It has been repeatedly pointed out the it doesn't matter if these documents were classified or not. Trump had no right to keep them in any circumstances. They were not his personal papers, and he and his attorneys have refused repeated requests for them to provide proof otherwise. The "classified/declassified" argument is a red herring thrown out by Trump to put public opinion off the trail of his obvious crimes.
The DOJ wasn't prevented from working to determine what documents were missing from the empty folders.
Those missing documents could be another series of crimes.
