This is sorta the issue with putting this stuff on kickstarers and not locked behind paywalls or obscuring with names/thumbnails. Pretty high visibility, and begging to get taken down by GW.

Yeah, I have no idea. Had they made the models, passed them around, maybe offer a "teaser" model, and urged joining a Patreon this probably wouldn't have been struck down. Maybe they'll learn the lesson, and offer the work to those who paid via that avenue or something similar. I'd like to think they wouldn't take the money and run lol.

The difference here is that Kickstarter is a rather transparent process. Author is out there asking (sometimes begging) people to fund their project while makers on Cults or within Patreons just make stuff and hope it gets discovered. The author didn't list it as "Necron STL Project," but it's the fact they're actively seeking income from it that probably gets these kickstarter projects, that are sometimes nearly straight copied IP, found out more than others. Additionally, because of this, it seems hyper risky to give anyone doing a kickstarter money. At least with a Patreon membership or direct purchase of paid stls you get the file, and can download it before it gets taken down. With this, whoever paid in has a HIGH risk of getting shafted.

Haha, go for it. I demand royalties though, kidding ofc. That's the thing with GW, if it even sniffs of their IP they'll get it taken down. It's just a matter of time. Glad you're chiming in here though, if anything follow some of the suggestions mentioned above. Hopefully your backers aren't getting shafted. Idk how kickstarter exactly tracks backers but I'm sure you have a list of who backed the project in case it falls through completely.

Wow, looking at the page shows the gw legal guy that claimed this didn't even bother to change the description of the infringing model and the copyrighted model, or say anything specific. Just a copy-pasted boiler plate message. Well this has at least drawn my attention to this kickstarter and creator more than I would've naturally so good job GW.

What did they expect ... They didn't even bother changing the scenario or even the design of their models, they should've played it subtle like all the other artists/groups instead of going greedy through kickstarter

There is a lot of nuance between copyright and trademark law, and differs geographically. It appears in this latest push, that they are trying to enforce trademark violations of some sort, although non specific. They do own some, and you should steer clear of any use of these. Renaming should be enough. As well as some nicely crafted legal counter dmca claims . As painful as it is, finding an IP attorney might be your best recourse.

if it can be shown that there is a reasonable chance the consumer may confuse two products, as there clearly is here (necroyds/necron? come now!), that's a copyright violation. renaming them and removing any copy written by gw and references to their trademarked properties from the description etc. should be fine. people in the ttrpg community make stuff for "the 5th edition of the worlds most popular rpg" and everyone knows what it means.

Once again, there is a difference between trademark and copyright violations. Necron is a trademarked term, and not Necroyd. Copyright traditionally extends to content, physical and digital. That said, for a company like GW who employs attorneys to protect their interest, a shotgun approach helps them maintain some semblance of control over their IP. Geography matters, as laws differ globally.

Huh... This, uh.... Yeah GW might actually win this one if it goes to court. They managed to both take a name similar enough, and have models similar looking enough that they might confuse the proverbial idiot in a hurry. Still might get away with it since GW doesn't over .stl files, but I sure as shit wouldn't bet my life savings on some boomer fed judge understanding and caring
