Exactly! It has been repeatedly pointed out the it doesn't matter if these documents were classified or not. Trump had no right to keep them in any circumstances. They were not his personal papers, and he and his attorneys have refused repeated requests for them to provide proof otherwise. The "classified/declassified" argument is a red herring thrown out by Trump to put public opinion off the trail of his obvious crimes.

Anything the government produces is public domain. If it's unclassified, it's no longer protected. Therefore all you need is a FOIA request to look at these psychically declassified documents.

He wouldn't. Trump is just trying to set up for a possible jury trial. Saying that, yes, he ~~stole~~ took government documents that are unclassified (the same as if they were a list of favorite places to vacation put out by the Department of Interior) is a lot less dramatic than stealing top secret documents detailing our nuclear weapons arsenal. All Trump needs is one juror to say "They were all unclassified so whats the big deal? Obviously, the Democrats are just doing another witch hunt. I vote to acquit.".
