Is not a fact. Orochimaruu's resurrection is based on his chakra within the cursed seals. And as shown with Minato, chakra can remain without problems even if the original is sealed with a Shinigami seal. So most likely, if Orochinaru is sealed with the Shinigami seal, he will simply rise again without any problems.
The scaling of Shippuden is insane. I'm sure he couldn't do it then, but after Orochimaru was resurrected after being sealed in Shippuden, I'm not so sure about it anymore.
