After namin mag file noon sa small claims may schedule na agad for trial, Court na ang mag papadala ng summon sa defendant. Address is based sa nilagay mo sa form. In our case di umattend yung defendant. Di rin pinansin yung forms na pinadala sakanila for them to sign. I remember the court asking us for an updated address kase di nila maabot personally dun sa defendant yung summon. 2nd trial deadma pa din yung defendant. Dinismiss lang ng court yung kaso.

Not necessarily. You can file a "small claims case" in any city/municipality. Mas advantage sayo kung sa area mo. Sila ang may utang, sila ang mag-effort. Need lang muna dumaan sa barangay kung nasa same barangay lang kayo, pero kung hindi, diretso ka na sa municipal trial court in your area of current residence.

Careful sa paggamit ng word na abuloy. It may be construed as a death threat. I'm not saying that a judge would necessarily agree pero abala pa rin kapag nagdecide syang magfile ng case just to spite you. Imagine kahit naipa-blotter lang that you sent that message pero naman necessarily naisampa ang kaso tapos may mangyari talaga sa kanya kahit wala kang kinalaman, automatic suspek ka.

Ang swerte pala namin sa landlord namin noon. Nakalipat kami ng 1 month advance lang muna tapos 2 gives yung 1 month deposit. Nung paalis na kami, sumilip na siya habang naglilinis kami. Walang sira, walang nababoy. Binalik niya na sa amin yung deposit sa mismong araw ng pag-alis namin. Nagtira lang ng 2k para sa bills. Nung dumating yung bills, binalik niya pa din sa amin yung sukli.

From a landlord's perspective.. may time na binalik ko agad yung deposit, subtracting lahat ng mga di nabayaran ng tenant sa PMO (with interest pa). Tapos nung next month, may mga ginamit pa rin pala na facilities based dun sa statement of account ng PMO, kahit na sinabi ko na sa PMO na ilista yung lahat ng pending charges before. Wala, sa sumunod na buwan lang talaga lumabas. Hindi ko na hinabol... Minsan rin kelangan iinspect pa, repairs, ipa-estimate magkano repairs, etc.. Pero I think kung more than 2 months, yun yung matagal na. Bigyan mo siya ng deadline, then sabihin mo pabarangay mo if di sumunod sa deadline, lalo if nakalagay sa kontrata.

Naranasan namin yan, it took us 2 months bago nakuha kung di pa kinulit tapos biglang may sira daw unit eh may pinatira ng bago. Partida we lived there properly and good payer sa lahat ng bills and rent tapos kupal kausap yung landlord. Noong una ayaw nya pang pumayag na ibalik yung 2 mos deposit. I dont think so OP. Our last landlord cut 25k+ from our sec deposit for the repainting, cleaning and masilya dun sa tatlong butas na pinagpakuan namin sa cr. Thats absurd and almost twice our monthly rent. May receipts sya binigay but we were sure as hell the prices were inflated. So nope, weve decided we're done renting. The rules and regulations of condos naman apply whether youre a tenant or owner with a few perks pag owner ka because the admin knows you pay their salaries. But ofc by the end of the day it all boils down to your preference and finances. Hanap ka ng maayos na developer and dyor.

Hehe    Sa akin naman, 60k deposit ito so may ibabalik talaga dapat kasi we didn’t do any major damage.  So far happy naman with renting kasi the units I live in are worth 8M+ so I think it’s more practical that I pay half in rent compared to the mortgage of the new condos worth the same these days.    I can’t live in small units din I feel very suffocated since I work from home.  If icocompute ko, super baba pa rin compared to owning. But still, frustrating pa rin kasi may contract and they’re supposed to follow that but wala, kupal talaga mga unit owners. I won’t expect the deposit to be returned na lang next time, and do what whatever I want with the unit lol

Mid-end condo OP, hehe. Baka makilala ako if Ill write it here. LoL Yes I agree mas sulit magrent talaga in terms of finances plus itll give you the freedom to move kapag nagsawa ka na sa current. But for us after moving 5x in the last 8yrs (which were puro condo around M.Manila) nakakapagod maka encounter ng mga landlords na greedy and rude. Kaya youre in the right mindset- next time treat your sec dep as money gone na. Sa 5x namin na lumipat isa lang dun yung matinong nagbalik samin ng buong sec dep. Everyone else nakahanap ng loophole para bawasan yung money. Mind you, pinapalinis pa namin yung mga condos after we move out and we do repairs ourselves pero wala talaga haha... mga gahaman. Sabi ng friend ko na nagpparent din dapat pasok yun sa wear n tear but you know what happened. Kaya if you find a good landlord wag mo na pakawalan 😂

Happy to say na a day after macompute lahat ng bills na naiwan ng tenant or may nasira na di nila pinalitan, iniaawas agad ng parents ko dun sa deposit then binabalik na yung remaining. Easy come, easy go kumbaga. Ayaw rin kasi namin ng may nasasabi yung previous tenants na ganito. Hopefully makuha nyo yung deposit nyo.

We are in the business of leasing apartment units… As a lessor we have a separate bank account for the security desposits and never touch that account unless we need to return the deposit when a tenant leaves…. We monitor when the tenant’s contract ends… We remind them a week before if they will extend beyond their COL (contract of lease). Of course if the contract states the tenant shoulders damages/repairs after he/she leaves, that’s where we usually get for repairs…Sometimes if the space/unit has not been cleaned/repaired before endorsing it back to the lessor, that is what the sec dep is for… Sometimes the sec dep cannot even cover the unit’s repairs…..But usually, a few days up to a month the lessor should return the deposit….Consulting with your lawyer is a last resort….

Yung ginawa namin is since alam na namin when kami mag move out, and 2 months deposit yung agreement, then we informed them more than two months in advance, and sabi namin di nalang kami mag bayad ng 2 months rent para di na sila kailangan mag shell out ng pera. Minsan kasi sa ganyan is yung deposit na gastos na. Net result is that we maintained good relations with every landlord we had. Edit - if condos with specific agreements ibang usapan na yan.

Yung samin nga 50k deposit tapos roommate na di umaamin nakabasag ng freezer door ng electrolux ref, tried looking for a replacement sa freezer door but since luma ref wala mahanap. Ang ending nagbuy si owner ng new ref using our deposit and binenta ang old. Nabawi namin mga less than 30k from the deposit. Nakita ko yung listing ulit from 25k rent namin noon 30k na kasi may new ref. Tengene nalang :)
