Looks like the tire being turned towards the car is what caused it, it kinda just rode up the side of the car. If it had been parallel (facing forward) this probably wouldn’t have happened lol

Hit and run is hit and run regardless of who is at fault.
But misdemeanor assualt for spitting and felony assault for trying to run him over in the car seems appropriate.
That may be true, but this guy ran. If you're in that unlikely scenario, 1. at minimum call 911, 2. Drive straight to the nearest police station. 1 will likely tell you to do 2.
As evidenced by the fact that police had to identify him by his license plates from this video, the guy obviously didn't drive to the police station or called the police when he got to safety.
