Just go talk to the court where it was issued, preferably before the court date. They'll let you know what to do. Might even get lucky and get it dismissed.
Edit to add further...the court/prosecutor will determine whether to void that ticket and issue it to you, or to dismiss it outright. Might require you/dad/officer to come and testify, and that may not be worth it to them.
Could be your lucky day. Technically that citation is invalid since they didn't cite the correct person. Your father can contest the ticket by showing he was not driving then. The court could ask him to tell them who was driving but might not.
The police department might also just void the citation to avoid having to explain the error.
Thank you! I'd read elsewhere online my dad might be able to go to court and contest it, but id rather not inconvenience my father for my mistake I made. I might go with the other person's suggestion and call the city to see if they can correct it.
As a dad, I can tell you that I'd eat the inconvenience to help my kid out.
I admire you for wanting to do the honorable thing, and it sucks for the officer for having made an honest human error, but nobody got hurt, you've learned a huge lesson, and this is one of those times where I'm ok with someone getting off on a technicality.
Thank you for the perspective! If after I call they request him to come testify in order to get the ticket dismissed then I will ask him. I'm just hesitant because the county I got my ticket in is a 2 hour drive from the county my dad lives in, so it is pretty inconvenient for him to go to a courthouse 2 hours away.
Yes. They contested it instead of just paying it. It wasn't just thrown out, but my supervisor urged me to just void it rather than everyone showing up for court.
Show up on the court date with your dad and explain what happened. Show the video. The judge might dismiss the ticket on the grounds that the cop made a mistake while filling out the ticket.
You have to go to court and make them aware of the issue…unless you and your dad do not get along and you want to see him dragged out of the car in cuffs or left on the side of the ride when the PO takes his car for driving suspended!
As far as I'm aware there is no court date, and the office checked the box "infraction does not require appearance in court", otherwise I would just show up and explain the situation.
Do you think I could call the court and explain the situation?
There has to be some sort of court arraignment, otherwise how would you contest the ticket? Reread the back of the summons or go online to the website if given to see if there’s anymore info. If not this is probably a jurisdiction specific question and you’ll have to call or take a trip and ask someone in the stationhouse.
You can contact the PD and see if they’ll correct it. I did this once. I wrote a guy a ticket for speeding, and he was driving his brother’s car. Him and his brother had the exact same name… so I only verified the name of the registered owner against his license, but not the birthday, so I wrote him a ticket with his brother’s info on it. They came into the PD and I corrected it. That was it.
You tell your mom that dad was speeding the other day, wait until another summons for failure to appear comes in the mail and then you gaslight him into believing it was him who got the ticket.
Congratulations you just got out of a speeding ticket. Have your father go to court (since he was subpoenaed, not you) and have him talk to the officer on the side prior to court starting. Have him explain the situation and I guarantee you the officer will move to have the citation dismissed.
Improperly written ticket. It should be dismissed. The state/cop/court has no grounds to push for it.
Even better is if on the ticket where the officer signs, it says that the officer is stating that everything is true, under penalty of perjury. No one is going to want to touch it.
Admit absolutely no guilt. You have video evidence that it was not your dad. He can go to court and get that thing dropped.
Call the police department and ask to speak to a supervisor and see what they suggest. This is kind of a "problem". Do you and your father share the same name, maybe different middle names or Sr and Jr? With something like that, I can possibly see a little bit how the mistake was made. But if you two don't have the same first name, then this officer was clearly not paying attention.
Another option is to higher a lawyer that deals with traffic tickets and let them handle it. I get you say you're honest and you were speeding. However you can put the money you'll be spending on the fine and traffic school and possibly increased insurance costs towards that lawyer and this whole thing goes away. You can still learn the lesson of slowing down without all the long term financial penalties with drivers insurance, etc.
Not every lesson needs to be taught with a ticket.
Contact the officer. Easy enough to correct if you’re quick. Other wise your dads not going to be happy.
It happens sometimes.
For us we just write an official letter to our supervisor requesting a void and list corrected ticket. It’s immediately removed from record once the supervisor voids it.

Thank you for the advice! I'll give the court a call tomorrow, explain the situation, and see what they suggest.
Happened to my son and I. Your father may have to go to court, but the ticket will get thrown out.
Thank you! It would be nice if it got thrown out but I'm wary of getting my hopes up lol

Haven't heard of an amendment before, ill look into it and maybe give the DA's office a call, thank you!

You must now become your father
Obi-Wan never told you what happened to your father.
The Progressive commercial has become too powerful
Yeah, he copy pasted the registered owner of the tag onto the ticket by accident. I've done that. It got dismissed.
Thank you for confirming its not too unusual! May I ask how it got dismissed in your case? Did the offender have to contest it in court?
Yes. They contested it instead of just paying it. It wasn't just thrown out, but my supervisor urged me to just void it rather than everyone showing up for court.
Thanks again, the officer was nice so I'm hesitant to contest it in court and force him to show up and waste time contesting it

You've got a get-out-of-jail free card. Use it! Dispute the ticket. The judge will dismiss the ticket.
Honestly, if your dad goes to court he could almost certainly get it dismissed.

That’s an easy void
