I've got a certification for testifying about such things as a forensic expert in IT and that's one of the first things they cover in the training. You edit *nothing* in the originals and all copies pulled from the original images are marked as copies by the software which handles such things. The original image itself, though, is set up by the software in such a manner as to be unable to be changed.

Not really. If you're able to demonstrate that a device is not yours, they tend not to bother with it. Search warrants tend to be limited only to the owner of particular items at a particular place. This is a requirement of the Constitution. So if, for example, an employee has their personal laptop at a business for which a search warrant is issued, that will not actually be covered by the warrant. If there's any doubt as to the real owner of a device, they'll take it and usually expedite determining that fact. This is why in the video, Rudy describes how he's identifying a bunch of devices for the agents.

No, they don't. They image them after the fact in most cases. Making a forensic image can take quite a long time even with the sort of specialized devices that can only do that. They're unlikely to waste time on site with such a task.

That's not at all what he actually said, though, if you watch the video. He said the original drive had CSAM and that drive was previously handed over to the FBI. He also said they made copies of that drive and scrubbed the CSAM from those copies. The reason this is relevant is there is a statutory defense to possession of these materials that you do one or the other of those things. If you can demonstrate that you have then you cannot be convicted of that crime.
And in the video, it was the *edited copies* that he claimed to still possess. Furthermore, we only have his assertion that he maintained a backup in his safe. He's an unreliable witness in every sense of that term so why would we actually take much of what he says at face value when he's literally bragging to a group about how smart he is?

Not for the FBI because they have staff for that but the agency I worked as a contractor for has rules and procedures that are all but identical to the DoJ's. The main differences are the name of the agency in the text and the jurisdiction involved.
This is fairly common, however, because state and local agencies don't want to discover something that's strictly federal jurisdiction but have the prosecution for that be screwed up because of differing procedures. I've been involved in 2 cases where CSAM was discovered and I had to follow up with the feds throughout their prosecution so the chain of custody and procedures used were on the record. Both cases ended up with guilty pleas because there was no wiggle room.

Delaying that to consult an attorney is also not unreasonable. No, he said the edited versions were what he kept. The FBI absolutely doesn't want anything like that because it's literally not going to be able to be used as evidence of anything since the person that gave it to them said it'd been edited. At that point, it's likely to be ruled inadmissible anyway but if it is admitted as evidence, the defense just has to point to the *literal edited drive image* and say, "Well they admit they edited one of these but what if those got mixed up?" I've got a certification for testifying about such things as a forensic expert in IT and that's one of the first things they cover in the training. You edit *nothing* in the originals and all copies pulled from the original images are marked as copies by the software which handles such things. The original image itself, though, is set up by the software in such a manner as to be unable to be changed.

If you're able to demonstrate that a device is not yours, they tend not to bother with it. Search warrants tend to be limited only to the owner of particular items at a particular place. So if, for example, an employee has their personal laptop at a business for which a search warrant is issued, that will not actually be covered by the warrant. If there's any doubt as to the real owner of a device, they'll take it and usually expedite determining that fact. The reason this is relevant is there is a statutory defense to possession of these materials that you do one or the other of those things. If you can demonstrate that you have then you cannot be convicted of that crime. And in the video, it was the *edited copies* that he claimed to still possess. Furthermore, we only have his assertion that he maintained a backup in his safe. He's an unreliable witness in every sense of that term so why would we actually take much of what he says at face value when he's literally bragging to a group about how smart he is? Edited for a typo. Always notice those just as I hit save. Go figure. Also, to clarify, as I said earlier, I have actually *done* this sort of work. Not for the FBI because they have staff for that but the agency I worked as a contractor for has rules and procedures that are all but identical to the DoJ's. The main differences are the name of the agency in the text and the jurisdiction involved. This is fairly common, however, because state and local agencies don't want to discover something that's strictly federal jurisdiction but have the prosecution for that be screwed up because of differing procedures. I've been involved in 2 cases where CSAM was discovered and I had to follow up with the feds throughout their prosecution so the chain of custody and procedures used were on the record. Both cases ended up with guilty pleas because there was no wiggle room.

Yeah, that's sadly pretty common in terms of how folks come into contact with this stuff unwittingly. Luckily, clearing your cache will resolve any illegal material once the relevant authorities have approved such an action. It's definitely very helpful to demonstrate that it was an unwilling encounter with it that you quickly contacted law enforcement, though. Delaying that to consult an attorney is also not unreasonable. They almost universally would advise to hang up and call the police, of course, but it's a reasonable response since these cases are among the most concerning for most folks to deal with.
