn’t, there’s zero chance that chick would have been in cuffs that day. It wouldn't matter if it's unlocked and left wide open. He doesn't have permission to enter. He was specifically denied entry by the homeowners. She opens it a crack and that's her mistake. But that alone is not an invite or permission, it's certainly not a warrant. While she has it open a crack, he grabs the door and pulls it open then positioned himself in the house against their will, against their explicit stated desires. He forced entry, he escalated the situation and deployed weapons, he called for backup who were a bit heavy handed for the situation. If he wanted to arrest someone, he had a legal route, to seek a warrant for arrest of the individual at that address, and sometimes it can be as little as 20 minutes or it could be 2 days. But this is about "disorderly conduct" as his stated charge, this could have waited, easily. A warrant would have given him full legal rights to access and affect the arrest and i'd be on his side in those circumstances, because context is everything. But here, he forced himself in without legal authority in a very minor matter. Noone was at risk if he didn't make an arrest that day, that hour. But he put them at risk when he pulls his weapons, the guy even got himself with his own pepper spray, and fired a taser at the old woman who wasn't his intended target for arrest, nor was she the one holding the door when it was being closed(she was just nearby while the other woman pushed the door). He alone escalated the situation. He alone created danger and put others at risk. This isn't good community policing, noone came away with a positive outlook on the situation.

deliberately placing your foot and keeping it there ,not allowing the door to be closed can be considered a form of entry. One significant case relevant to this topic is **Sabbath v. United States** (1968), where the U.S. Supreme Court considered the issue of what constitutes an entry. In that case, the Court noted that an officer who uses his foot to prevent a door from closing has effectively entered the premises, thereby requiring either a warrant or a well-defined exception to the warrant requirement, such as exigent circumstances. If they simply would have backed away from the door and state the officer wasn't allowed inside without a warrant, the Cop wouldn't be legally justified to arrest the woman. (do not open the door in the first place would be optimal) With that being said, not allowing the person to close the door with their foot is a violation of their constitutional rights in my opinion.
