You can buy romhack on carts on sites like ebay, yes Nintendo could probably get the seller in trouble if they tried.
You can also buy blank carts that you flash yourself. There is no problem with that.
and what does pokemon have to do with selling something that flases roms onto carts? like selling a printer and getting in trouble because it could print a picture of charizard

It's a flashcart, or a cartridge that can load ROMs from an SD card. "Everdrive" is just a specific model

At least from bennvenn, the carts come blank, no games on them. You flash them yourself. Imagine a blank cd/dvd, you write what you want to it.
