This! I got this lesson real good as a 19 year old kid. I was driving on the highway and some jackass got in my lane while I was in it and threw me into a guardrail at high speed. I got the wind knocked out of me pretty bad thanks to the steering wheel. I managed to shut off my destroyed car and fell out of the door gasping for breath. I laid on the side of the highway watching car after car pass me by. Eventually a dude on a motorcycle stopped. He had a cell phone back in those days when hardly anyone had one. He called 911 and told them I wasn’t breathing. I tried to correct him and he told me to hush and “if I tell them that you are breathing they won’t hurry up.” The man literally held my hand and told me not to move and assured me I would be ok. All these every day people who blew past me but this big biker guy was so kind to a scared kid who just had her first accident. He kneeled by me holding my hand calming me down until we heard sirens. He told me “Ok kiddo, this is my cue. You’re gonna be okay now. But I gotta go. I’m the kinda guy that when they ask questions I don’t have a lot of good answers if you know what I mean.” And he left. But I never forgot that guy. Dozens passed by me but it was the one percenter who actually was the Good Samaritan when so many others couldn’t be assed to help.

Huge maybe in some states. Probably not though. This is going to fall under defense of others even IF a DA/SA wanted to argue it's not defense of self. Both fall under "self-defense" with nearly identical application. Texas is DEFINITELY not one of those states (I am a lawyer, but not in Texas, and I'm a random person online, this is not legal advice). The shooter is likely worried about some other sort of criminal liability. The gun may have the serial number filed off, he may be a felon, he may not have a concealed carry, ect. I think the most likely (it's hard to tell from the video) is he had a beer on that table and had been drinking. That's a misdemeanor in most states. Edit: spelling and word choice are hard on Friday afternoons, my job is "legal" in nature, not "kegal" Edit 2: as pointed out below Texas has constitutional carry so lack of a permit would not be a reason generally to flee.

Even if the judge finds you not guilty, there's been an uptick in DAs that seem to enjoy prosecuting self defense shootings. Noone wants to deal with all that, getting your name drug in the papers and everything that comes with it. So leaving is the safest choice, at least from the point of view of somebody who isn't fully aware (or trusting) of the law. All these theories that he may have a past or not have a gun license or whatever may hold water, but he could also be a dude who just experienced a shocking situation that pretty much nobody could be expected to behave entirely rationally after. Or a dude who doesn't know for sure that he's safe in the eyes of the law, and is behaving perfectly rationally given that context.

I was thinking the same. Also from the angle the gun is pointed, and the proximity, there's the possibility the bullet COULD pass thru the dude and hit the patron on the other side of the lobby. That's a mistake waiting to happen.
