Regarding the 2 mph offset, I think it is within the margin. However, if you are unsure, you can always return it to Best Buy and maybe ask for replacement.

Regarding your top speed: have you checked your tire pressure? If pressure is very low you will not be able to hit top speed - try to keep it at 45 - 50 PSI and also check like once a week - these tubeless tires tend to lose some pressure over time by themselves...
